Great to have your knowledge of justice system. I have been reading about the convict leasing system and in particular Parchman Farm, which I would assume is the place Asberry would have been held. I contacted the circuit courts and they directed me to the archives who said that their records didn't go back that far. So, now I'm going to try to find newspaper articles about it. Its interesting that i can't find a record of death for Asberry, which makes me wonder if it was a middle name... hmm. just thinking out loud :) I think that Sidney may have been married twice before marrying my grandmother. I found him on a 1930 NY census married to Lillian and living with Elizabeth Brown (who was my grandmother). I found basically the same as you for Asberry & Hager McCall. She was widowed by 1910 and living in Poplarville, Pearl River, MS. Her kids were Willie Sidney, Clara B., Ottis, Minnie, Walter & Ollie. I also saw in another 1910 Census that a Sidney McCall was living in New Orleans, LA which is close to Pearl River. In 1930 - Ollie & Mallie McCall were living in Brooklyn,Kings, New York. In 1942, Sidney McCall's WW II stated that he was also living in Brookyn, Kings,New York. It appears that they moved north to New York. As a retired law enforcement officer - the McCall - Cole case is pretty simply to explain. The original case would most likely be found in the Lauderdale circuit court records or at the Mississippi Archives. Asberry McCall appealed his conviction of manslaughter because the lower court refused to allow a witness for McCall to testify about the prosecution's witness' statement to him about Cole having a weapon which appears to be what McCall was claiming (self-defense), thus not allowing the witness to be proven a liar, invalidating his testimony about removing Cole's weapon from his body after the fight. Also, MS did not have a law that said you had to flee to avoid a confrontation. So, the case was dismissed against McCall. NOW, what we don't know is if the prosecutor tried to refile the charges and re-tried McCall. With the defense's witness though, I would cautiously guess that he was NOT recharged. I found a supreme court appeal notice (google Asberry McCall)but no other info on the original case. Census shows that The Ethridges, McCalls, Coles were neighbors. Asberry was married to Hagar (or Hega or Hager) in 1888 but a 1910 census lists her as widowed. Their children are Sidney (my grandfather b1891/2) Ottis, Mary; there is an Ollie McCall who may be a half sibling? Also I can only locate Asberry on the 1900 census. Thanks for any help! She was born Oct. 25, 1912, in Hernando, Mississippi (DeSoto County). to Charles and Omie Childers Howell, the fifth child of eight children. She moved to Youngstown, Ohio with her family after the death of her mother in the early 1920s and attended Campbell Memorial High School. She was on the high school girls' basketball team and baseball team. She worked as staff assistance at the Bethel House, a neighborhood center in Campbell, Ohio and taught youth sewing classes. She worked various other jobs, including assembling airplane parts during World War II. She joined the Gospel Temple Baptist Church at the age of 19 and held the oldest church membership. She remained an active member of the chorus and mission until her health would no longer allow her to participate. She was a former member of the NAACP, Youngstown Area Urban League, Harambee, and the Youngstown Black Independent Political Party. She enjoyed reading, traveling, and fellowship with her friends and family. Earlene leaves behind three daughters, Claudette Lee (G. Winston) of Omaha, Nebraska, Annette Stonework of White Plains, Md. and Mercedes King of Youngstown, Ohio; five grandchildren, Lisa Parker of Garner, N.C., Kenneth King of Youngstown, Mari Lee of Laurel, Md., Erika Lee of Omaha and Gerald Lee II of Hercules, California; two great-grandchildren; and a host of nieces, nephews and other relatives and friends. She was preceded in death by her parents, Charles and Omie Howell; her husband, Albert Stonework; a daughter, Mildred Ann; brothers, Franklin, Ervin and Charles "Jip" Howell; and sisters, Mary "Sis" Brown, Lular Williams, Geneva Moncrief and Lucille Dothard. Friends may view her from noon to 6 p.m. on Friday, March 25, 2011, at the L.E. Black, Phillips & Holden Funeral Home and from 9 to 10 a.m. at the church.
