Lett & Sarah Dagley) On March 28, 1910, John Lett put his mark to his Will written by Notary Public, C.F. Startzman. John Lett was a patient in the NATIONAL HOME FOR DISABLED VOLUNTEER SOLDIERS., Los Angeles County, Cal. It was witnessed in the presence of Anne Eliza Palmer and W.E. Richard Schottstaedt. At the time of signing the will "the testator was of sound mind and comprehended fully his acts in making said will." John Lett bequeathed all his property in Ashland, Oregon to G.B. Nichols, Anna Nichols, William Newland, and Sarah Newland all residing at Ashland, Oregon to share and share alike. John Lett died on or about two days later in the Soldiers Home, Los Angeles Co., CA. The following is an extraction of the PETITION TO PROBATE: "AT THE TIME OF HIS DECEASE HE WAS A RESIDENT OF THE CITY OF Ashland, Oregon and was the owner of property situated in said city, consisting of a house and three lots, to-wit: Lots 2,3, and 4 in Boulevard Park Addition to Ashland, Oregon containing a dwelling-house thereon and of the probable value of $1300.00, and no other real property, but household goods of the probable value of $100.00, total valuation probably $1400.00 The said will was not executed according to the laws of the State of Oregon and therefore inadequate to pass title to real estate in Oregon. An Amended Petition was filed by G.B. Nichols and William W. Newlon for the appointment of an Administrator. It was ascertained that John Lett, left surviving him, a wife and several children and as none of them were mentioned in the will, the will would be of no effect for any purpose, under the laws of the State of Oregon. The Petitioners waived any claim to the estate of said John Lett. That the Petitioners are informed and herein set forth on information and belief, left as heirs and his only heirs, the following named persons, all of whom are over 21 years of age, to-wit: Julia Lett, his widow, who resides at Marrysville, Missouri Sidney Lett, William Lett, Wesley Lett and Lewis B. Lett, all of whom reside at Marrysville, Missouri. There are no heirs or next of kin, residing within the State of Oregon. That these Petitioners, are the creditors and the only creditors of the deceased residing within the State of Oregon, to the best of their knowledge and belief: that as a matter of fact, it was intended by the deceased, that these petitioners and their wives, should have all the property of the deceased, in this county, in payment of such indebtedness, but owing to he objection herein before set forth, in regard to the said will it becomes necessary, to probate the said estate as if no will had ever been made, and for these petitioners to rely, on the presentation of their respective claims and the allowance of the same by the court.. L.L. Mulit was appointed Administrator & the petition was signed & sworn to by G.B. Nichols and William W. Newlon on 21st day October 1910 Appraisers of the estate were appointed by the Jackson County, Oregon Court, and an "Inventory of the Real and Personal Property" was made in handwriting. A list follows: One steel and iron gauge --- stove pipe & stove fixtures -with hot and cold water attachments, evidently intended as a part of the building or dwelling on Lot 3, blk B but for convenience wish appraised separately but will probably be sold with lot 3/ value $10. Lot 2 in said Block "B" in same condition- Lot 3 in said block "B" Occupied by a one story four room dwelling. $250 Also fruit trees in -----? range attached. $1500.00 Curtains& carpets -----? linoleum in kitchen stove -----? Go together for dwelling & garden- Real property !500.00 1 - Kitchen cabinet 5.00 1 - Six foot extension table 3.00 1 - 2 piece bed-room suit, dresser & bedstead 10.00 1 - 3 piece bed-room suit, Bed, dresser & commode 1 - Lounge 7.50 1 - Heating stove & pipe 8.00 4 - Chairs common 3 - Rocking chairs 2 - High chairs all total 9.00 Personal Property $57.50 & Real Property $1500 totaled $1557.50 Each of the three Appraisers received $2.00 totaling $6.00 Claims against the estate were presented and paid to Dr. J.K. Reeder, $41.50 for medical attendance during last illness & George B. Nickolls and William M. Newland $750 for nursing and attendance during the last sickness.. The children of the deceased and Julia Lett, the widow, proceeded to try and adjust matters pertaining to the said estate without passing through full and formal administration, and without a sale of the property through the Administrator. To carry out their intention the said children, Sydney Lett, William Lett, Wesley Lett and Lewis Lett and their respective wives, did on the 6th day of January, 1911, convey all their and each of their right, title and interest in and to the property of the said estate to James J.McNair of Ashland, Oregon, which Deed is of record in Volume 85 on pages 537 and 538 of the Deed of records of Jackson County, Oregon. On 7th day of December, 1911 Julia Lett made and executed to James McNair a Deed for all her dower interests in the property of the deceased, which Deed is of record in Volume 93 on page 173 of the Deed of records of Jackson County, Oregon. The said James McNair in pursuance of an agreement between him and the heirs of the said estate settled with the claimants presenting claims as aforesaid, and each of said claims has been withdrawn.. All of the expenses of the administration were paid and settled for in full, including the expense of publishing the first notice and also the final notice. On 23rd day of February, 1912, the Court concluded that the heirs and only heirs of the estate were the four children of John Lett, namely: Sydney Lett, William Lett, Wesley Lett and Lewis Lett, all sons of the deceased and all above the age of twentyone years; also Julia Lett, widow of the deceased, being the stepmother of the said children, who would be the heirs and only heirs and claimants to the estate of the said John Lett. Judge J.R. Neil approved the administrator's report, discharged him, exonerated the bondsmen closed the estate & signed his name on the Court record..
