Author: CindyMcC Surnames: Harmon, Dixon Classification: will Message Board URL: http://boards.rootsweb.com/localities.northam.usa.states.northcarolina.counties.lincoln/4005/mb.ashx Message Board Post: State of North Carolina Lincoln County Court of Pleas and Quarter Sessions January Sessions AD 1830 To the worshipful the justices of this court of the Petition of Richard Harmon humbly represents unto your worships--that Andrew Harmon departed this life some time in the month of __ AD 1827 without having made any last will and Testament leaving at the time of his death a considerable personal estate and leaving then living a widow, Sarah Harmon, and no children, and Richard Harmon, Henry Harmon, John Harmon, and Peter Harmon his brothers and Sarah Dixon the wife of Robert Dixon and the children of Elizabeth Dixon, the wife of John Dixon, who died some time previous to the death of her brother Andrew, to wit. That John Dixion Junr. and Peter Harmon administrators upon this estate of the said Andrew Harmon deceased in the county court of Lincoln took upon themselves the burden of the administration thereof and took into their hands and possessions as administrators the personal property of the said decesd. to a very considerable amount to wit, to the amount of $____ to which said sum your petitioners was entitled by law to one sixth part after the widow had received the third. Your Petitioner has applyed to the said Administrators and after tendering them a refunding bond agreeably to act of Assembly demanded of them his part of the said Estate but to pay the same or any part thereof they utterly refused and still do refuse. Your petitioner further represents unto your worships that he has been informed and believes that the said administrators have not made true returns of the amount of the sales of the property of said deceased nor of the amount of the debts due the said deceased at the time of his death. Your petitioners therefor prays your worships to order the necessary process to issue to bring this said John Dixon and Peter Harmon into Court to render upon oath the previous facts, particularly as to the amount of the Estate, the number of heirs, and whether they have paid your Petitioner any thing and if any thing how much. And may it please your worships to order and decree that the said John Dixon and Peter Harmon pay your petitioner whatever sum he may be entitled to as one of the brothers and heirs at law of said desd. and further rules and decree whatsoever may be agreeable to equity and good conscience, and your petitioner as in duty bound will every pray.
