In researching my Conrad MYERS I came across the following record in York County, PA, thinking that perhaps Jacob the son of this Conrad MYER could be my Jacob...but then I wondered why Jacob renounced his inheritance in favor of his brother...and eventually learned he had moved to Ohio. Perhaps that is YOUR Jacob since he is not mine---and if not perhaps it will help someone else. Conrad Myer Inquest Awarding The petition of Charles Myer & John Myer by their attorney Charles A. Barnitz Esq. was read to the Court as follows to Wit: To the Honorable the Judges of the Orphans Court. The Petition of Charles and John Myer two sons of Conrad Myer late of Codorus Township York County deceased. Respectfully showeth that said Conrad died Intestate leaving to survive him a widow named Magdalena and Nine children lawful issue namely Charles & John your petitioners, Jacob, Conrad, Daniel Jesse, Sally wife of John Runkel; Susanna wife of John Dubs; and Betsy, of whom three are minors. That he died seised as of fee of the following real estate viz. The dwelling place in Codorus Township containing about two hundred twelve acres adjoining lands of Conrad Rennoll, Brodbeck, Meckly, & Christian Rennoll with a Grist Mill and Saw Mill and Improvements. Also a Plantation and tract of Land with the buildings and Improvements in Hopewell Township containing about two hundred and twenty acres, adjoining lands of Jacob Lanius, James Edie, Christian Sibey, Henry Hammond, Benjamin Meads. Also a Lot of Woodland in Hopewell Township of about three acres, bounded by lands of Samuel Miller & others all which said Widow & heirs hold together & undivided and not being able to agree on any other mode of division or partition or valuation, the petitioners pray that an Inquest be awarded to make partition of the premises according to law. If the same cannot be so done, then to inquire how many the premises will conveniently accommodate and to value each division in any case then to appraise the whole according to law, and they will pray. Signed Charles Myer and John Myer. Charles A. Barnitz, Attorney August 3, 1830 Whereupon the court order and Direct that the Sheriff of the County of York in his proper person and with twelve good and lawful men of his Baily wick in the presence of all the parties who shall chuse to attend or the Guardians of such of them as are minors, they respectively having had due and legal notice thereof, do hold an Inquest on the premises and make partition thereof with the appurtenances to and amongst the heirs of said intestate if the same will admit of such partitions without prejudice to or spoiling the whole. But if they find that the same cannot be so done, then that they well and truly inquire whether the same premises will conveniently accommodate more than one of the said heirs, and if they so find, then that they well and truly petition the same into so many parts as the same will bear, by metes and bounds and value and appraise each division. But if the said inquest shall find that the said premises will not admit of such Partition and Division at all, then that they well and truly value and appraise the whole together and undivided according to law. And that the said Sheriff and inquest make return of said Inquisition annexed to this order, under their hands and seals to the next Orphans Court, after the same is held. August 3, 1830 On the petition of Daniel Meyer a son of Conrad Meyer late of Codorus township, York County deceased the Court appoint Charles Meyer of Hopewell Township, York County guardian of the person and estate of him the said Daniel Meyer. On Petition of Jesse Moyer a minor son of Conrad Moyer of Codorus Township deceased the Court appoint John Strickhouser (of Henry) Guardian of the person and estate of said minor. November 2, 1830 Came into court Charles Meyer oldest son of Conrad Meyer deceased and accepts No. 2 being the Hopewell Farm real estate of said deceased at the return of valuation. John Meyer second son of Conrad Meyer deceased came into court and accepts number one (No. 1) of the real estate of said deceased at the return of valuation. Conrad Meyer fourth son of Conrad Meyer deceased (Jacob having renounced) accepts No. 3 in Codorus Township being the mill property at the return of valuation. William Spangler late sheriff Came into Court and made return of a former order of this court Whereby he was commanded to make partition and valuation of the Real estate of Conrad Meyer deceased Which the Court upon due consideration Confirm We the children & heirs of Conrad Meyer deceased appoint Charles A. Bernitz as our attorney to appear for us and refuse the land of our late father at the appraisement which was made by the Jury and to request the Court to grant a sale of my part which is not taken and it is also our desire that our brothers Conrad and Charles may take those parts which are not taken by any others and I Jacob Meyer do renounce my right to take any part and assign my right to accept to my brother the said Conrad. Witness our hands and seals this 1 November 1830. Jacob Meyer, George Dubs, Daniel Meyer by Charles Meyer his guardian, John Runkle, John Strickhouser, Elizabeth Moyer. Witness present Daniel Dubs and Conrad Rennol. Meyer Decree of Land No. 3 and 4 Whereas at November Orphans Court last William Spangler Esquire late High Sheriff of the County of York came into Court and made return of a writ of partition and valuation of the real estate of Conrad Meyer late of Codorus township York County in the State of Pennsylvania deceased who died intestate Setting forth as follows to wit Inquisition indented and taken on the land hereinafter mentioned on the 30th and 31st days of August A.D. 1830 before William Spangler Esq. High Sheriff of the county of York in the state of Pennsylvania by virtue of a writ of partition and valuation to him directed and to this inquisition annexed on the oath and affirmations of Martin Sherer, John Bear, David Brillhart, Michael Mecklin, Christian Mecklin, Frederick