It is believed that his family came from New Jersey or Long Island, NY. He was an attorney and a member of the House of Assembly (1771-1774), and was also named a Brig. General by the House of Assembly on 22 Apr 1776. He married Mary Benners. His son, Thomas, was also a lawyer in Edenton.
