Hi everyone..thought I would share this news article that Sandy put on the NORCAL list. Marge Campbell >>>>> DREADFUL AFFRAY -- 2 Men Shot, And Probably Mortally Wounded -- 'Argus' 8th inst. -- Yesterday evening an affray occurred 6 miles from the city, on the opposite side of the Calaveras river, which will doubtless end in the death of both men engaged in it -- 1 is already dead, and but little hope is entertained for the other. It appears that a man by the name of John VANCE built a house upon a piece of land on which there were no improvements but was claimed by another named Gabriel HOHNSHELL. After the erection of the house by VANCE, HOHNSHELL declared that the land was his, as he had first lain claim to it; that he would not look to the law, but would drive VANCE off himself. He went over to VANCE's house accompanied by 3 men, when words ensued which soon terminated in a fight. VANCE had 1 friend with him. Of the 4 present with these 2 principals, there was a division of opinion in regard to allowing the parties to fight, and in their quarrel HOHNSHELL and VANCE were allowed to come together. HOHNSELL fired, making a slight flesh wound in VANCE's shoulder. VANCE returned the fire, hitting his opponent in the breast, which has since proved fatal. HOHNSHELL again fired, hitting VANCE in the abdomen, the ball passing obliquely but reaching the cavity, which will doubtless cause his death. HOHNSHELL fired in all some 5 or 6 shots, while VANCE fired but 3 times, and afterwards beat his opponent over the head with a pistol. Dr. RYER was sent for to attend VANCE, and Dr. COWAN to attend HOHNSHELL, by the friends of the parties. Such scenes are most shocking in their nature, and we hope this will be the last to be recorded in this county. >We learn that Mr. John VANCE, who was engaged in the affray with Mr. G. HOHNSHELL died of his wounds yesterday morning. A few moments before he expired he felt quite well, raised himself and requested something to eat. It is supposed that suppuration taking place effected an artery, causing death in a few moments. Coroner SKINNER held an inquest on the body, yesterday evening, when the Jury returned the following the following verdict: We, the Jury, find that the deceased was John M. VANCE, aged 23 years, a native of the State of Missouri, and believed that he came to his death by a pistol ball, fired from a revolver in the hands of Abraham HOHENSCHELL [spelled 2 ways], aided and abetted by Theodore LEE with criminal intent, on Wednesday, Jan. 6th, A.D. 1858. M. BOND, Foreman Officer CHILDS arrested Theodore LEE on the charge contained in the above verdict, and brought him to the city. Mr. LEE was immediately bailed from custody by Messrs. Thos. MARSHALL and H.O. MATTHEWS. - -------------------------------------------------- Transcribed by Dee Sardoch To see more old newspapers, visit http://www.newspaperabstracts.com/index.php -- No virus found in this outgoing message.
