Marriage Book B, pp. 119-121 DURLEY - STEGER This indenture made and entered into this twenty sixth day of November A.D. Eighteen hundred and fifty Six, between Samuel Durly of the county of Pettis and State of Missouri of the one part and Mary V. Steger, of the county of Johnson and State of Missouri of the other part. Witnesseth: I, the said Samuel Durley doth hereby agree to marry the said Mary V. Steger, upon this condition, to wit: that the said Mary V. Steger is to hold all the property both real and personal that she now owns, the same to be forever hers and clear from the claim of myself or of all and every person claiming by and through me in any manner, whatever, And I the said Mary V. Steger agree to Marry the said Samuel Durley in accordance with the foregoing stipulations & in addition thereto, hereby agree that the said Samuel Durley shall have and hold all the property he has or may own both personal & real and whereever situated free and clear from any claims or right I May have by reason of, said i! ntended Marriage or that any person or persons May have claiming by through or under me. Whatever, except that in the event that said Samuel Durley should die leaving me a widow then in that case I am to have and to hold during the term of my natural life the Mansion house in which the said Samuel Durley now resides, in said County of Pettis, together with farming lands and timber to support said farming lands not to exceed together, One hundred & twenty acres and said lands to be adjacent to said Mansion house, the same to him full satisfaction of any claim I May have as dower both in real and personal estate of the said Samuel Durley in the event of his death before my own. This is understood and is a mutual agreement between us from the fact that both of us have children of our own each by a former Marriage and Should either of us after our said Marriage wish to bestow our own property on our own children that we shall have the full right to do so without interfearing ! with the rights of the other. In witness that this contract is Mutual ly agreed between us to be entered into we have hereunto set our own hands, and seals this day and year first herein written. Samuel Durley (seal) Mary V. Steger (seal) State of Missouri, County of Johnson. Be it remembered that Samuel Durly and Mary V. Steger, who are both personally known to the undersigned clerk of the county court, within and for said county to be the persons whose names are subscribed to the foregoing Marriage contract as parties thereto, this day appeared before me in Said county of Johnson and each of them acknowledged that they executed and delivered the same as their voluntary act and deed for the purposes therein contained. In testimony whereof I have hereunto set my hand and affix the (seal) Seal of said court, at office in Warrensburg, this 26th day of November, A.D. 1856. James McCown, clerk State of Missouri, Johnson County I, the undersigned clerk of the circuit court and Exofficio Recorder00 of Said County certify that this contract, hereto attached, was filed for Record in my office on the 26th day of November A.D. 1856 and the same was by me duly recorded on the 3rd day of December 1856 in Book O, Page 260.
