    3. Do you know where they married? And, how it is that you know that they did marry? Or, how do you know what her name was? I may have all of that somewhere myself, but I am drawing a blank right now. I need to know what documents you know about and what County and State. I assume NC and I assume Johnston or Cumberland but it will be easier if I know exactly where. 3. This Beaverdam Creek (frequently called swamp in deeds) begins in the town of Princeton in Johnston Co., then runs southeast into Wayne Co then to the Neuse River. The portion in current Johnston Co is only about a mile long. The creek is unamed on our county maps but is labeled on the USGS maps. You don't say what year this deed is, but it could be in current Wayne Co now? 3. Hi, I am also looking at the Fail family in Johnston. A Patsy Fail married Ely Jones in Johnston in 1841, bondsman was Needham Fail. I believe that Patsy died before Needham made his will in late 1840s. He did not mention Patsy Jones. Is this the same family? 1. [NCJOHNST] Punishments in 1828
    2. Betty A. Pace
    3. The current issue of the Rowan Co. Genealogy Society Journal came today. I noticed some "cruel and unusual" punishments in two trials in April 1828 in Rowan Co. Both were for theft--one for horse stealing and the other for house breaking (changed to just larceny). I was struck by the fact that both men could have been sentenced to death! Instead because they "prayed the benefit of clergy for leniency," they were sentenced to be beaten by whiplash, one for 39 lashes and the other for 25 lashes. In both cases, the punishment was split into two phases about a month apart. I guess they wanted the first wounds to heal before meting out the rest of the punishments by lashing. I doubt if Rowan Co. NC was more harsh than others in this early period. Betty Pace ________________________________________________________________ GET INTERNET ACCESS FROM JUNO! 1. [NCJOHNST] Richard Avera, Richard Ryals, Jesse Gully, Cumberland Co NC, 1800-1845
    2. FW I
    3. Help! Two different Richard Averas married two different Civil Ann’s in Cumberland Co NC. This first was the Richard Avera who married Civil Ann Godwin in 1814 with John Deu [Dew] as bondsman. [Marriage Bond in NC Archives.] The second was the Richard Avera who married Civil Ann Gully in 1840. [Will and Estate Records of Jesse Gully, NC Archives.] Can someone help me sort out this puzzle? I have a accumulated a pile of material on Richard Avera #1 and Richard Avera #2, Richard Ryals, and Jesse Gully of Cumberland Co NC during the 1st half of the 1800’s. However, I have no proof of who the parents of these men are. Can you help? Below is only a sample of what I have. Hopefully it will be useful to some researcher, but I am sending it in an attempt to learn more about the descendants and ancestors of these three men. Franklin Ingram, Raleigh, NC Descendants of Richard Avera, Richard Ryals, and Jesse Gully, Cumberland Co NC, 1800-1844 Generation No. 1 1. RICHARD1 AVERA was born 01 Feb 1778, and died 15 Mar 1844 in Cumberland Co NC. He married (1) MARY RYALS, daughter of RICHARD RYALS and MILBRA BAGGETT. She was born 1779, and died 26 Sep 1819 in Cumberland Co NC. He married (2) CHARLOTTE STEPHENSON 01 Dec 1822 in Cumberland Co NC, daughter of JOHN STEPHENSON. She died Bet. 1828 & 1839. He married (3) CIVIL ANN GULLY 11 Mar 1840 in Cumberland Co NC, daughter of JESSE GULLY and SALLY. She died Bef. 1871. Notes for RICHARD AVERA: Richard Avery Bible Record is reported to name the three wives of Richard Avera with dates of the marriages. This Bible Record is also reported to give his date of death as 15 Mar 1844. However, Civil Ann "Civie" Avera testified in her Dower Petition in 1844 to the September Term of the Cumberland Co NC Court that Richard Avera had died "about 1 Mar 1844." Note that the spelling of this Bible Record is Avery and not Avera. See "Old Southern Bible Records," Compiled by Memory Aldridge Lester, Genealongical Publishing Co, Inc. Baltimore, 1974, pages 11 and 12. The source and whereabouts of this "Richard Avery" Bible Record is not cited by Lester. I have verified the names of the children of Richard Avera, died Mar 1844, in his Cumberland Co NC Estate Papers, NC Archives, but the dates of all births are from the Bible Record. Spelling the name Avery indicates that Richard Avera himself was not the author of any of the Bible Record material or whoever transcribed it changed the spelling. Richard Avera was quite wealthy and literate, with an extensive library. The signatures that I have seen in