Will of Jeremiah Butt, February 9, 1840 Clark County Missouri In the name of God, Amen, I Jeremiah Butt of the County of Clark in the State of Missouri do make, constitute and ordain this my last will and testament, hereby revoking all former ones. First of all, I will bequeath unto my loving wife Nancy Butt all the property such as lands and Negros and all personal property until such times as the youngest child comes of age, for her use and benefit in raising and schooling the children and then the remainder to be equally divided between the children leaving of my wife Nancy Butt one third part her natural lifetime, and be it understood that if in case my wife should marry before the youngest child becomes of age the property then shall be equally divided as above named leaving a sufficiency for the maintenance and schooling of the youngest children and be it understood that my wife’s part shall be divided equally with the children at her death. I hereby constitute and appoint Nancy Butt and Edmond H. