> James Smith by 1st wife, Sarah Phipps, had a son Prestwood Smith. > And > although it does not show up on the Smith Family Tree, I have a note > in my > files from a respondent cousin that Zachariah Jr. named a son Augustine > Prestwood Smith. List of heirs from Zachariah Smith's will, filed for probate 13 Dec 1831. Sons: Zachariah A. Smith, and Augustine P. Smith-- guardian named: John L. Wall, so these children were under 21, possibly under 14 on 19 May 1831 when the will was written as children over 14 were allowed to select their own guardian. The guardian was given money to pay for their schooling. daughters: Erelian Rebecca Mayes & Melissa N. Dowty. Are these the names you have on your Family Tree? > What do you think? A duel or a brawl between Prestwood and Wilson? The note in the book said "Manslaughter'. Mrs. Wiese did small excerts from the papers and did not include complete articals. This doesn't seem to be one of the newspapers available from the LDS FHCs but the archives in Jackson has a larger assortment of filmed newspapers.
