Surnames: LAMM, GAY, BOWDEN, GREEN, WARREN, FINCH, RICE, WILLIFORD Classification: Will Message Board URL: http://boards.ancestry.com/mbexec/msg/rw/VUB.2ACE/596 Message Board Post: Will of Huell Lamm Nash County, North Carolina August 15, 1893 North Carolina Nash County I Huell Lamm of the aforesaid County and State, being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament - First -- My executors hereinafter named shall give my body a decent burial suitable to the wishes of my friends and relations and see that all my funerel expences are paid to-gether all my just debts. Second - I give to my son Abram Lamm sixty acres of my huse tract of land on the East side of the new road. Said tract of land shall include my dwelling house and all other out houses belonging thereto Provided. I give said land to my said son Abram Lamm with this special trust and confidence that he shall clothe maintain and support and treat her with kindness his mother my beloved wife Joanna Lamm during her natural life and at her death give her a decent burial suitable to her relations and friends and pay all burial and funerel expences Third To my son Jacob Lamm the remainder of my home tract of land not aforesaid devised I give in fee simple forever, provided that said Jacob Lamm shall pay to my grand-son Charley Lamm two Hundred Dollars as his distributive share of my estate. Fourth To my two sons Jesse Lamm and Wm Lamm I give in fee simple a certain tract of land lying on Tar River adjoining the lands of Zeke Gay Harvey Bowden and others, Said land to be equeally divided between the two said sons provided they pay all claims against said land that may be against it at my death. Fifth My executor hereunafter named shall sell at public auction to the highest bidder all my household and kitchen furniture, farming implements and all my stock of every kind and of the proceeds thereof pay over first to my two daughters Anna Lamm and Tempy Lamm Two Hundred Dollars each, and to Madison Lamm pay Twenty-five Dollars, and if there shall be a surplus after paying said heirs my three daughters Anna Lamm, Tempy Lamm and Barzilla Green shall be paid the remainder, each one to share and share alike. Sixth My will is that Abram Lamm and Jacob Lamm see to it that I am decently buried and at my funerel prepare a good dinner for my relations and friends, and that they pay all expences therefor. Lastly I hereby constitute and appoint my trusty friend Henry M. Warren my lawful executor to all entents and purposes to execute this my last will and testament according to the true entent and meaning of the same, and every part and clause thereof hereby revoking and utterly declaring void all other wills and testaments by me heretofore made. In witness whereof I the said Huell Lamm do hereunto set my hand and seal. This the 15th day of August 1893. Huel (his x mark) Lamm {seal} State of North Carolina Nash County. In the Superior Court. A paper purporting to be the LAST WILL AND TESTAMENT of Huel Lamm deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for said County, by A. B. Finch a (illegible), the execut therein mentioned, and the due execution thereof by the said Huel Lamm is proved by the oath and examination of Nathaniel Rice and W. W. Lamm the subscribing witnesses thereto: who, being duly sworn, doth depose and say, and each for himself deposeth and saith that they is are a subscribing witnesses to the paper writing now shown them, purporting to be the last will and testament of Huel Lamm that the said Wiley Lamm in the presence of this deponent subscribed their names at the end of said paper writing, which is now shown as aforesaid, and which bears date of the 15th day of August 1893. AND THE DEPONENT FURTHER SAITH, That the said Huel Lamm the testator aforesaid, did at the time of subscribing his name as aforesaid declare the said paper writing so subscribed by him, and exhibited, to be his LAST WILL AND TESTAMENT, and this deponent did thereupon subscribe their name at the end of said Will, as an attesting witness thereto, and at the request and in the presence of the said testator. And this deponent further saith, that at the said time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of the deponent's subscribing their names as an attesting witness thereto, as aforesaid, the said Huel Lamm was of sound mind and memory, of full age to execute a Will, and was not under any restraint to the knowledge, information or belief of this deponent: And further these deponents say not.
