Davidson River Cemetery is where it's been since at least 1828, when Lambert Clayton was buried there. I have Monteith's "Transylvania County Cemeteries" and in the index I find a dozen or so "Frady" listings; no Patillo; two Thrift, neither in Davidson River; a number of Capps, but none are in Davidson River. I don't think we've seen anyone researching Frady and maybe not Capps in Transylvania County (that seems to be a Henderson County name) on the list, maybe you'd like to invite this person to join. Entering public or private property to maintain or visit a private grave or an abandoned public cemetery without consent. (a)If the consent of the landowner cannot be obtained, any person listed in G.S. 65-74(1), (2), or (3) may commence a special proceeding by petitioning the clerk of superior court of the county in which the petitioner has reasonable grounds to believe the deceased is buried, or in the case of an abandoned public cemetery, in the county in which the abandoned public cemetery is located, for an order allowing the petitioner to enter the property to discover, restore, maintain, or visit the grave or abandoned public cemetery. The petition shall be verified. The special proceeding shall be in accordance with the provisions of Articles 27A and 33 of Chapter 1 of the General Statutes. The clerk shall issue an order allowing the petitioner to enter the property if the clerk finds all of the following: (1) There are reasonable grounds to believe that the grave or abandoned public cemetery is located on the property or that it is reasonably necessary to enter or cross the landowner's property to reach the grave or abandoned public cemetery. (2) The petitioner, or his designee, is a descendant of the deceased, or that the petitioner has a special interest in the grave or abandoned public cemetery. (3) The entry on the property would not unreasonably interfere with the enjoyment of the property by the landowner. (b) The clerk's order may: (1) Specify the dates and the daylight hours that the petitioner may enter and remain on the property; (2) Grant to the petitioner the right to enter the landowner's property periodically, as specified in the order, after the time needed for initial restoration of the grave or abandoned public cemetery; or (3) Specify a reasonable route from which the petitioner may not deviate in all entries and exits from the property. (1987, c. 686, s. 1; 1991, c. 36, s. 1; 1999-216, s. 12.) This is from the NC General Assembly

Maybe someone can compromise with the person, to survey and photograph the cemetery. That person can make the info public. In Texas, there is a similar conflict, where the two parties have gone to court about. I can get more info on that if you want.

I'd also be interested in the answer. I have Davis relatives buried in Granville County on private property. The owner has said that he'd "shoot anyone who stepped foot on my land". My aunt had enough nerve to visit the graves (which are in terrible condition). The owner did not approach her, but he did send his dogs out to scare her. Do we have any rights at all with regards to these graves? Carla Stancil Townsend

I have been told that my g-grandparents were buried in the Hickory Grove Methodist Church Cemetery in Charlotte, NC, but I did not find head stones marking their graves in that cemetery.They lived in Landis, NC, and perhaps in other locations in Mecklenburg or Cabarrus County, so it is possible that their gravesites could be located in any of these three counties. Robert William Roberts died in the 1920's; I am not sure when Henreitta died, and can only asume that they are buried together. However, it's possible that the graves could be located in two different places. Have been there several times over the years, as I have ancestors buried there who settled in the area. It is somehow connected with Smyrna Church, but I believe it is what they called the Hemphill family cemetery, the family having allowed the church to bury some members there. I have relatives in their late '90's who know the history behind it. They are in Morganton where I am residing now. The last time I went, it appeared that someone may have been looking after the place. Please e-mail me at nlhogan@directus.net and I will find out more about this for you. I AM interested in ANY Quartermus graves that might be located, but specifically, my line includes: * James Thomas Quartermus, born in 1809 * Quaturmus, Patrick; James Quatermus; Patrick Quartermus Jr.; Josiah Quatermus; Thomas Quatermus who were all in Pitt County in 1763. * James Benjamin Quartermus, born 1 NOV 1839 in Jamesville, North Carolina and died (where?) on 6 OCT 1920 The main thrust of my interest is in James Thomas Quartermus as I'm trying to find his parents, and possibly their parents. It is right next to the Carolina Mall on Hwy 29 N. right next door to the Northeast Hospital. When the property was bought from Mrs Burgess the grave was on the old home site. So when the mall was built the grave yard is right up against the buildings. it has a fence around it. When facing the mall it is on the right side of the mall and is easy to find. If you drive near the mall you will see it near the Sears entrance? Mrs Burgess was a very nice lady and was a nurse at the hospital for years, the hospital origanal name was at the time Cabarrus memorial Hospital. From what I understand they wanted to move the grave yard but was taken to court to stop it, it's been a long time ago so I don't remember details. The mall was built in '70's i think. There are a lot of Burgesses in Cabarrus County North Carolina. Signed Brenda

She was Madalene/Magdalene Vinesett, she Married John Haney in Charlotte, N.C. date unknown. She died sometime between 1935 and 1945. She would have been born between1908 and 1915 possibly in S.C. Father was Lucius Thedell Vinesett, he died in Chjarlotte in 1973. Mother was Mattie Louise Daniel, she died in Gaffney, S.C.1917.     3. Greetings folks! I am trying to find some information on a Confederate cemetery in Southport (Smithville). I was reading the Fort Caswell book over the weekend, and the author made mention that the Confederates who were sick at the fort were taken to a hospital in Southport and if they died, were buried there.
