The legend at the bottom states that it was made for Sinai Foster and Erastus Lum for a wedding present in 1820. the original belongs to the family of Wm (Bill) Lum in Port Gibson. I imagine Martha has it hanging in Oak Square. Mine is a hand painted copy done by Bill's daughter Deborah for me. we have had the original photographed and copies made throughout the years for descendants who are interested. He lived in Sicily Island Catahoula Parish, Louisiana and was very involved with the Lovelace and Wall clans.)4. Betty Smith B. 1783 place unstated. 5. Barbara Smith B. 1785 place unstated. 3. The Mays family seems frequently intermarried with Zachariah's offspring. James Smith (Zachariah and Francis' son) had a daughter by the name of Elizabeth by his third wife Francis Thompson who married Benjamin M. Mayes 21 May 1835 in Wilkinson County, Mississippi. This family followed John Smith m. Elizabeth Kaigler (James and Sarah Phipps Smiths son) to Attakapas district where they got into court trouble over land deals in Wilkinson County Mississippi. As a result of that litigation Benjamin Mayes moved his family to Jefferson County, Texas. And yes Benjamin's first wife was Evelina Rebecca Smith daughter of Zachariah Smith Jr. and Sarah Kimball. They had 3 children that I know of William N Mayes, Augustin P. Mayes and Sarah Ann Mayes. John Smith the son of James and Sarah Phipps Smith was ever bit as court plagued as John Moses Smith son of William but it sure has made tracking them easier. Thanks! 3. This is not from notes just from my head so take it for what it is worth. Prestwood Smith, son of James Smith and Sarah Phipps owned a tavern in Woodville there by where the Museum is now. A fight broke out in the tavern between Wilson and someone else and Prestwood tried to stop the fighting and got fatally wounded by Wilson in the attempt. James and Sarah had 4 children John, Prestwood, Nancy Ann, and James. When they divorced 9 July 1794 John and Prestwood were apprenticed to James' oldest brother William to learn the art of Silversmithing. James himself was a blacksmith. Their daughter Nancy Ann Smith married William Smiths son John Moses Smith and moved to Attakapas District, Louisiana with him. They are my 3rd great grand parents. Their daughter Rosanna Smith married a Peter Smith in ca. 1845 in Louisiana who I think may be descended from Zachariah's son Peter. Therefore my deep interest in all of Zachariah's children. I have yet to find out what became of James and Sarah's baby James. Sarah was awarded custody with provisions that he not be removed from the territory. That would have been a problem for John and Prestwood also as William was in Feliciana Parish and by 1799 was in Attakapas District Louisiana. He must have turned his apprentices back over to his brother James as they all remained in Wilkinson County but I have found no records of that. John Moses went back to Wilkinson County Mississippi to marry Nancy Ann in 1812 and settle her portion of the estate with her brothers. Thanks! If I have his death date, I could not find it. James Smith by 1st wife, Sarah Phipps, had a son Prestwood Smith. And although it does not show up on the Smith Family Tree, I have a note in my files from a respondent cousin that Zachariah Jr. named a son Augustine Prestwood Smith. I believe this was sited as from a deed there in Wilkinson Co. Augustine Prestwood may have been Frances Prestwood Smith's father, or relative in Anson Co., N.C. as there was a land transaction between him and Zachariah Smith before they left N.C. Another note I have indicates that Jame's brother William probably reared the young Prestwood. What do you think? A duel or a brawl between Prestwood and Wilson? The tree lists James' birthdate as Feb 16, 1764, so this Capt. Prestwood could have been his son or Zachariah jr's son if indeed he had another son born after the tree was made in 1820, which I question. At any rate, thank you for the additional information for the Smith files. >I don't have a death date but Zachariah Smith's will was filed for > probate the 13 Dec 1831. > >>From Mrs. Wiese's book on the Woodville Republican, issue dated 27 Sept > 1823, there is a note that Capt Prestwood Smith was killed by A. The only member in First Families on Zachariah to my knowledge was Winnie Cowgill. I will have to Email Ralph to see if he had any supporting data for the death dates. I just wonder why, since at the base of the tree, Zachariah and Frances birth dates are given and their marriage date, but no death dates. The notation at the side of the base states that the tree was done as a wedding gift for Sinai upon her marriage to Erastus Lum. It says 1820, but my record shows they married Jan 1821. It seems whoever made the tree would have included the death dates. Perhaps the tree is incomplete. I do have some of the gift deed records but certainly not all you list. 3. The Probate for Zachariah Smith on 13 December 1831 was for Zachariah Smith Jr. (son of Zachariah m. Francis Prestwood) Will