DAILY NEWSPAPER July 5, 1927 PASSENGER TRAIN KILLS OLD MAN AT HAW RIVER James Alvis Small, 77, was instantly Killed Sunday Morning Near Haw River Underpass As He Walked Upon Tracts --------------------------------------------------------------------------- Funeral Services Held From His Home --------------------------------------------------------------------------- Service Held In Haw River Monday Afternoon By Rev. Cook Of The Baptist Church, And Robert Councilman Of Burlington. Funeral service for James Alvis Small, 77, who was instantly killed Sunday morning by a Southern passenger train west of the Haw River underpass, was held yesterday afternoon from the home in Haw River, by Rev. Cook, of the Baptist Church, and Robert Councilman, ministerial student. The aged man is said to have walked toward the tract from his home and to have continued directly in front of the locomotive. Someone is said to have called a warning to him, but is not believed that he heard this. He looked up about this time, however and threw up his hands. It is thought he did this when he saw the engine upon him, or suddenly heard the noise. The scene of the fatal accident is at a point between a cut and a fill, where in years gone by a grade crossing was. Since the road changed, people have used the place for a pathway across. Almost opposite is a filling station to which some believe the deceased had started. For a mile or two west of Haw River the railroad is down grade. Trains roll out of the curve cut without the noise they make when pulling and glide out upon the fill. Johnny Newlin, one of the witnesses, stated he did not see the train actually strike the body, but saw it hurled up 10 feet in the air. It fell back upon the pilot and then rolled off upon the track and under the wheels. It was badly mangled. L.P. Kimrey was another witness who saw the accident practically as Mr Newlin did. There was a third witness whose name could not be learned. These witnesses say that the train did not blow its emergency warning as it usually does when something is sighted on the rail close to the approach. None have stated the train blew nearer the scene than back above the cut where the mile station post is, where it regularly blows. Happening on the side of the fireman, probably out of his seat for a moment. It is believed that neither he or the engineer observed at any time what had happened. The train rolled on to the Haw River station, 500 yards east, made its accustomed short stop, and pulled out. There is said not to be a record of a train doing this having actually observed an accident, especially when it involved a person. Mr Small even at 77, was an active man, and those who knew him declare that it is a certain thing that he did not see or hear the approach of the train until it was too late to avoid being struck. The body was taken to the undertaking parlor of Green and McClure in Graham, and for burial. Besides his wife, the former Mattie Andrews, the following children survive; Grover of Roanoke, Va; Mrs Della Daniels, Graham; Mrs O.C. Cole, Mebane; Miss Gena, Dillard, Otha, and Miss Dora, of Haw River; also two brothers, Thomas, of Graham, and John William, of Burlington, and one sister Mrs Dora Teague. The pallbearers were, Marshal Blackmon, Ed Minnis, Bill Terrell, John Ray, W.E. McCracken, and Mr Woods. There was a large crowd at the service, showing the esteem in which the deceased and members of his family are held, and a profuse floral offering. *************************************************************************** My Mother, "Miss Dora" was 13 years old when her father was killed, she is the only surviving member in this family. I would have LOVED to have known this man, he ran a General Store on the west bank of the Haw River. Born in Rockingham County, NC, came to Alamance County in the 1880's, married first, Bettie Bryant of Virginia in 1883, and second Mrs Mattie C. Andrews Cates of Orange County, NC in 1903. I am at a loss to identify my Ann Sharp. Ann married Lawrence KINNION/KENION 26 Jul 1783 in Orange Co. The following abstract would indicate that Joseph Sharp of Hillsborough was her father or brother. 1797, Nov Term at age 11 years and 4 months, Paul Kinnion, orphan son of Lawrence Kinnion was bound out to Robert Eaton to learn the art and mastery of carpentry. Aug Court 1798 ordered that Paul Kinnion an orphan boy of Lawrence Kinnion now of age _________ be bound to John Carter to learn the art and mystery of a farmer. In the same month the court again ordered Paul Kinnon now of the age of thirteen on the 3rd of July next be bound to ________ (unreadable...could be a Mr. King or Mr. Henry). On the 30th of Nov 1799 the court of Orange Co., NC ordered the sheriff to remove Paul from the home of Joseph Sharp in Hillsborough and he was then bound to William Roberts. Have you any information that may help me? 1800 census shows Joseph living alone and apparantly elderly. He married Sarah CATES, daughter of Thomas and Martha CATES. They had five children. This family lived on New Hope and Collins Creeks, Orange County, Richard signed as security when his brother William qualified as Administrator of the estate of their father on 28 Aug 1866. "Rich CHEEK" was named as a surviving son in the petition for sale of land of their father on 30 Aug 1866. He died during the fall of 1868 and was buried at Cane Creek Church, Orange County. 