Just to remind everyone -- Charlotte's "Pearls" are now archived permanently at http://www.rootsweb.com/~ote/usa_genealogy/mo_newspaper.htm -------------------------------- Jefferson Democrat Hillsboro, Jefferson County, Missouri Part II WEDNESDAY, NOVEMBER 19, 1884 MININGTOWN BURNED - Silver Plume, a mining camp, located near Georgetown, Col., was entirely consumed by fire. Silver Plume had about 700 inhabitants. Forty buildings were burned, and a number were destroyed in the effort of the populace to stop the spread of the fire. The town was located on either side of a narrow gulch, and the only buildings now standing are a few cabins which stood off the main street. The hotels, Post Office, the COLORADOAN office and all public buildings were burned. The town was set on fire by an unknown incendiary. Twice before an attempt was made to fire the place. The fire originated in Samuel DERMOTT's saloon and spread rapidly. Patrick BENNATT, an old citizen, was burned to death. He was intoxicated and perished in his house. The town is literally swept from the face of the earth. Six hundred people are homeless and a number of them are destitute. The loss is about $150,000. The insurance is not one-third of the loss. ORDER OF PUBLICATION - STATE OF MISSOURI - County of Jefferson - In the Circuit court of Jefferson County, in the State of Missouri, to January term, 1885 - in vacation, November 3rd, 1884. Enoch McCUNE, plaintiff, versus Sylvester H. LADIN, Melvin L. GRAY, executor of Hiram A. PROUT, deceased, Elizabeth B. PROUT, Hiram A. PROUT and George W. PROUT, defendants. At this day comes the plaintiff hereinby his attorneys, W.H.H. THOMAS and Samuel N. HOLLIDAY, and files his petition and affidavit, alleging among other things that defendants, Elizabeth B. PROUT, Hiram A. PROUT and George W. PROUT, are nonresidents of the State of Missouri. Whereupon it is ordered by the clerk that said defendants be notified by publication that said plaintiff has commenced a suit against them and their co-defendants in this court, the object and general nature of which is to obtain a decree of said court making partition and division among said parties of the following described real estate, situate in Jefferson County, State of Missouri, to-wit: A certain tract of land containing seventy-six acres, more or less, bounded as follows, to-wit- beginning at the southwest corner of United States survey No. 3018, in township forty-one, range five east of 5th principal meridian; thence north with the west line of said survey to the southwest corner of James CURTIS' lands and 7.18 chains from the northwest corner of said Survey; thence east to the north corner of Gottleib D. NIEHAUS' lands; thence south parallel with west line of survey to the south line of said survey; thence west to beginning. that Sylvester H. LAFIN is the owner of one undivided fourth of said land; that plaintiff owns three-eighths of said real estate; that Hiram A. PROUT, at the time of his death, owned the other three-eigths of said land, that Hiram A. PROUT died in the county of St. Louis in 1862 leaving him surviving Elizabeth B. PROUT, his widow, two sons, Hiram A. PROUT and George W. PROUT, and one daughter, Mary K. PROUT, that afterwards, while yet a minor, said Mary K. PROUT departed this life; that said Hiram A. PROUT left a will and testament, which was duly probated in the county, Now City of St. Louis, in the year 1862, and Melvin L. GRAY was duly qualified as sole acting executor; that said executor, in and by said will of said PROUT, was authorized, empowered and required to sell all the real estate of said deceased; that the said estate of Hiram A. PROUT is still unsettled; that the said estate is insolvent; that the proceeds of the lands herein described as belonging to said estate, will be required by said executor to pay the debts of said estate that have been duly allowed against said estate; that Elizabeth B. PROUT renounced under the will of her husband and refused to take under said will; that said widow is entitled to dower in the undivided three-eigths of said premises belonging to said Hiram A. PROUT at the time of his death. Plaintiff prays that said premises may be divided among said parties according to their respective interests, and, if the same cannot be done without great prejudice to the interests of the owners thereof, then that the same may be sold and the proceeds distributed to the parties in interest, in proportion to their respective interests as aforesaid. And that unless the Elizabeth B. PROUT, Hiram A. PROUT and George W. PROUT, be and appear at this court, at the courthouse thereof, to be begun and holden at the courthouse in the town of Hillsboro, in said county, on the second Monday of January next, and on or before the sixth day of said term, if the term shall so long be continued - and if not, then on or before the last day of said term - answer or plead to the petition in said cause, the same will be taken as confessed and judgment will be rendered accordingly. And it is further ordered that a copy hereof be published according to law, in the Jefferson Democrat, a newspaper printed and published in Jefferson County, State of Missouri. C. Though. Thomas BYRNS, father of the bride.
