Additional information on women's rights to property. On the issue of women and the law I would like to add a point that doesn't get mentioned often. I have encountered three surprisingly early instances of widows getting prenuptial agreements prior to remarriage. One was 1660 in England where a widow was shielding the legacies of her minor children from their future stepfather. Another was a woman in Charleston, SC who had prenups for two different marriages in the early 1700s . Her first prenup was before her marriage to the speaker of the SC House of Assembly and the second was before her marriage to the son of a former governor. In both lengthy agreements she spelled out in great detail all the property she was bringing into the marriage and that it was not to become the property of her future husband. Ken Daniell --------- <snip> Ken I have seen that many many times. The step father did not need to give any property to his wife's previous issue even though she brought most of property into the marriage UNLESS it was agreed to and signed before the marriage -- it is often recorded on the day of the marriage. Most of my research is in the south. In my PA research women's rights and property were not so protected although as you say when an agreement was reached it went into great detail. This is an short verion I carry with me for Southern Colonial research. At times state laws may vary. from birth inherit enumerated in censis age 12 female witness documents age 14 male testify in court choose guardian be punished for a crime sign contracts act as executor bequeath personal property by will marry age 16 be taxed muster into militia procession land take possession of land holdings age 18 practice trade age 18 female release guardian age 21 male release guardian own land devise land by will be taxed plead or sue in court be naturalized fill public office serve on jury vote Ruth Keys Clark, Kansas

I have many Green's in our Rogers line in Anson, Montgomery, and Stanly Co's NC who later on all moved into Carroll Co. TN, then into Boone Co. AR. Most trace back to the Anson NC area in the 1774 era, and may have been in Johnston Co. NC before that time. The Speights, Greens, Rowlands, Rogers, Edwards, McMakins, McGregors, Liles, Lipe, Cox, Cooper, and others are all familiar names in Anson, Montgomery, or Stanly who all moved to Carroll Co. TN about 1820's, and I am trying to determine if some of those lines may trace back into Johnston Co. NC as well. Tina Rogers Beller e-mail jkpb3@bellsouth.net

Ruth is a professional genealogist and historian. She probably knows what she is talking about. Betty Pace --------- Forwarded message ---------- From: ruthkeysclark@myfamily.com To: PACE-L@rootsweb.com Date: Wed, 14 Feb 2001 07:09:54 -0800 Subject: [PACE-L] Colonial property rights of women and legal age Message-ID: <20010214150954.EAIH142.mta09.onebox.com@onebox.com> Noted with interest the discussion regarding property right of females and the legal age for involvement in various legal transactions. The first editon of Val Greenwood's book covers this topic well giving the legal age for both male and female. Males could inherit propertuy at any age, could claim property later on but could not sell property until they were 21. His discussion is excellent and I would suggest you study it. I can send this table of legal age to any who are interested. Female rights varied some in the colonies -- after the Revolution they are more uniform. Unlike PA and NY, the South enforced strictly the dower rights of women as divorce was very very rare. Many males left home and never returned however thier wives could not legally own and pass along to their children property unless court action was taken to permit it. Women could not do business without the consent of their husbands. Husbands owned their wives property and also their clothing, time and talents. Women could not take in laundry without their husband's permission. The two books I have found very useful, I have posted previously : Women and the Law of Property in Early America by Marylynn Salmon and Inheritance in America from Colonial Times to the Present by Carole Shammas, Marylynn Salmon and Michel Dahlin. Both of them believed they had gone to school with her... a decade apart. (She did die, didn't she?) Y'all think on this and let's come up with a genuine celebrity, preferably one who is somewhat knowleageable about his/her roots and is, or can reliably pretend, to be proud of his JOCO heritage. If we can come up with an active or retired astronaut, NASA pays them to do this sort of stuff. (You know that already if you plan events in the Carolinas, where we have nothing if not an abundant crop of astronauts!) At some point, I was wandering aimlessly about the science of genetics to explain believable characterizations. I explained that John and I, two blonde/brown-haired persons, have four children; one has blue/black hair, one is a true blonde, one is a vibrant redhead, and one has mousy fine brown hair like mine. I waited for some sign that this is remarkable. Finally, one girl on the front row looked brightly at me and asked, "Uh, the one who has hair like yours? Who does HER hair?" An individual may own land when they are one day old, but cannot sell land until they are 21. There were also laws concerning female ownership of land, a woman's land became her husbands property upon marriage. I am seeking information on Elijah Phillips. Parents: Fort T. Phillips and Elizabeth Rains Phillips. Elijah was born in 1855 in or around Johnston and Wayne County, probably at Boon Hill. He is shown with his family at Boon Hill on the 1860 Census Records. I believe his father was killed in or died shortly after the Civil War. After the war, the widow, Elizabeth, moved with some of her children to the area around Sullivan, Illinois. I believe the connection to that area may have come from Fort T. Phillips, in that his mother Mary Polly Thomson Phillips was from Shelby County, Illinois. Anyone having information on Elijah Phillips, please contact me. Thank you so much. Kathy Davis
