    3. 1834-1848 Minutes Probate Court A Noxubee Co 7 Jan 1839 pg. 39 That the account of sales of the estate of William BENNETT dec'd. as presented by Joseph L. HUNTER, administrator and the same is hereby received and ordained to be recorded and that the list of notes due and money belonging to the estate of William BENNETT dec'd. presented by Joseph L. HUNTER administrator be and the same is hereby received and ordered to be admitted to record - and that the administration of the estate of William BENNETT dec'd. be and is hereby authorized to sale the crop of cotton now on hand belonging to said estate for cash at private sale and make return there of to the court. 1 Apr 1839 pg. 44 Ordered that the return of Joseph L. HUNTER administrator of the estate of William BENNETT dec'd. of the amount of sales of the crop of cotton belonging to said estate and the same is hereby received and ordered to be recorded. 2 Dec 1839 pg. 58 That the administrator of the estate of William BENNETT dec'd. is hereby authorized to rent the land belonging to the estate of said dec'd. for the year 1840. 6 Jan 1840 pg. 63 To the Honorable, the Probate Court of Noxubee County, Greeting: Whereas I, Temperance GANDY, late consort and now widow of Foster GANDY dec'd. and entitled to one third part of all the land, tenements, and --??-- of which the said Foster GANDY dec'd --??-- seized and possessed or had --??-- conveyed whereof I had not relinquished my right of dower as provided for by law and whereas the said Foster GANDY dec'd. and seized and possessed of the following land to wit, the northwest 1/4 of Sec. 19, Twp. 13-N of Range 19E also the SW 1/4 of Sec. 18, Twp-13-N, Range 19E, and also the East 1/2 of the SW 1/4 , Sec. 19, Twp 13-N, Range 19-E. Now therefore your petitioner humbly prays your Honorable court to issue a writ directed to the sheriff commanding him to summon five --??-- freeholders as commissioners who --??-- oath shall allot and sett off by metes and bounds to me Temperance GANDY widow as aforesaid on one/third part according to the quality and quantity of the above designated lands your petitioner further prays that said commissioners shall also at the same time allot and set off to me my portion of the personal estate or the slaves of which the said Foster GANDY dec'd did possessed of which I am entitled to by law and also to make a full division of all the personal estate of said dec'd. among the heirs. <signed> Temperance GANDY by her attorney Chas. ALEN It is therefore ordered by this court that the foregoing petition be and the same is hereby granted and further named that Robert NEAL, Henry BISHOP, Samuel SHAW, Humphrey JIMENSON?, and David W. LOCKETT be and they are hereby appointed commissioners for the purpose of c--??-ing? in to affect the foregoing order according to law. 3 Feb 1840 pg. 63 Ordered that the report of the commissioners appointed to lay off and set apart the dower of Mrs. Temperance GANDY late consort and now widow of Foster GANDY , dec'd. be and the same is hereby recorded and ordered to be recorded. 2 Mar 1840 Ordered that the clerk of this court issue summons to the following persons. Guardian, Executors, and administrators to come forward at a regular term of this court to be held on the 1st Monday of April and May next and show cause if any this hour why they have not made their annual returns to this court and also make settlement with the court viz: Jethro ATKINSON, Alfred BRIDGES, John GANDY, --------who have not made return to this court and settlement for the same for the year 1839. 1 Dec 1840 pg. 97 Ordered that the return of final settlement of John GANDY guardian for the minor heirs of Foster GANDY dec'd. be and the same is hereby received and ordered to be recorded pg. 98 That John GANDY, guardian for the minor heirs of Foster GANDY dec'd. be and he is hereby allowed the sum of one hundred dollars for the hire of a negro drowned or stand in the petition now named and ordered to be recorded. 3 May 1841 pg. 114 Ordered that the return of Joseph L. HUNTER adminstrator of the estate of William BENNETT dec'd be and the same is hereby received and ordered to be recorded. Martha ROBERTSON, petition for dower of William ROBERTSON 4 Jan 1842 That citation issue to Jethro ATKINSON notifying him or and personally before the Judge of our Probate court on the first MOnday in February next and make return of his actings and ?--?? as guardian for Henry M. ATKINSON and William H. ATKINSON minors of Jacob ATKINSON dec'd. and give new bodn for his guardianship of said minors. Ordered that citation issue to alfred BRIDGES, guardian of Caroline J. ATKINSON to come forward and make return of his acts as guardian for Caroline J. ATKINSON minor of Jacob ATKINSON, dec'd and to give new bond for his guardianship of said minor. That citation issue to all persons interested in the estate of William BENNETT dec'd to be and personally appear before the Judge of Probate of said county on the first Monday in June next and show cause if any why the administrator of said dec'd. should not make final settlement of said estate on that day. Ordered that the return of Jethro ATKINSON guardian for William H. ATKINSON be and the same is hereby received and ordered to be recorded Ordered tha the return of Jethro ATKINSON guardian for Henry ATKINSON be and the same is hereby received and ordered to be recorded. 6 Jun 1842 pg. 155 This day according to previous legal notice published in the Macon Herald published in the Town of Macon came into open court Joseph L. HUNTER, administrator of all and singular other goods and chattels, rights and credits of William BENNETT, dec'd. With the amount of sale, expenditure together with his vouchers whereupon it is ordered and agreed that said return and final settlement be allowed and approved. IT is further ordered and adjudged that the said be discharged from further duties as administrators aforesaid. It is further ordered that Joseph L. HUNTER administrator as aforesaid pay out to the guardian of the minor heirs of said estate the sum of 135. 28/100? dollars the amount he is due said estate and also to return --?? to said guardians the --??-- and in amounts and other --??-- of debts returned by said administrator. Ordered that Joseph L. HUNTER be and he is hereby appointed guardian of Samuel S. BENNETT, one of the minor heirs of William BENNETT dec'd upon his giving bond and security in the sum of one thousand dollars. Ordered that Joseph L. HUNTER be and he is hereby appointed guardian of Jehu S. BENNETT, one of the minor heirs of William BENNETT dec'd upon his giving bond and security in the sum of one thousand dollars. Ordered that Joseph L. HUNTER be and he is hereby appointed guardian of Reuben BENNETT, one of the minor heirs of William BENNETT, dec'd. upon his giving bond and security in the sum of one thousand dollars. Ordered that Joseph L. HUNTER be and he is hereby appointed guardian of Columbus L. BENNETT, one of the minor heirs of William BENNETT, dec'd. upon his giving bond and security in the sum of one thousand dollars.
