Questions? Call the NCPA Legal Hotline at (919) 833-3833. Chapter 132. Public Records N.C. Statutes: Public Records: 132-1 - 132-5.1 §132-6.2. Provisions for copies of public records; fees (a) Persons requesting copies of public records may elect to obtain them in any and all media in which the public agency is capable of providing them. No request for copies of public records in a particular medium shall be denied on the grounds that the custodian has made or prefers to make the public records available in another medium. The public agency may assess different fees for different media as prescribed by law. (b) Persons requesting copies of public records may request that the copies be certified or uncertified. The fees for certifying copies of public records shall be as provided by law. Except as otherwise provided by law, no public agency shall charge a fee for an uncertified copy of a public record that exceeds the actual cost to the public agency of making the copy. For purposes of this subsection, "actual cost" is limited to direct, chargeable costs related to the reproduction of a public record as determined by generally accepted accounting principles and does not include costs that would have been incurred by the public agency if a request to reproduce a public record had not been made. Notwithstanding the provisions of this subsection, if the request is such as to require extensive use of information technology resources or extensive clerical or supervisory assistance by personnel of the agency involved, or if producing the record in the medium requested results in a gre! ater use of information technology resources than that established by the agency for reproduction of the volume of information requested, then the agency may charge, in addition to the actual cost of duplication, a special service charge, which shall be reasonable and shall be based on the actual cost incurred for such extensive use of information technology resources or the labor costs of the personnel providing the services, or for a greater use of information technology resources that is actually incurred by the agency or attributable to the agency. If anyone requesting public information from any public agency is charged a fee that the requester believes to be unfair or unreasonable, the requester may ask the Information Resource Management Commission to mediate the dispute. (c) Persons requesting copies of computer databases may be required to make or submit such requests in writing. Custodians of public records shall respond to all such requests as promptly as possible. If the request is granted, the copies shall be provided as soon as reasonably possible. If the request is denied, the denial shall be accompanied by an explanation of the basis for the denial. If asked to do so, the person denying the request shall, as promptly as possible, reduce the explanation for the denial to writing. (d) Nothing in this section shall be construed to require a public agency to respond to requests for copies of public records outside of its usual business hours. (e) Nothing in this section shall be construed to require a public agency to respond to a request for a copy of a public record by creating or compiling a record that does not exist. If a public agency, as a service to the requester, voluntarily elects to create or compile a record, it may negotiate a reasonable charge for the service with the requester. I also know I read somewhere that the court house could not take into consideration the time it took the employee to assist you because they were already on county payroll. If they won't lower their costs then think it might be time for us to do a little protesting to the AG. For those of you who don't know - Easley is now the Gov of NC but I assume the Sunshine Office is still in existence. Stephen did protest, but received no reply. Prices weren't lowered either.     3. Several people have asked about Plain & Fancy. Dr. Ruth Little is the author with a lot of help from people in the county who went through many old structures in the county looking for unusual details. Many of these structures no longer exist but there are pictures in private hands or at LCC. There is some history of the county and the towns. Kinston has its own section and is broken down into the older neighborhoods. The same for LaGrange and Pink Hill. Each section of the county is broken down in the 455 pages plus the excellent index. They tried to trace the ownership of the property when known with a little genealogy. The structure are business related, grand old homes, farm homes and tenant houses - they just had to be old. A history of the owners, when known is given. As most of you know, the old structures in the county bite the dust on a regular basis and most of the older homes in Kinston have been torn down especially in east Kinston where the original homes were built. Many surnames of the original owners are not even found in the area anymore. This book is what is called a coffee table book and if your roots are in Lenoir County, the money is well worth it and would make an excellent Christmas present. We are trying to get a better description of both books from the Historical Society for Dobbers. Martha

