I am sending this out to as many people in my email address book that I can so someone does not make the same costly mistake we have. If it saves one person the problems we have gone through then it is worth it. Today our lawsuit ended and an evil man got a right of way through our property. They call it right of way by prescription or squatter's rights. I say it is a right of way by deception. Every low life liar that could be dug up was brought in to lie and bear false witness against us. My husband teaches Sunday School and this was brought out in court and they ripped him to pieces. The opposing attorney, in his closing arguments, said his uncle always would tell him to watch out for them fellers that put religion out in front of you because they will always be the first ones to screw you. This lawyer's wife is the head of the United Methodist Women in this state and they are both members of a Methodist Church in this town. This evil man has beaten a donkey on the road in front of his neighbors and when the donkey wouldn't move he dragged it to death behind his truck, with neighbors and small children watching. He dragged a dead calf behind his truck up and down the road. I have heard stories of him holding a gun on children. He tried to run my husband down with a truck when he was walking on the road. He threw a 15 inch crescent wrench at us. Most everyone on this 4 mile road hates him. We were not allowed to bring any of this out in court because they said it had nothing to do with a right of way. His attorneys could invent things that we did but we could not tell the truth about him. It was like when the jury could not hear all the evidence in the OJ trial. It was very unfair. Let me give you all a word of advice. Never buy a piece of property without having the seller give you a written statement guaranteeing that there are no right of ways on the land and be sure to have it notarized. The person we bought the land from was someone my husband had known for 40 years so trust no one. Yes, we had a title search done but these right of ways are NOT covered in a simple title search. Also, never let anyone cross your property for any uninterrupted amount of time for hunting or accessing another piece of land or for any other reason. After a certain amount of time, they have an established right of way and you can do nothing about it and your property is devalued. You will have to check your state laws to find out how long because I believe it differs in various states. Phyllis
