    2. This is a Message Board Post that is gatewayed to this mailing list. Author: southard Surnames: Carroll Classification: queries Message Board URL: http://boards.rootsweb.com/localities.northam.usa.states.northcarolina.counties.johnston/61.1.1.1.1.2.2/mb.ashx Message Board Post: I believe the laws in each state are a little different regarding the legal status of cemeteries on private property. Article 10 of the General Statutes of NC regarding access to private or abandoned graves was amended in 1991. You can find that legislation at http://ftp.legislature.state.nc.us/Sessions/1991/Bills/Senate/pdf/S177v2.pdf It is important to get permission to cross the private property between you and the cemetery before trying to go to the graves. It is probably best to do that in advance of going to the property. In my case in another county, the owner of the property had to first put his bull in another pasture before we could enter. I hope this helps. Lura Important Note: The author of this message may not be subscribed to this list. I don't understand how a cemetery can be private either. I understand there are a lot of cemeteries around here that are on people's farms etc. Do we need permission to visit them? What is legal and what isn't? When was the last time you visited the Bunker Hill Cemetery? That is a shame that they would damage a cemetery to build a road.... How can someone not allow you on public property? I have alot of family buried there. I know for sure about 10 years ago they were trying to built a road through there and some of the caskets were exposed. I don't know if that's why the chain is there. Go back there and see, if someone approaches you tell them you were trying to find some graves. I get confronted all the time while researching. One time I was at a church and they were having a meeting inside and they wanted to know who I was looking for. My family was buried there, but they didn't know them. Go for it! 3. That is the official date. The census takers are told to get the age of the person as of that date. However, they don't always get around to all of the people on one day.