his own hand always spelled the name Avera. Notes for MARY RYALS: Richard Avery Bible Record is reported to state that Mary Ryalls died 26 Sep 1819 in the 40th year of her life. Note that the spelling is Ryalls and not Ryals. See "Old Southern Bible Records," Compiled by Memory Aldridge Lester, Genealongical Publishing Co, Inc. Baltimore, 1974, page 11. Notes for CHARLOTTE STEPHENSON: The "Old Southern Bible Records," page 11, housed in the Johnston Co Genealogical Library, has handwritten marginal notes added by someone that Charlotte Avera was the daughter of John Stephenson and the granddaughter of Solomon Stephenson. It also stated that Charlotte Stephenson had first married Willie Jones, 13 May 1811, Johnston Co NC. There is in fact a Cumberland Co NC Marriage Bond in the NC Archives for a Richard Avera to marry a Charlotte Jones, dated 28 Nov 1822. The Bible Record states that the marriage date was 1 Dec 1822. See "Old Southern Bible Records," Compiled by Memory Aldridge Lester, Genealongical Publishing Co, Inc. Baltimore, 1974, pages 11, Johnston Co Genealogical Library. The source and whereabouts of this "Richard Avery" Bible Record is not cited by Lester, and the author of the marginal notes is also unknown. Notes for CIVIL ANN GULLY: The 1841 Will of Jesse Gully left certain lands to his wife Sally that were to go to his daughter Civil Avera at the death of Sally if she had no heirs of her body. A Fall 1871 Petition to the Cumberland Co Court asked that this land that had come to Civil Ann Gully Avera Pearson be sold and the proceeds divided between the surviving children and grandchildren of Jesse Gully, father of Civil Ann Gully. This 1871 Petition stated that Civil Pearson, mentioned in Jesse Gully's Will as "Civil Avera," had been dead "many years" and had died without heirs of her body. See both the Will and the Estate Papers of Jesse Gully housed in the NC Archives. The 7 Mar 1841 Will names all of Jesse Gully's children and the 1871 Estate Papers names all of his children living and dead and all of his known grandchildren. It is also names spouses and where each heir was living in 1871. Richard Avera was one of the Executors of Jesse Gully's Will in 1841 and the Administrator of Sally Gully's Estate in 1842. John MacKay and Henry Avera signed the the Bond for Sally Gully's Estate Administration. Children of RICHARD AVERA and MARY RYALS are: i. ALLEN AVERA, b. 04 Oct 1800. ii. BRYANT AVERA, b. 29 Dec 1802. iii. CALVIN AVERA, b. 19 Mar 1805. iv. ELIZABETH AVERA, b. 17 Oct 1810; m. JAMES ADAMS, 03 Apr 1828; b. 23 Jan 1805. v. WINIFRED AVERA, b. 09 Apr 1810. vi. DAVID AVERA, b. 04 Jun 1813. vii. MARY AVERA, b. 14 Aug 1817. Children of RICHARD AVERA and CHARLOTTE STEPHENSON are: viii. CHARLOTTE2 AVERA, b. 28 Oct 1824. ix. NC Queries Forum Reply Here: http://cgi.rootsweb.com/~genbbs/genbbs.cgi/USA/NC/Johnston/2018 Surname: Lee Otho Davis, Maude Davis, Pearl Wilson Broadwell, Donnie Broadwell ------------------------- I am the grandson of the above and would like any info on them or there acsendants i could get.Iam new at this but am very interested. Please help. Thanks ahead of time.I live in Johnston County,NC.They may have been reered outside of Johnston In response, Ann Massengill writes: hi, joseph! i'm trying to contact you directly -- i can't get through to you on the address as it is shown. i have no information, but I am interested in why you want to know. i teach a class of mid-schoolers in south carolina and am trying to get them interested in finding out about their families as a way to teach them to use computers. boy! they are a SLOW crew! i have noticed that you are starting with your grandparents. that seems to me to be a good place. but maude davis doesn't have a maiden name. maybe you do not know what it is. but if you do, or even if you could guess it, you might put that info out there. say you've got two cousins named "butler" -- one is a girl named "maude butler". then you might infer that your grandmother's maiden name is butler, which you would list as "maude (butler?) davis". if you can get to her maiden name, you have opened up a whole 'nother family line to follow. i can tell you that "otho" is an extremely unusual name. it could be what we call a "corruption" of such a name as "arthur" -- well, we who think we KNOW everything may call the name a "corruption", but in truth it is spelled the way it is spelled because that's the way your family (your ascendants) promounced it. now i ask you: who's right? i notice you use the beautiful old english term "ascendants" instead of