He got into some difficulty when the Marshal attempted to arrest him. He resisted and shot the Marshal, when that officer turned and shot Ware five times, killing him instantly. The Marshal, however, was mortally wounded, and died in a few minutes afterward. We could not learn the name of the town.

There was a Michael Sullivan - 1 yr old - buried in Block A, lot 33 in 1875. There is no other information given for him in way of date. The lot had been purchased by a Dan Sullivan for $16 4 DEC 1875 (probably date he made final payment). no other Sullivans are buried in this plot. Other persons buried in this lot are a Mrs Mahoney (no other information given); Thomas Lavin Mahoney (no other information given) and an Infant of Thomas Lavin (doesn't say Mahoney, but may be) buried in 1904.

Funeral will take place Tuesday afternoon, at 3 o'clock from the Episcopal Church. Alice was a bright and beautiful little girl, of sweet disposition. She was a member of the Calvary Church Sabbath School and noted for her prompt and regular attendance. That fell and fatal disease, cerebra spinal meningitis, had marked her for its first victim, in our midst this year, and she fell a beautiful sacrifice, upon the altar of death. When earth was brightest, when spring with its flowers and bright skies came to us, she departed to that glorious immortality whose flowers are perennial, and whose brilliant firmament is never darkened by a single cloud. Pure and stainless, she has joined that angelic throng without the taint of that impurity which tarnishes the years of maturity, and is now in the Bosom of Him who said "Suffer little children to come unto Me.' The afflicted parents have the warmest sympathy of the community in this, their irreparable loss, but heaven's gain.

Surnames: Stephens Saylor Classification: Obituary Message Board URL: http://boards.ancestry.com/mbexec/msg/rw/FMB.2ACE/2290.2 Message Board Post: Sedalia Daily Democrat, Saturday, April 25, 1874, p. 1 That Texas Shooting The Killing of Tom Stephens We stated, this week, that there was a rumor to the effect that Thomas Stephens, who resides on Flat Creek, near this city, was shot and killed by two young men named Saylor, with whom he was traveling in Texas. This morning we obtained from Jacob Saylor, an old and well known resident of this county, who formerly lived near this city, but now resides in Windsor, the particulars of a letter received from his sons, detailing the facts of the unfortunate affair. In the latter part of January last, two sons of Mr. Saylor - Wilford and Ad left Windsor, in company with a young man named Thomas Stephens (or Stevens) for Texas, by wagon. Stephens, who resides on Flat Creek, near this city, not having the necessary funds, gave the Saylor boys his horse for payment of his way with them. The letter received by Mr. Saylor is written by his eldest son Wilford, and dated Maynardsville, Texas, April 8. He stated that the party got through all right, with the exception of a shooting affray which occurred previous to their arrival, in which Stephens was shot and died from his wounds. The circumstances attending the event, as related in the letter, are as follows: Stephens was riding in a stranger's wagon, just in front of the wagon in which the Saylor boys were riding. Ad, the youngest, was driving; Stephens' horse balked, or lagged, when Ad used the whip on him to make him keep up. Stephens heard or saw the whipping and tried to borrow a double barrel shotgun of the stranger he was riding with, to "go back to the Saylor boys." The man refused to let him have the gun. Stephens then got out of the wagon with his six shooter, and told Ad to "quit whipping that horse." Ad Saylor, told Stephens if he didn't want the horse whipped, to get in and drive him himself. Whereupon Stephens told him that he would and drew his revolver on Ad. Wilford Saylor then drew his revolver, and told Stephens three times to put up his pistol. The third time he was asked Tom replied: "I'll be d_____d if I do" and turned his pistol to Wilford and shot at him twice and mi! ssed him, then turned on Ad. Wilford's pistol missed fire twice, after which he shot at Stephens twice, the last shot wounding him. In the melee, Wilford shot twice, Ad twice, and Stephens six times. Stephens died in a few hours after receiving his wound. The boys say the shooting was in self defense, and that Mr. Saylor (the father) need not give himself any uneasiness about them, as the act was justifiable, and that nobody would molest them.
