Ordered that a commissionDedimus Potestatum issue to the State of North Carolina, Lincoln County, totake Examination of John Beest in behalf of the plaintiff.” Ie. Mr. Hoover is suing Mr. Lefever, probablyfor debt. The county court has issued a Writ of Attachment, meaning JohnLefever’s personal property will be attached and sold to cover the debt. If sufficient personal property is notlocated, then Lefever’s land can be attached. Mr. Lefever is defending himself. John Best who lives in Lincoln County, NC has been summoned to testifyin behalf of Frederick Hoover. Usuallywitnesses are required to testify in open court; however, extenuatingcircumstances such as illness could prevent a witness from being able to attendcourt. In that case, the Court will approve a dedimus potestatum. This is acourt order issued to an appropriate official – such as a justice of the peacein Lincoln County. – to hear and record the testimony of John Best. The Justice of the Peace then seals histranscript of the testimony and returns it to the Court where it is then readinto the record of the proceedings. 1789 Abraham Lefever and wife Elizabeth of Augusta Co., VAsell land in Lincoln County, North Carolina to John Cressimore with explanationthat “John Lefeber’s will dated Oct 1787 and registered in Berks Co., PAdivided his land in PA but failed to do anything about the land in NorthCarolina.” Abraham, as the eldest son was declared heir-at-law.