Typically, "Pension Applications" for the specific State and Surname are the ones that identify either wounded or KIA soldiers in any war. Typical sites for specific State/Federal War parks mey have such information also. Please let me know if you come across any such listings for North Carolina, as it appears our Dormand and Herrenton FAIRFAX folks were KIA in the Revolutionary War while enlisted in the North Carolina Continental Line since their sons John and Daniel FAIRFAX applied for their pensions in 1797 in North Carolina? There has been a change in the price (probably not a good decision) and address for the Lenoir County Heritage Book (history of families including Greene families and of the county) and Plain and Fancy (history of old buildings in Lenoir). There will be additional information and a request for sugggestions on how to move these books as soon as Mary Mac has time to deal with this new job. I was told by several different people that the Historical Society was almost out of the reprint of the Heritage Books. Given they have 600 copies still to sell, obviously that information was incorrect. They want our help moving them. No chance of doing Vol 2 until Vol 1 is sold. Some of you have had a problem receiving your books after your check was cashed - with Mary Mac at the helm, there will be no further problem.     3. Jim has sent me a good deal of information on the Needham Garner family who moved from Greene to that area of Duplin adj to Lenoir. In the Duplin Sutton deeds posted last week, there are several mentions of the Garner family in the deeds. William Garner (b. 1793) was the son of Wiley Garner (son of Needham Garner) Married Elizabeth Sutton in Duplin or Lenoir Co. Children: Winifred W. b. abt. 1820 Simeon b. 11/15/1820 Wiley Sutton b. 2/8/1824 Ann b. abt. 1825 John P. b. abt. 1825 Narcissa b 1827 Avy b. 1835 Josiah b. 1836 Elizabeth died in Coffee Co, Ala. and William died in Dale Co., AL My assumption was that this Elizabeth could have been the daughter of Simon Sutton who lived in the same area as the Garner family but nothing supports it. THe name of her son was Simeon not Simon and the spelling of Simeon indicates it was a Garner name. IF the widow of Simon was Mary who appears to have had a son Thomas, daughter Penelope who married Curtis Dail as his 3rd wife, and Phereby who married Luke Herring, then the census and the estate records do not support Elizabeth being a daughter. However, the census is inconsistent with the age of Mary and it indicates two additional sons that I can't find. The Suttons of Duplin were within walking distance of the Suttons of LEnoir. Elizabeth was not the daughter of Benjamin (Oxley) or his brother, William. John Jr is a strong possibility. Does anyone else have any information on an Elizabeth bc 1795? Martha

    3. First, I am not exactly what the situation is on Milo Sutton as I sent him an email several months ago and the reply stated he was quite ill and no longer able to reply to emails. Yet, I think he is still listed as the moderator of the Sutton List. I was on that List when it first started and had about 500 people on it, mostly experts on the New Jersey line. It appears those people are no longer on the list. Several of them had worked together over the years and said John of Lenoir Co could not have been part of the New Jersey line as they had all of them accounted for and proven without question. All of their proofs were run on the list and it satisfied me. Unfortunately, I either did not keep that information or lost it when my pc crashed the first time several years ago. The names in the New Jersey family never show up in Lenoir and I am of the opinion that John was from NE NC but have not been able to prove it. Have a good candidate but going to take a lot more work in Bertie to try and prove it. John's assumed widow, Ann, may have very well been a Turner, part of the Simon Turner family of IOW and Southampton, Va but again, I can't prove it. Some of the names among the children of John are found in that family and without question this Turner family had land in old Dobbs Co. Rose has pretty much disproven any connection between the Turner and Wiggins family. Given the span of years between John I's assumed children, it is possible he had two wives. I think that because Jesse Hardy's father William Hardy was born around 1729 and his wife Sarah Sowell was born around 1733, they were married 11/26/1751, it makes sense that Jesse was born around 1769 and not 1779. I can't find were I found the info on Jesse's birthyear but I feel certain that it is correct. I have started researching the Radford family of Greene,Lenoir,Wayne Co.My greatgrandfather George Slaughter's sister Caroline had a daughter Nancy Slaughter 1876/1943 that married John R.Radford 1874/1948.He was the son of Henry 1843/1921 and Winnie Radford.Grandson of Lamb Radford.Dock Radford[brother to Richard--married 1st Chellie Mozingo,2nd Nannie Wiggins and 3rd Lizzie Ward Deans.Chellie Mozingo was the daughter of Bryant and Sarah Robinson Mozingo [Mozingo Cemetery--Greene Co Cemetery Records Vol.I].Their daughter Mary Mozingo married John Rouse--sister Sarah[Sally]married Thomas Aldridge Farmer.Is anyone doing any Radford research??????? That's all I know about him. I have located his name in some court records from around 1820 or so. I don't have them in front of me right now, so that could be plus or minus a yr. William is a family name, since I believe that my great grandfather William R. Andrews is the grandson of Winston Andrews. It's a educated guess on my part, but I believe that Winston Andrews left NC about 1830-35 and arrived in Lowndes Co. MS (he's on the 1840 census). From there he went to Carroll County MS. 1850 census there shows him, and several others who I think are his sons, I'm still working on proving that. William R. Andrews' father was J.J. Andrews. I'm sorry I do not have any knowledge of the Andrews in NC, or the specific names you listed. Did any of those Andrews migrate to MS? There were several different sets who made it to this state, and may have been related, I just don't know. It has become a dead end for m! e and when I get time to start on research again, I would like to search more in Lenoir Co. Thanks for responding, Francine

    3. I would like to extend a special welcome to William who has just joined us. He lives in the Grifton area, is an African American and is very active in the Pitt Co Family Researchers especially in the area of working with cemeteries with Bill. It appears we have a number of families in common - one way or the other - both in Pitt and Lenoir. The more we talked a couple of weeks ago, the more surnames and specific families that came up in common. William has extensive information on a number of AA families and I want to sit at his knee and learn how he has done it. This is a field, I know nothing about yet receive queries all the time and need to become more knowledgeable in order to be of assistance. Welcome, William and to our other new members.
