Noxubee County, MS Probate Court Minutes Vol. A (1834-1870) 25 Oct 1845 pg. 395 Legal notice published in the Independent a newspaper published in the town of Macon for the purpose of making final settlement of the estate of John W. BARNES dec'd. Present John J. BEAUCHAMP This day came into court R.B. BRIDGES administrator of John W. BARNES dec'd and the settlement of said estate is continued until Saturday the 1st day of November next. 1 Nov 1845 pg. 396 This day in persuance? to legal notice published in the Independent a newspaper published in the town of Macon notifying all persons interested in the final settlement of the estate of John W. BARNES dec'd to be and appear before the Judge of our Probate court on this day to show cause if any why the same should not be allowed and thereupon came R.B. BRIDGES administrator of said estate and presents no vouchers ---? --? from 1 to 35 inclusive for allowance hwich after examination by the court they are ordered adjudged decreed by the court that the same hand is hereby allowed and upon inspection and examination it is found that said estate is indebted to said administrator the sum of $352.94. It is ordered that said administrator go hence and c. 12 Dec 1845 pg. 399 Ordered that James A. GAMIEL? Joseph W. PARK and John COTTON be and they are hereby appointed appraiser of the estate of Coleman H. CALLOWAY dec'd and they are hereby required to make their return of the same according to law.... 3 Jan 1845 pg. 402 This day came Samuel R. BRIDGES security on the administration bonds of Joseph H. FRITH? administrator with the will annexed of John WILLIAMS dec'd and petitioned the court to open a citation to said Joseph H. FRITH? commanding him to be and appear at the next regular term of the probate court of said county to be holden at the court house in the town of Macon on the first Monday of January next and give new bond and securities and release said Samuel R. BRIDGES which petition is granted and it is ordered that a citation issue? to the Sheriff of Noxubee County aforesaid commanding him to summon said Frith administrator as aforesaid to be and apear at the term aforesaid and give the bond aforesaid otherwise his letters of administration will be revoked in persuance of the statute in such cases made and provided. 6 Jan 1846 pg. 408 ordered that the petition of Samuel R. BRIDGES praying to be released as one of the securities of Joseph H. FRITH as administrator of John WILLIAMS dec'd be and the same is continued until the next term of this court. 31 Jan 1846 pg. 410-411 Ordered -- Be it remembered that heretofore at the January Term 1846 of this court Samuel R. BRIDGES one of the sureties on the administration bond of Joseph H. FRITH administrator with the will annexed of John WILLIAMS dec'd filed his petition for release to me was given to the said Joseph H. FRITH with the first day of the present term of the court to give a new bond according to the statute in such cases made and provided and the said Joseph H. FRITH having failed to give new bond with good security on counter such it is therefore ordered that the letters of administration heretofore on the 16th day of Jun 1845 granted to the said Joseph H. FRITH on the estate of John WiLLIAMS dec'd be and the same are hereby revoked and set aside. 6 Apr 1846 pg. 421-422 Joseph MAY came into open court this day and made application for letters of administration de bonis non on the estate of William MAY dec'd and the court being satisfied that the interest of the estate will be promoted by granting the same it is therefore ordered that letters of administration de bonis non with the will annexed or granted to said Joseph MAY and that John H. STONE and Jacob MATTHEWS come into court enter into Bond for the faithful performance of said Joseph MAY administrator as aforesaid it is further ordered that the clerk issue a writ of appst? to David ATKINSON, Jethro ATKINSON, Alfred BRIDGES, Alexander JOHNSTON and James SANDERS requiring them to appraise the goods and chattels of said dec'd. April 1846 pg. 434 Ordered that Joseph MAY administrator of William MAY and made public for the space of six weeks notifying all interested in said estate to present their claims in due time or they will be forever baned??? 2 Jun 1846 pg. 442 Ordered that Joseph L. HUNTER guardian of the minors of William BENNETT dec'd be allowed till the next term of this court to make his annual return. 