Was it a practice to leave the property only to the widow or the minor children in a will? Some kind person sent me an abstract of the Benjamin R. Smith Will" dated 25 Feb 1865, probated in Oct. 1866 Court. Leaves to wife Nancy S. Smith his entire estate. At her death, then equally divided between his five children, B. Rush, Elizabeth, Jane, Wm. Mark and John D. Smith. He gives money to son Samuel L. Smith and to his niece Mary E. Smith. The executors were: sons B. Rush and Saml. L. Smith. He leaves to his 5 children and Samuel is not listed with them, but he refers to him as "son" in the named executors. Samuel is the one I need. He would have been born about 1841 or before and was married before 1865 so would not be listed as a child. (He wasn't with the family in 1860 census but I haven't sent for the 1850 one yet.) D.
