McCearley his wife of said county shows that William Aswell departed this life some time in the year 1863 leaving no will that your petitioners know of that at the time of death of said William Aswell he left your petitioner Eliza McCearley as his widow who has since intermarried with said Leroy McCearley that said intestate at the time of hi s death left a small real and personal estate in said county….. …..besides your petitioner widow as aforesaid the said intestate left two other heirs and distributes children of said intestate to wit minors, William (W.)