Book 1 pg. 17 shows Zachariah made the will 19 May 1831. He requested his executors to take care of all debts belonging to the estate. He obtained Judgement against Wm. H. Ruffins executor in a suit for $2,500. His son Zachariah A Smith to get $1,000 of the settlement paid to guardian applied to schooling and maintenance. The rest of the money to be divided equally between Evelina Rebecca Mayes, Mellissa M. Dowty, and Augustine P. Smith and Zachariah A. Smith. Remaining portion of last years crop not needed for debts to be sold at New Orleans and proceeds to go to Zachariah A. Smith. Present crop of cotton and corn to be equally divided after expenses paid between the four children. His land was to go to Zachariah A. Smith except what had already been given to the other children. Guardian for Zachariah A. Smith was John L. Wall. Augustine P. smith and John L. Wall were executors. Any disputes to be settled by neighbors Glass B. Barkley and George Ogden. Witnesses Glass C. Barkley and Temple Stewart. Filed 13 December 1831 by John L. Wall Executor. Thanks! 3. Hi Nan Sorry to be so late jumping in here but I just got home. I am always excited to see Zachariah Smith family information show up. According to the book THE ORDER OF THE FIRST FAMILIES OF MISSISSIPPI 1699-1817. ed. Pg. 72. Zachariah Smith died in 1812 and the records I have abstracted from the courthouse in Woodville seem to bear that out. The Conveyance records show a group of bequests to his grand children and great grand children that began to be recorded in starting the 4 November 1812. They had been written at various dates in the preceding months of that year with the last being done the 1 November 1812. I expect he died shortly after that date. Conveyance records Book A pg. 295. Recorded 4 November 1812. Zacariah Smith to Francis Ann Lovelace his grand daughter a Negro girl Phebe. Done 29 Aug. 1812. Signed Zachariah Smith. Witnessed Jno Wall, W. Hunter. Book A pg. 296. Recorded 4 November 1812. Zachariah Smith to Nancy D. Foster a Negro girl Sary with yellowish complexion, 13 years old. Done 9 October 1812. Signed Zachariah Smith. Witnesses Jno Wall, W. H. Hunter. Book A. pg. 300. recorded 20 November 1812. Zachariah Smith to granddaughter Barsheba Hetty Foster, a Negro girl Louisa. Done 28 Aug. 1812. Signed Zachariah Smith. Witnesses Randolph Foster and Moses A Foster. Recorded 20 November 1812. Zachariah Smith to Polly Eleanor Foster, his granddaughter, a Negro girl Nancy. Done 28 Aug. 1812. Signed Zachariah Smith. Witnesses Randolph Foster and Moses Foster. Book A, pg. 301. recorded 20 November 1812 Zachariah Smith to his grandson Thomas Kelsey 2 plow horses with all utensils for husbandry, Smith and Working tools, all household and kitchen furniture, clock and yoke of oxen, a sorrell horse, 1/4 of present crop, all stock of hogs, and all whiskey in storage. Done 28 August 1812. signed Zachariah Smith. Witness Randolph Foster. Book A, pg. 307. recorded 5 Jan. 1813 Zachariah Smith to Adolphus Fredrick Smith in Parish of Attakapas for $500 land on Thompsons Creek in New Felicianna. Spanish Grant to Felix Barnard. When granted bounded on north by Philip Alston, on south by Dr. Joga Raouel, bought from Edward Gibbens by Zachariah Smith. 236 1/2 arpents. Done 28 July 1812. Signed Zachariah Smith. Witnesses: John Wall and Peter Smith. Book A, pg. 309. recorded 5 Jan. 1813. Zachariah Smith to Eliza Ann Wilkinson his great grand daughter 4 cows and a chestnut sorrell mare. Done 1 Nov. 1812. signed Zachariah Smith. Witnesses: John Wall, Peter Smith. Book A, pg. 310. recorded 5 Jan. 1813. Zachariah Smith to William Henry Smith his grandson a Negro boy Jerry. Done 28 July 1812. Signed Zachariah Smith (his mark this time, the rest have been signatures). Witnesses: John Wall and Peter Smith. His son Peter Smith is made administrator of his estate in January of 1813 as he died intestate. He had already taken care of his bequests by deed in the preceding months so there was only a small amount of last details for Peter to settle. INVENTORY AND ACCOUNTS BOOKS (These are housed in the basement) Vol. 1, pg. 262. Jan. 1813. Peter Smith made administrator of Zachariah Smith Sen. estate as he died intestate. Vol. 2 pg. 376. July 1821. Peter Smith, administrator of Zacheriah Smith Sen. dec. states he has only $186 belonging to the estate and bills amounting to $193. Vol. 3 pg. 113. Debts of Zachariah Smith estate as of 13 Feb. 1813. North Evans $85.91, $5.50,$51.41 Arron Kirkland $18 E.H. Marselis $20.24 Jas. Wilson $4.86 John Threkeld $28.00 total $193.70 Property of Estate available to Peter Smith Administrator. 