Epley, James Edie, Henry Hammond, Tolbert Hammond, David Fulton, Joseph Leib, and Samuel Baird respectively taken twelve honest and lawful men of his bailiwick who on their oaths and affirmations aforesaid respectively do say that they went to and upon the lands and tenements on the days and years above mentioned of which Conrad Meyer in the same writ mentioned died ___ and find that the premises of aforesaid could not be divided between all of the said heirs of the deceased without prejudice to or spoiling the whole. But the inquest do find and say that the premises aforesaid will admit of partition and division conveniently to accommodate four of said heirs without prejudice to or spoiling the whole which parts are described viz Number One No.1 containing one hundred and seventy two acres with a Brick house and barn thereon erected Situate in Codorus Township adjoining lands of Conrad Rennolds and Brodbeck. Number two containing forty nine acres and one hundred perches situate as aforesaid with a Grist Mill thereon erected adjoining Number One Christian Rennold and others. Number three (no. 3) a tract of land containing two hundred and twenty two acres with a log house and log barn thereon erected Situate in Hopewell Township adjoining James Edie, Jacob Lanius, and others. Number four (No 4) a tract of woodland containing four acres Situate in Hopewell Township York County adjoining lands of Samuel Miller and others and the inquest aforesaid have valued and appraised Number two (No. 2) as aforesaid at the sum of three thousand five hundred dollars lawful money of the Unites States Which partition and valuation the County do hereby confirm and now came into court Charles Meyer oldest son of said intestate and accepted No. 3 & 4 at the return of valuation and John Meyer second son of said intestate accepted No. 1 at the return of Valuation. Jacob Meyer having renounced his right to the taking any of said real estate at the valuation as will appear from his renunciation with the other heirs recorded and filed. And now on the fourteenth day of December A.D. 1830 first above written he the said Charles Meyer came into court and prayed to be permitted to take the part of said real estate designated and marked number four at the return of the valuation in addition to the above mentioned number three and prayed the court to decree said parts to him subject to him paying the widow and other heirs their respective shares of the valuation thereof. Whereupon the court decree the same to him he paying the widow and other heirs of said intestate their several and respective shares and parts thereof and thereout and it is ordered and decreed by the court that the said Charles Meyer be allowed the sum of thirty three dollars and twenty five cents the costs and expenses of these proceedings that he pay unto Magdalena Meyer the widow of said intestate annually during her natural life the sum of twenty seven dollars fifty eight and a half cents. The first payment to be made on the fourteenth day of December A. D. one thousand eight hundred and thirty one in full of her right of dower to and out of number three and number four of the real estate of said intestate with the appurtenances that he retain in his own hands the sum of one hundred and two dollars and seventeen cents and at the death of said widow Meyer the further sum of fifty one dollars and eight and one quarter cents in full of his share of the land and appurtenances No. 3 and four aforesaid. That he pay unto John Meyer, Jacob Meyer, Conrad Meyer, Daniel Meyer or to his Guardian, Jesse Meyer, John Runkle, intermarried with Sarah or Sally in right of said Sarah George Dubs intermarried with Susana in right of said Susana and Betsy Meyer or unto the guardian or guardians of such of them as are minors or such as are placed under guardianship each and every one of them respectively the sum of one hundred and two dollars and seventeen cents on the fourteenth day of December A. D. 1830 with interest for the same from this 14th day of December 1830 and that he the said Charles pay immediately after the death of said Widow unto the other heirs above named the further sum of fifty one dollars and eight and a quarter cents to each of them respectively or to the guardians of such as are minors which said several sums of money will be in full of their several shares of the valuation of the land, premises and appurtenances No 3 & 4 as aforesaid as eight of the children of said intestate which said several and respective sums of money are the full amount of the Valuation of said land and appurtenances taken by Charles Meyer aforesaid. And it is further ordered and decreed by the court that upon the said Charles Meyer his making the several payments aforesaid or giving good security for the sameThat thereupon the said Charles Meyer his heirs and assigns do hold the said land and premises marked and described as number three and number four in the return of valuation for the same estate in as ample a manner as the said Conrad Meyer deceased held and enjoyed the same in his lifetime. Exonerated and discharged from the further claims of the other heirs and the widow aforenamed of said intestate and all persons claiming or to claim the same under them or any or either of them. Charles Meyer and Jacob Lanius Respectively bound unto the Commonwealth of Pennsylvania in the sum of two thousand seven hundred and seventy four dollars Lawful money of said Commonwealth to be levied of their goods and chattels, lands and tenements Respectively upon the condition That the said Charles Meyer shall well and truly do and pay unto the widow and other heirs of Conrad Meyer deceased their respective shares of the valuation of that part of the real estate of Conrad Meyer deceased which the said Charles Meyer has taken at the Return of valuation at the day and time set forth and appointed for the payment of same in and by the foregoing distribution and decree. Then these Recognizance to be void otherwise to be and