Do you have any more information on your Sarah (Sally) that might help connect her with them?     3. There was a James Yarbrough who died about 1832, apparently Franklin Co., as his estate sale was there. Also a David Yarbrough in Orange Co. in 1820s. Also seen it spelled Yarbro. Brown, from Granville.- Judgement of the Superior court affirmed. ***** War in Texas.- By a passenger in a steam boat from Natchidoches, we learn that two actions have been fought in Texas between the Fredonians and Mexicans, in both of which the former claim victory. Of the first fight we have no details. The last is said to have occurred on the 4th of this month, at the town of Nacogdoches. Some 70 or 80 Mexicans having advanced on the village, they were met by about 40 Fredonians, who soon routed their foes, killing 4 and wounding ten of the Mexican soldiers. Accounts from Austin's settlement stated the people to be about equally divided for the Fredonians and Mexicans. As, however, the former were the most noisy and violent, it was thought they would take all the authority into their own hands. N. Orleans paper. ***** It is estimated that 100 steamboats now float on the warters[sic] of the United States. [p.3] LATEST FROM TEXAS. Natchicothes, Jan. 21, 1827. By gentleman just arrived from Col. Austin's settlement, Texas, we are informed that Governor Saucedo has arrived there from St. Antonio with one hundred and fifty Mexican troops, on his way to Nacogdoches to suppress the insurrection which exists there. On the arrival of the governor at Colonel Austin's settlement, he called on the Colonel to know what part he inteded[sic] to act, when Colonel Austin informed him that he should act on the part of the Mexican government, and at the request of governor Saucedo, immediately called a meeting of the Alcaldas in the settlement, who unanimously resolved to support the Mexican government in opposition to the "Freedominions!" Immediately after the conference with Colonel Austin, the Empresato for the district, and the Alcadas of the same district. gov. Sausedo sent commissioners to Nacogdoches, to treat with the insurgents (or Freedominions! as they term themselves.) for a reconciliation. On the arrival of the commissioners at Nacogdoches the insurgents refused to hold a treaty upon any consideration, unless the Mexican government would acknowledge them "Free and Independent!" We have not been able to ascertain what measures the governor would adopt, as our informants left the district previous to the return of the commissioners. Some person at one of our tippling[?] houses (those pests of society) gave him, as we learn, a quart of liquor, on condition he would drink the whole at one time. He succeeded in getting it down, and soon after fell into a profound sleep from which he never awoke! Wednesday, April 28. ***** We are authorized to announce Thomas H. Taylor, esq. as a candidate to represent this county in the senate of this state. ***** The dwelling house of Mr. James Peace, in Granville county, was entirely consumed by fire, with all its contents, on the 17th inst. while the family were at church. Owing to some circumstance, a negro fellow the wife of whom Mr. Peace had hired, was suspected as the author of the foul deed, and he was consequently arrested. The negro confessed himself guilty of the charge, and stated that he had done it, to revenge his ill treatment, in being prohibited from visiting his wife. The negro is confined in jail to await his trial. Ib. ***** [p.3] ***** The secretary of the commonwealth of Pennsylvania has advertised for a loan of $600,000 to the state. ***** Clergymen.- It is calculated that there are about 6,000 regularly ordained clergymen in the United States. ***** Small Pox.- It appears by the report of Doctors Mitchell and Bell to the managers of the Philadelphia Alms House, that of the 138 persons place under their care, having the small pox, but 25 are known to have been previously vaccinated. These 25 all recovered, while of those who had neither been vaccinated, nor had the small pox, 70 out of 113 died. Four persons died of the small pox who had had it before, two of whom had it by innoculation, and two by the natural way. So it would seem that to have been vaccinated is a better security than to have had the small pox, either naturally or by innoculation. ***** U.S. Ship Franklin.- A letter from captain Gardener, of the U.S. ship Franklin states, that the small pox continued to prevail on board, and that several of the crew had died of that fatal disease. Murder.