1 horse $76 Neat processed 4 bales of cotton $189.22 cotton $20.46 Property brought $186.28 pg. 261. Bond of Peter Smith as administrator with Zachariah Smith and Thomas Lovelace as securities. The dates and information in not filled in on the bond. But it is obviously the bond for Peter to be administrator of his fathers estate. (This appears to be the final accounting of Zachariahs estate.) I believe Francis Prestwood Smith had already died in 1809, though First Families says she died 1820-24. In the first place if she had still been alive at the time of Zachariah's death (1812) she would have been provided for in his estate or the deeds prior to his death. She was not. The last record on which she signed was Conveyance Book A, pg. 90. recorded 10 October 1808. Made 2 March 1808. Zachariah Smith Sr. and Francis his wife to John Foster and Mary his wife and Claiborne and William Zachariah Foster, their sons for $3,500 a tract of land on Blumart Creek 500 acres. Adjacent Zachariah Smith Jr. on north, David Ogden on south, William Ogden on east. signed Zachariah Smith Sr. and Frances Smith. Wit. Thomas Foster and William Hunter. Book A, pg. 135. Recorded 4 January 1810 made 16 September 1809 Zachariah Smith Sr. and Frances his wife to Thomas Kelsey for $1000 a tract of land on Buffalo Creek 174 acres. A Spanish grant of 1788. Signed Zachariah Smith. Frances did not sign. Wit. Joshua Buchammer Bateman, John Foster. Though the last record says Zachariah and wife and was actually done September 1809 no signature is shown on the record at the courthouse. While most of the of the other property he deeded to his grandchildren were not real estate and did not require her signature the property in Feliciana Parish that he deeded to his grandson Adolphus Fredrick Smith would probably have carried her signature had she been living. As to where they are buried I expect both are buried on the family plantation as was the custom of the time. So unless someone in the family can give me proof that she went to live with one of the family (I love to get those kinds of stories from families as they are the only ones that can give us that kind of information) until her death because she needed special care I will leave their dates of death at 1812 for him and 1809 for her. Thanks! In fact, one had the old Foster Bible. Zachariah Smith Sr. was born 1734 so this could not be his will. His son Zachariah was born 1770 and married Sarah Kimbrel. the tree on shows Benjamin, Helen 2 Barbara's, one died in infancy, and Evelina. 1. [MSWILKIN] Question - Earliest Known Cemetery in Wilkinson Co.
    2. Can you supply the date of the earliest known cemetery in Wilkinson Co., MS? Reason: My ancestor, George Keller [yes, there were three of them, two of them father and son, third one unidentified], migrated from Sumter Co., SC in the 1810s, along with a Scott family of Red Wood Creek in Feliciana Parish, now East Feliciana Par., LA (1820 census). George is reported to have been born June 1762, birthplace unknown, but probably near Sumter Co., SC. Two of the Scott brothers (there were seven of them) married Keller brides, but years apart. The surviving members of this combined family group migrated to Copiah Co. en masse when that area opened up for settlement by claimants. The elder George Keller died Feb 1823, his wife Jane surviving him, and apparently migrating to Copiah Co., MS, along with at least one son (Thomas Keller) and a son-in-law (Samuel T. Scott) and miscellaneous grandchildren. The next paragraph will explain the origin of the death date. What little is known of the George Keller family is found mainly in a transcribed "George Keller Bible Record," published by the Mississippi Genealogical Society in CEMETERY AND BIBLE RECORDS, V. II (Jackson: Nov 1955). I stumbled on a copy years ago in Vicksburg, MS Public Library. I expect Keller and his son George W. Keller were buried on the family farm, as many families did in this time period. However, if you or another person of that area knows of an early cemetery, will you let me know. The man that owns the land now is Fred Dwight Perry. His Daddy was Fred Francis Perry married to Annie Ruth Curtain. Mr. Fred is dead now but Mrs. Perry lives about 1.5 miles from me. In fact Bobby tilled Mrs. Perry and her daughter Francis a garden spot the other day. Hope you are doing good. It's THAT TIME of the year for me...garden, yard, etc. So been staying real busy. But every now & then just have to sit down and play a little bit on this stuff. Take care of yourself!!! Brenda

    3. I wrote Mr. Anderson off line and told him you took pictures of this cemetery and I stayed in the car because I didn't want to meet any rattle snakes. I started to add the red bug part to the letter to the list but didn't want to embarrass you. When I went there earlier it was in the fall and the ground was covered with leaves. I haven't been back since it was posted. The man who now owns it gave me permission to go when I wanted to and told me who to call to have the gate unlocked but with my leaky memory I can't remember who it was. He was a Perry. 3. On Ashley 1, I should have said, at the time I was over, which was back in the mid 1980s, only the Ashley graves were left and I was told the land had been plowed and planted. I remember a garden, or something, growing where Uncle Willis said the old graves were. I only pass on what I was told. Virginia