3 Nov 1846 pg. 475-476 Joseph L. HUNTER came into court and made application for letters of administration on the estate of Jehu STEWART dec'd and Willis HUNTER having entered into Bond for the faithful performance of the said Joseph L. HUNTER It is therefore ordered that the said Joseph L. HUNTER be and he is hereby appointed administrator with the will annexed of the said Jehu STEWART dec'd and that the clerk issue letters as aforesaid. Ordered that Joseph L. HUTER be and he is hereby appointed guardian of Thomas B. STEWART , minor heir of Jehu STEWART dec'd and that he enter into Bond for one thousand dollars with Willis HUNTER as his security. It is therefore ordered that the clerk issue letters of guardianship to said HUNTER. That a warrant of appraisement issue to Joseph MAY, Jethro ATKINSON, and William DUROH to appraise the estate of Jehu STEWART dec'd. To the Judge of Probate of Noxubee County and State of Mississippi. Being one of the distributees in and to the estate of the late Jehu STEWART dec'd I consent that an order may be granted for the sale of the negroes of said decedent and waive notice thereof <signed> A.J. STUART John E.W. CARNEL Manuel L. STUART Joseph L. HUNTER, guardian of Thomas B. STUART On the application of Joseph L HUNTER administrator the will annexed of Jehu STUART dec'd praying for an order of court to sell the personal property of said dec'd and the court being satisfied that the same would be to the interest of the distributees having come into court and by writing gave their consent thereto it is therefore ordered that the same administrator have leave to sell the property aforesaid on a ??--?? of 12 months he taking bond with good and approved security for the same and give the legal notice thereof and report his proceedings for the approval of this court. Ordered that Joseph L. HUTER administrator with the will annexed of Jehu STEWART dec'd have leave to ship to Mobile or elsewhere on flat ??--?? or steamboat the crop of cotton of said dec'd and sell the same to the best advantage either at private or public sale. pg. 477 William H. ATKINSON came into court and made application for letters of administration on the estate of Henry ATKINSON dec'd and Spencer May ATKINSON and Gray H. ATKINSON having entered into Bond for the faithful performance of the said William H. ATKINSON. It is therefore ordered that the said William H. ATKINSON be and he is hereby appointed administrator of the said Henry ATKINSON dec'd and that the clerk issue letters as aforesaid. That a warrant of appraisement issue to Jethro ATKINSON , Alfred BRIDGES, and Latin? SANDERS to appraise the esate of Henry ATKINSON dec'd. Ordered that William H. aTKINSON , administrator of Henry ATKINSON dec'd have leave to sell the personal property (with the exception of the negroes) of the estate of said dec'd on a credit of 12 months his doing so in persuance of the statute in such cases made and provided. 16 Nov 1846 pg. 479 In the matter of the last will and testament of Abel John TAYLOR dec'd. We, Joseph MAY and Jethro ATKINSON named and appointed with said Jethro ATKINSON in said last will and testament for the execution thereof hereby renounce the office and trust thereby confered to us and all right to probate, letters of testamentary of said will and pray record of our renounciation in this behalf <signed> Joseph MAY Jethro ATKINSON pg. 480 Jethro ATKINSON and Mary Ann TAYLOR came into court and made application for letters of administration with the will annexed on the estate of Abel John TAYLOR , dec'd and David ATKINSON and Alfred BRIDGES having entered into Bond for the faithful performance of the said Jethro offered?? Mary Ann TAYLOR in the sum of ten thousand dollars. It is therefore ordered that the said Jethro ATKINSON and Mary Ann TAYLOR be and they are hereby appointed administrator with the will annexed of the said Abel John TAYLOR dec'd and that the clerk issue letters as aforesaid and the said administrators were only qualified. Ordered tha a warrent of appraisement issue to Joseph MAY, David ATKINSON, and James MATTHEWS to appraise the estate of Abel John TAYLOR, dec'd. 7 Dec 1846 pg. 484 Ordered that Jethro ATKINSON administrator of Abel J. TAYLOR dec'd be authorized to ship to Mobile or elsewhere by flat - Barge or steam boat the crop of cotton of said dec'd and sell the same to the best advantage. Ordered that the inventory and appraisals of the estate of William MAY dec'd be and the same is hereby received and ordered to be recorded. Ordered that the inventor and appraisals of the estate of Henry ATKINSON dec'd be and the same is hereby received and ordered to be recorded. pg. 485 That the last will and testament of Abel J. TAYLOR dec'd be and the same is received and ordered to be recorded. pg. 491 Ordered that the inventory and appraisement of the estate of Jehu STUART be and the same is hereby rec'd and ordered to be recorded. 