- On Tuesday last, an inquest was held in this town on the body of Samuel Horne, a free colored man, who died the preceeding day. From the Coroner's report it appears that on Sunday last Edward Jones, a shoemaker, residing in this place, saw two chicken-cocks fighting near his house; he caught one and threatened to shoot the other, which Samuel Horne, the deceased, begged him not to do; upon this Jones ordered him out of the house, and swore if he did not go he would kill him, and immediately looked about for his shoe knife; the deceased went off, was pursued and stabbed by Jones. The wound was afflicted just above the collar bone on the left side of the neck, passing obliquely across the breast, cutting his windpipe, puncturing the swallow, and dividing important blood vessels. Carey and re the age of majority and age of capacity Carey, Can you tell me more about the change of the age of majority, when did it change, and was the age reduced or increased? This is something I have never gotten straight. Thank you, Marilyn Stroh Dear Marilyn, I think we need to distinguish here between "age of majority"--the age at which a person attains full legal rights, particularly civil and political rights--and the "age of capacity"--the age at which a person is legally capable of taking on certain responsibilities such as agreeing to a contract, marriage, executing a will, paying taxes, or serving as a chainbearer. "Age of majority" was 21 years in North Carolina and elsewhere until 1971 when the Twenty-sixth Amendment lowered the national legal voting age to 18. It is still defined as 21 in many states for other privileges. "Age of capacity" in North Carolina was 16 until it was changed in 1784 to age 21. Therefore many of the grants of confiscated Loyalist property were made to "minors" before 1784. He was usually a teenage son of an adjoining land owner." Other sources indicate that chain carriers were sworn (you will see SCC in some deed extracts for sworn chain carrier). >From http://www.surveysinc.com/history/history_4.html "Chain carrier - An assistant to the surveyor, the chain carriers moved the surveying chain from one location to another under the direction of the surveyor. This was a position of some responsibility, and the chain carriers took an oath as "sworn chain carriers" that they would do their job properly." Since persons were frequently related to those that lived next door to them, if the above is true, then the sworn chain carrier would indeed be a relative. Of course there would have to be some exceptions to this (what if there were no male relatives old enough to be a sworn chain carrier?). NC, 21 Nov 1821] [transcribed by Mark Murphy, 12 Oct 2001] ***** HILLSBOROUGH, Wednesday, November 21, ***** Mail Robbery.- The case of Thomas Haswell, deputy postmaster at Louisburg, who was indicted for breaking open the mail and purloining letters therefrom, some containing money, and some notes, on Wednesday last came on for trial. It occupied nearly six hours, and almost the whole of that time was taken up in the examination of testimony. Mr. Devereux and Thomas Ruffin, Esq. were of counsel for the United States, and Mssrs. Seawell, Gaston and Mordecai defended the prisoner. The facts charged in the indictment were so clearly proved, that the counsel on each side deemed it entirely unnecessary to offer any argument, or submit any remarks in the case. The chief justice simply instructed the jury to read over the counts in the bill, and if the evidence proved him guilty of all, to return a verdict of guilty generally; if it proved him guilty of only a part of the counts, to find him guilty of those counts, and not guilty of the balance; and if they should be of the opinion that none of the counts in the indictment were sufficiently substantiated by the evidence, to return a general verdict of acquittal. The jury retired, and in about thirty minutes returned a verdict of guilty upon the first four counts, and not guilty upon the fifth.... The prisoner was remanded to jail, and his sentence suspended until the next term. Raleigh Star. ***** Premiums offered by the Rowan Agriculture Society for the Show of the Next Fall. A premium of ten dollars for the best Brill Pough for putting in cotton seed. Five dollars for the most approved two-horse Plough; and the like sum for the most approved one-horse Plough- both to be constructed on the Dagon principle. Five dollars will be awarded for the best pair of woollen Blankets... Five dollars for the most elegant counterpane, and four dollars for the next best... The next annual show will take place in the month of November, of which due notice will be given. Direct-Line software is focued on software (Deed Mapper) for platting out land, etc and has interesting references and info on land, transfers, terms, definitions, what it all means, etc. It's certainly helpful to understand the entire system, as well as the lingo of the day before platting land. http://www.ultranet.com/~deeds/landref.htm As far as I have always understood it from NC reference books, the chain carriers were not necessarily related, it was a possition of responsibility and an oath had to be taken to be a chain carrier. I'm sure the site above will edify those who are interested.

    3. In transcribing late 1700s and early 1800s court records, I keep seeing the abbreviation after someone's name "Excr&c" . I know that Excr mean Executor of the estate of the deceased, but what does "&c" mean? I thought it meant "& costs" but that term is spelled out elsewhere when associated with a jury fine aSseSsment. Any thoughts? -Mark Murphy