10...Alfred CHEEK, born 1817. House #568 in the 1850 Census of Orange County consisted of Alfred CHEEK, age 32, and Renny CHEEK, age 28. They apparently had children: the Court petition of 30 Aug 1866 lists as grandchildren "heirs of Alfred CHEEK", but they are not named. 11...Wesley CHEEK, born 1820. He married Euphemia ---?, they had one daughter. At the May 1847 Term of the Orange County Court there was a petition by "Eupheme CHEEK", widow of Wesley CHEEK, dec'd, who "departed this life in the month of April 1847, he died leaving his widow and a child under age unprovided for"; petition to allot a year's provisions. William CHEEK qualified as Administrator, and provided support for the widow and child. A report of sale of personal property was made at May Term 1849, and a final inventory was filed on 1 Aug 1849 (Orange Co Estate Papers, NC Archives). In the 1880 Census, "Euphemi CHEEK, widow, age 54, mother-in-law" lived in the home of Sidney C. and Mary B. DURHAM, Bingham Township, Orange County.     3. Part 2...continuing the children of Robert "Robin" CHEEK, and his wife Patsey ANDREWS of Orange County, NC. 4....Robert CHEEK Jr, born 2 Aug 1805. He was married on 15 Dec 1831 to Elizabeth ROBERSON, daughter of Merrett ROBERSON and Sarah BAILEY, with Henry CHEEK as witness. They lived in the area which is present day Alamance County, and had seven children. His will was dated 1 April 1865 and was proved at the Dec 1865 Term of Alamance County Court. The will named his wife Elizabeth executrix, and gave her full use of land and property for "as long as my children stay with their mother", and named four children then living with her (Alamance WB-1:248). note: ( Marriage Bond gives name of wife of Robert Jr. as "Elizabeth ROBINSON") 5... Mary Ann CHEEK, born 1807. Neither she nor her heirs are listed in the Court petition to sell land of Robert CHEEK, dated 30 Aug 1866. It is assumed that she died without surviving children, prior to that date. 6...Henry CHEEK, born 1809 (age 41 in 1850 Census). He was married in Orange County on 2 Jan 1829 to Silvia WILLIAMS (b. 1807), daughter of David WILLIAMS (Marriage Bond). They had seven children. On 27 Nov 1860 "Henry CHEEK and Silvey his wife" sold to Frederick WILLIAMS an undivided interest devised under will of her late father, David WILLIAMS, in one tract of 340 acres on waters of Cane Creek and in another tract of 140 acres, residence of the late David WILLIAMS, adjoining Richard JONES and heirs of James WATSON (Orange DB-36:314). In the 1880 Census, Silvia CHEEK, widow, age 77, was living in the home of her son, Henry CHEEK, House #194, Bingham Township, Orange County. 7...Merritt CHEEK, born 9 Oct 1811. He married first on 1 Jan 1832 to Fannie HUNTER (Marriage Bond). They had three children. He was married second on 25 Jan 1848 to Elizabeth WEAVER (b. 1824). They had one daughter. Merritt CHEEK operated a cotton brokerage business in Chapel Hill, NC. He was elected Constable of Chapel Hill Township on 5 Aug 1869, and was elected first Mayor of Chapel Hill, 1879-1881. He was also Orange County Commissioner, 1884-1886. He signed as security when his brother William qualified as Administrator of the estate of their father on 28 Aug 1866. Merritt purchased the land of their father sold under Court order, 80 acres adjoining William CHEEK, the sale confirmed at Nov 1866 Court. In the 1880 Census, Merritt and Elizabeth CHEEK were living in the home of Ruffin WHITAKER, husband of their daughter Sarah, in Chapel Hill Township.     3. Folks, Many of you have misunderstood a message that I sent this morning on the A.B. Markham Maps of Orange County, NC. Instead of replying to everyone that has written to me about "the book", I am sending one answer to the list. THIS IS NOT A BOOK but a huge rollup type map mailed in a tube. Mr A.B. Markham researched Orange County for over 20 years, he then drew up this map, included an index of surnames, and the years that those folks acquired the land, he then obtained a copyright on his work in 1972.     2. A paper written in the 1880/90's (can't recall) by Alvis J. Bynum, of current Chatham Cty., from info received through an interview with his uncle said that when Luke Bynum of my line settled on the Haw River/Pokeberry Creek in then Orange that there were Indians still living in the area. This was in 1744, even before there was an Orange Cty., actually. John Patterson was also living on the New Hope at that time, in the area which was to become current Orange. Luke married John's daughter, Martha "Patsy" Patterson. The paper reported no mention of trouble and that the Indians were hunters. Bebe Fox Winston-Salem, N. There is a 1972 copyright on the maps, and they can not be bought or copied anywhere, except from Mrs Markham. Mr Markham also made a "Land Grant and Early Settler Map" for Wake County, NC. (also includes an index). A wonderful research aid for those of us who had Orange County or Wake County ancestors! Mrs A. B.     3. Robert "Robin" CHEEK married Martha/Patsey ANDREWS on 27 Nov 1798 in Orange County, NC Their Children... 