remain in full force and virtue. Conrad Meyer Probate Inventory File York Co., PA in 1830, Codorus Twp. December 14, 1830 Meyer Decree of Land No.2 Whereas at an Orphans Court held at York for ___ county on the second day of November A.D. 1830. William Spangler, Esq. ________ Sheriff of the said county came into court and made return of a writ of partition and valuation of the real estate of Conrad Meyer late of Codorus Township in the county and state aforesaid among the widow and the several heirs of said Conrad Meyer deceased who died intestate and whereas by the inquisition annexed to said writ it appears that the said sheriff and inquest found that the real estate of said intestate would not admit of partition or division among all the heirs of said intestate without prejudice to or spoiling the whole. But they found and say that the premises would admit of partition and division conveniently to accommodate four of the heirs of said intestate without prejudice to or spoiling the whole. Which parts are severally described in said inquisition annexed to said Writ and allowed and filed among the records of the Orphans Court of said county as follows to wit Number One No.1 containing one hundred and seventy two acres with a Brick house and barn thereon erected Situate in Codorus Township adjoining lands of Conrad Rennoldd and Brodbeck. Jacob Meyer third son of said deceased refused and renounced his right to the taking any part of said intestate's real estate at the return of valuation all the other heirs likewise renounced taking any part of said real estate at the valuation thereof. And now came into Court Conrad Meyer fourth son of said intestate and prayed the court to decree to him that part of said real estate designated and marked on the inquisition as Number two (No. 2) containing forty nine acres and one hundred perches with a Grist Mill thereon erected as aforesaid. Whereupon the court decreed the same to him he paying the widow and other heirs of said intestate their several and respective shares and purparts thereof. And it is ordered and decreed by the Court that the said Conrad Meyer be allowed the sum of thirty one dollars and the _________--Magdalena Meyer the widow of said intestate annually during her natural life the sum of sixty nine dollars and thirty seven cents the first payment to be made on the fourteenth day of December A.D. one thousand eight hundred and thirty one in full for her right of dower to and out of Number two (No. 2) of the real estate afore said That he return in his own hands the sum of two hundred fifty six dollars and ninty four cents now and at the death of said widow Meyer the further sum of one hundred twenty eight dollars and forty seven cents in full of his share of the land and appurtenances as Number two aforesaid That he pay unto Charles Meyer, John Meyer, Jacob Meyer, Daniel Meyer or to his guardian or trustee for his use Jesse Meyer John Runkle intermarried with Sarah or Sally in right of said Sarah George Dubs intermarried with Susana in right of said Susana and Betsy Meyer or unto the guardian or guardians of such of them as are minors or such as are placed under guardianship each and every one of them respectively the sum of two hundred fifty six dollars and ninety four cents on the fourteenth day of December A.D. one thousand eighteen hundred and thirty one with interest for the same from the 14th day of December A.D. 1830 present and that he the said Conrad immediately after the death of said Magdalena the widow pay unto the other heirs above named the further sum of one hundred twenty eight dollars and forty seven cents to each and every of them respectively or to the Guardians of such of them as are minors or their legal representatives Which said several sums of money will be in full of their several share of the valuation of the Land and Appurtenances marked and described in said inquisition as Number two (No. 2) as aforesaid as eight of the children of said intestate Which said several and respective sums of money are the full amount of the valuation of said land and appurtenances taken by Conrad Meyer as aforesaid. And it is further ordered and decreed by the court that upon the said Conrad Meyer his making the several payments aforesaid or giving good security for the same That thereupon the said Conrad Meyer his heirs and assigns do hold the said land and premises with the appurtenances with the priviledge of the water on number one as it ever had for the same Estate in as ample a manner as the said Conrad Meyer deceased held and enjoyed the same in his lifetime Exonerated and discharged from the further claims of the widow and other heirs of the said Intestate and all persons claiming or to claim the same under them or any or either of them. Conrad Meyer and Christian Rennold Respectively bound unto the Commonwealth of Pennsylvania in the sum of seven thousand dollars lawful money of the said Commonwealth to be levied of their goods and chattles lands and tenements Respectively upon this condition that the said Conrad Meyer shall well and truly do and pay to the widow and other heirs of Conrad Meyer deceased their __________ of the inheritance that part of the real estate of Conrad Meyer deceased Which said Conrad Meyer deceased has taken at the Return of valuation at the day and time set forth and appoint for the payment of the same in and by the foregoing distribution and decree Then their recognizance to be void otherwise to be and remain in full force and virtue Gravestones in St. Emanuel’s Union Churchyard Cunrod Moyer born 29 September 1761, died 1 May 1830 age 68 yrs 7 mo 2 d, stone engraved in German. Magdalena Myers b 4 Aug 1769 died 4 October 1831 age 61 years 10 months also in German. St Emanuel’s Burial Association erected a memorial in 1925 listing all the old gravestones in the cemetery. In addition to Conrad, his brother Peter Myers and sons Conrad Myers and Daniel Myer are also buried there. His wife's brother Christian Renoll is buried there as well.