4 Jan 1847 pg. 497 Ordered tha the sale bill of Joseph L. HUNTER administrator of Jehu STUART dec'd be and the same is hereby ordered to be recorded. pg. 504 Ordered that the return of R.B. BRIDGES administrator of the estate of Obedience BARNES dec'd be and the same is hereby received and ordered to be recorded. pg. 505 In the matter of the sale of the real estate of John W. BARNES dec'd on reading and filing the petition of Roddric B. BRIDGES administrator of the goods and chattels of John W. BARNES dec'd to the exhibits thereto annexed and also one of the heirs and distributees in right of his wife and this day prayed for a sale of the real estate of said dec'd the said R.B. BRIDGES among other things representing that the personal estate of said decedent is insufficient to pay the debts outstanding against said estate and it being represented to the court therein that Jane, Mary, Richard, and John BRIDGES the children of the petitioner and the heirs at law of said John W. BARNES dec'd in right of their dec'd mother Martha BRIDGES, formerly Martha BARNES, legatees of the said John W. BARNES, decd. Joseph and William ROBBINS, children of Jordon ROBBINS, heirs of said decedent in right of their dec'd mother Eliza ROBBINS wife of Jordon ROBBINS formerly Eliza BARNES are minors and thereby incapable of personally representing their interest in this application. It is therefore ordered by the court that Charles G. BARNES be appointed guardian ad Littim of said Jane, Mary, Richard, and John BRIDGES and William ROBBINS to take care of and protect their interest in this proceeding and it is futher ordered that htey as well as the said Wilie D. ROBBINS and his wife Elizabeth, John B. ROBBINS and his wife Nancy and Mary Ann BARNES and Jordon ROBBINS guardian of his minor children and all other persons interested in said land of said John W. BARNES dec'd be and to be and appear before this court on the first Monday of Mar next AD 1847 them and there to answer said petition and that the same be permitted 30 days in the Independent and that the same ??--?? forth san??--?? and show cause if any they can why an order and decree shall not be made to sell the land in said petition named for the purpose of paying the debts of the said dec'd and that said petitioner as to all other matters do stand continued until the next March Term of this court. pg. 511 Ordered that William H. ATKINSON, administrator of the estate of Henry ATKINSON dec'd be and he is hereby authorized to ship and sell the crop of cotton belonging to said decedent Feb 1847 pg. 517 Joseph MAY came into court and made application for letters of administration on the estate of alexander JOHNSON dec'd and securities ahving entered into Bodn in the sum of 20,000 dollars for the faithful performance of such trust and said MAY being duly qualified . It is therefore ordered that letters of administration be granted to said Joseph MAY on the estate of Alexander JOHNSON dec'd and that the clerk issue letters as aforesaid. Ordered that a warrant of appraisement issue to David ATKINSON, Jethro ATKINSON ,C.C. McERWIN, Jacob MATTHEWS, and Thomas JARNAGIN to appraise the goods and chattels of Alexander JOHNSTON dec'd. 1 Mar 1847 pg. 422 Petition of John B. ROBBINS of said county shows that at the October term of 1847 of this Honorable court, letters of administration of the goods, chattels, rights and credits of John W. BARNES dec'd were granted to Reddick B. BRIDGES of said county on his entering into bond for the sum of $6000.00 on conditioned according to law with your petitioner and Wiley D. ROBBINS as his securities and that your petitioner then became one of the securities of said Reddick B. BRIDGES on said bond which will uflly appear to your honor by reference thereto on file and of record in this court. That your Petitioner now concerns himself in danger of suffering by reason of being said security wherefore your petitioner prays your honor to cause the said administrator to be summoned to be and approve before this court to order him to give good ??--?? security or to execute a new bond with good security in the form and penalty prescribed by the statute in this behalf and your petittioner do in duly bound will ever pray. <signed> J.B. ROBBINS On reading and filing the petittion of J.B. ROBBINS one of the securities of Redderick B. BRIDGES administrator of John W. BARNES dec'd and after due consideration of the same, it is therefore ordered that a citation issue to the Sheriff of Noxubee County him to be and appear at a regular term thereof of theis court to be holden on the first Monday in April next to show cause why he should not enter into new bond and see as administrator of said dec'd and the said J.B. ROBBINS be released therefrom Ordered tha the appraisal of R.B. BRIDGES administrator of John W. BARNES dec'd for sale of Real estate of said deed be continued till the next regular term of this court. Ordered that an alias citation issue to the Sheriff of Noxubee County commissioning him to summons Joseph ROBBINS, William ROBBINS, Jordon ROBBINS, guardian and c John B. ROBINS and Nancy ROBINS to be and appear at the next beginning term of this court to be holden on the first Monday of April next thereto to show cause why an order should not be granted to sell the real estate of John W.