1....Alexander CHEEK, born 9 Oct 1799. He married in Orange County on 22 Jan 1820 to Nancy STROUD (b. 13 Jan 1801; d. 15 Feb 1884). They had nine children. On 15 June 1827 he bought from Dennison D. OLMSTEAD 125 acres on waters of Presswood Creek adjoining Elisha BEVILL, Benjamin A. YEARGAN, Mann PATTERSON, Lemuel MORGAN and William BARBEE (Orange DB-25:418). On 20 Dec 1832 he bought from Daniel BOOKER and David BOOKER 303 acres on Presswood Creek, part of waters of New Hope Creek, adjoining Reuben BATCHELOR, James DAVIS, and others (DB-25:428). On 3 Nov 1835 he bought from Edward COLLIER 214 acres known as the CRAIG MILL PLACE, 1 mile NE of Village of Chapel Hill on the Oxford Road and waters of Boling Creek, adjoining Lemuel MORGAN, John HENDERSON, Thomas H. TAYLOR, and himself (DB-26:420). On 2 March 1838 he was security for John C. CHEEK who pledged land on Ellerbee Creek for debts (DB-27:589). At Sept Court 1839 he bought from the John STRAIN Estate 78 acres on waters of Boling Creek adjoining John HENDERSON, Jacob POTTS and himself (DB-29:419). On 3 Dec 1845 he sold a lot in Chapel Hill Village to Mary R. WHEATON (DB-32:176). In Sept 1850 he sold to Morgan CLOSS, for $1,550.00, 392 acres on Presswood and Boling Creeks (DB-34:53), and then migrated with his family to Texas. He died in Freestone County, Texas, on 27 May 1855. "Heirs of Alex CHEEK" were listed in the petition to sell land of Robert CHEEK on 30 Aug 1866 (Orange Estate Papers, NC Archives. 2....Sarah "Sally" CHEEK, born May 1801. She was married on 23 Aug 1823 to William ANDREWS, with John Teddar as witness. "Sally ANDREWS" was among the living cildren listed in the petition to the Court to sell the land of their father Robert CHEEK on 30 Aug 1866. 3...William CHEEK, born 22 Sept 1803. He was married first on 4 Nov 1824 to Mary/Polly CRAIG (b. June 1805; d. 10 Jan 1863). They had eleven children. Their home was between Cane Creek Baptist Church and Chapel Hill in Orange County. William CHEEK married second, on 29 Nov 1864 to Nancy JONES. They lived at her homeplace six miles from Mebane. After her death, he married third, Penelope/Penny Williams BISHOP (d. 1906). William CHEEK died intestate in Orange County during Sept 1895. J.W. CATES was appointed administrator of the estate, and he filed a final report with the Court on 24 Sept 1898 (Orange County Estate Papers, NC Archives).     3. {continued from Lawson's visit to Indian village} The Occoneechee (Occaneechee) Indians provided Lawson with a feast of "good fat Bear, and Venison." The Indians' cabins, or lodges, were festooned with dried bear and dear meat, "a good sort of Tapestry," which caused Lawson to declare that the Indians possessed "the Flower of Carolina; the English enjoying only the Fag-end of that fine Country." Eno-Will agreed to guide Lawson to eastern Carolina. A halt was made at Eno town, located on a "Pretty Rivulet", fourteen miles east of the Occoneechee, and northwest of the present city of Durham. Here Lawson wrote theis character sketch of his Indian friend: ****Lawson's sketch**** Our Guide and Landlord, Enoe-Will, was of the best and most agreeable Temper that I ever met with in an Indian, being always ready to serve the English, not out of Gain, but real Affection; which makes him apprehensive of being poisoned by some wicked Indians, and was therefore very earnest with me, to promise him to avenge his Death if it should so happen. He brought some of his chief Men into his Cabin, and two of them having a Drum and Rattle, sung by us as we lay in Bed, and struck up their Music to serenade and welcome us into their Town. And though at last, we fell asleep, yet they continued their Concert till Morning. ****End of Lawson's sketch**** Soon after this visit of John Lawson, the Siouan tribes of the Piedmont departed for eastern Carolina. In the 1970s, A. B. Markam, of Durham, NC, did a remarkable job of ploting the original land grants of Orange County on a map. Markham is dead now and the NC Archives is the only place I know that has a complete copy of his map. Unfortunately, Markham only included the grants in the part of the county east of about Hillsborough. My Austin ancestors were in the western part of Orange and, for years, I have been augmenting Markham's map with the plots of grants in the western part of the county. I am still in the process of putting the pieces together. It's like a jig-saw puzzle and I am continuously amazed at how surveys do not close and wonder how any of the early inhabitants of Orange every really knew where they lived. Specifically, to answer your question. The best source of information on early Orange land records is a series of books written and self published by William Doub Bennett of Rocky Mount, NC. For each grant and/or deed, Bennett quotes all the pertinent land metes and bounds, dates of survey, dates of issue, names of surveyors and chain carrier, wittnesses, etc. Also included are the hand drawn plots of the surveys made by the surveyors at the time of the survey. Bennett's books include the Granville grants, NC grant 1-1000, Deed Books from Book 1 on up. Not living in Raleigh and having access to the original records, I have found these books indispensible in my research. The FHC in Salt Lake has Bennett's book and I'm sure the Allen County Library in Fort Wayne also has a set.