the more common "ancestors". i have a nephew who is growing up near beaufort, in the true "down east" section of north carolina, and he uses many of these lovely old english terms. this makes me think that at least one branch of your family may be from somewhere more "down east" than JOCO. such usages are also common to the eastern shore (of virginia, maryland, and delaware) and to some of the sea islands along the south carolina, georgia and florida coasts. some of us use JOCO to mean johnston county. what part of JOCO do you call home? my father was paul robinson massengill, third son of george kemp and mary cornelia (mamie) wilson massengill of four oaks. i notice that there are lots of twins born to JOCO families, and one of the most common sets of names for twins, according to my family records, is "paul" and "pearl". you may find out that your grandmother pearl wilson may have had a twin brother named paul. i would like to follow up the wilson connection with you. i don't have diddly-squat on my massengill grandmother, who lived the longest! we were simply not close to her, as we lived in south carolina and she was in raleigh. i do know that her father was adolphus robinson wilson. i found all this on a scrap of paper my mother had saved: "notes from paul's mother when we were trying to find out family names before wells was born". see? i was the oldest child, and i was named "ann" because it was the shortest name daddy my could think of at the time -- he thought massengill is such a l-o-n-g last name. by the time their fourth child, my bratty little brother wells, was on the way, i reckon they thought they had time to hunt around and find out all the family names in case he turned out to be a girl. i was supposed to have been a boy, and that was that! who were you named for? i don't see any "joseph" among your immediate ascendants. you may be interested to learn that i am one of a bunch of family history nuts who plan to start meeting in JOCO every july. the first meeting will be this year, and it is for representatives of the various families and townships of the county. we don't have much in the way of plans other than to meet and make some. i hope you can attend this meeting and help us out since you live there in JOCO. you can keep my address, as i am keeping yours. you can also check out the website meredith page designed for us. i keep forgetting what it is, but there's SUPPOSED to be a link on the JOCO website. try it and let me know if you can get to it. let me hear from you either directly or on the rootsweb. warren begley has asked us to keep "JOCO heritage week" stuff off the JOCO rootsweb because some people have been confused. i am now switching -- if i did it right -- to the "L" version as we get closer to the steering committee meeting so i can take each one separately. i expect you will be "swamped" with replies. do let me hear from you. with a little motivation, a couple of things i'm writing off to my agent, and better knees, i can go through a bunch of boxes in the storage and see what else i can come up with. life is good. annie

We are very sorry that you were inconvenienced by the broken link to the North Carolina Militia. We were in the middle of changing those links about the time you signed the guestbook, and they should all be functioning now. The various North Carolina regiments had all been combined on a single page, and we recently split them out onto individual pages, but had not finished changing all the links as of yesterday. You will now find the Regimental History of the North Carolina Militia at http://www.royalprovincial.com/military/rhist/ncmil/ncmillist.htm We did some looking through our sources here, but are sorry to say that we were not able to find anything on your John Pace. If you have not already done so, you might consider consulting the books by Dr. Bobby Gilmore Moss, which are available for sale at Scotia Press (http://jrshelby.com/scotia/) and would probably be available in some of the larger libraries near you as well. In addition, Dr. Moss' papers have been donated to the Historical Center of York County, South Carolina and might prove a worthwhile source of information for you. You can contact the archivist for the Historical Center, Beth Carter, at becarter@InfoAve.Net. We apologize again for the inconvenience of the broken links. -- Best regards, Todd Braisted & Nan Cole The On-Line Institute for Advanced Loyalist Studies http://www.royalprovincial.com -- ________________________________________________________________ GET INTERNET ACCESS FROM JUNO!
