Part #2 The First Courthouse for Orange County, NC At the beginning of the formation of Orange County, the courthouse was not located in Hillsborough, as it is today, there was no Hillsborough in 1752. The first courthouse was located in the present day Alamance County town of Haw River, NC. ************************************************************************* As was the practice, KIMBROUGH provided two sureties that he would build the courthouse, stocks, and jail at his own expense. He would not be paid until after completion of the work, but he stood to benefit from the tavern and lodging trade that court sessions would bring. KIMBROUGH had operated an ordinary in Edgecombe County, and there had been a petition there to move the county court to be near his establishment. The justices specified that the courthouse would be 32 by 22 feet with a pitch of 11 feet, framed, and weather boarded with feather edge plank and shingled roof. The prison was to be 20 by 12 feet with a central partition. They specified further that it was to be made of hewed logs eight inches thick, weather boarded with feathered edged plank, with shingled roof, and floored above and below of hewed logs. The contract stipulated that "the work is to be finished in a workmanlike manner within two years from the date hereof" In the meantime however, the courthouse was to be "fit for the reception of his Majesties Justices at their next sitting". The minutes of this first session of the Orange County court ended as follows: "Court adjoined till Court in Course to be held at the place where the Courthouse is to be Built". The law had set the next session for December 1752. The minutes for that session, which opened 10 December 1752, indicate "that the court met at Mr KIMBROUGH". Orange County Court met there for four sessions, and also the March 1754 session. The December 1753 granted KIMBROUGH a license to keep an ordinary "at his home", and also granted a license permitting Brasel BRASHER to keep a second " Ordinary at the Court House". The original Orange County consisted of present day counties of Alamance, Caswell, Chatham, Orange, Person, parts of Guilford, Lee, Randolph, and Rockingham, and very small portions of Stokes and Wake. Alamance County was dead center of old Orange County, which the Haw River roughly bisected from northwest to southeast. Orange County included the headwaters of the Neuse River system, most significantly the Eno River. The first court met at the home of John GRAY near the Eno River in September 1752. At this court session it was ordered to build a courthouse farther west, near the Haw River, close enough to the river crossing at Pine Ford for that crossing to give access to people who lived west of the Haw River. Pine Ford or "Piney Ford" is in the present town of Haw River, across from the present day Granite Mill, near the railroad bridge and today's John Robert WATKINS bridge on NC Highway #70. Pine Ford was near the center of Orange County, and the main leg of the Trading Path crossed there. Seven of the eight justices present at the first court meeting were: John PITTMAN, Mark MORGAN, James DICKEY, Lawrence BANKSTON, Joseph TATE, Andrew MITCHELL and John PATTERSON. They contracted with the eighth justice, Marmaduke KIMBROUGH to build a courthouse, stocks, and jail, the usual facilities for county business that the law required. The specific site was to be selected by a committee of PITTMAN, ALLISON, and KIMBROUGH. The only requirement the other justices made were that the site be within two miles of Pine Ford. They selected a site, on the high ground west of the main tributaries of Back Creek. This is located east of (today's) Belview Baptist Church on Bason Road, it is the nearest high ground to where the Trading Path crossed Quaker and Otter Creeks. 1778 and 1779 land records refer to a tract on both sides of the tributaries of Back Creek as "the Old Courthouse tract". We will begin the tour at 9am, leaving from Grays Chapel School which is located across the road from the church. The tour should last all day and we've chosen sites that we can drive too so some of our cousins who can't hike or walk long distances can join us. Maps of the Allred sites will be available at the reunion for those who can't join us. We are planning to eat lunch at Captain Tom's Seafood Restaurant around 1 or 1:30 that day. If you aren't a fan of seafood, don't worry. I can't eat it either, I'm allergic to shell-fish. There will be other items to choose from on the menu. I hope you can join us. Before the formation of Alamance Co, in 1849 the entire area was the western portion of Orange Co. If you had ancestors in western Orange Co before 1849 then you should look for them in Alamance Co after that time. If you had ancestors in Alamance Co then you should look at Orange Co for dates before 1849. Col. John STOCKARD and Giles MEBANE were responsible for the divison of the "western area" of Orange Co. Stockard and Mebane anticipated a hard battle to pass the division. The actual vote was 1,257 for division, 1,011 against the division. One possible help for Stockard and Mebane was the proposed name of the county seat in the companion legislation. The name decided on was "Graham". This was seen as a political move to honor the then Governor on N.C., William A GRAHAM. Gov. Graham was also one of Hillsborough's most respected citizens. Hillsborough was the county seat of Orange Co and had much vocal opposition to the division. Giles MEBANE is credited with naming the county Alamance after the battle of 1771. Some years later a Ggrandaughter of Col. John STOCKARD made (and wrote) history in Alamance Co. Sallie Walker STOCKARD became the first female graduate of the University of North Carolina in 1898. She also became the first female to receive a master's degree from that university. Her thesis for that degree was the first published history of Alamance Co. This thesis not only contained the history of the county but the history of some of the families. It is credited with being the first published genealogy of the ALBRIGHT family.
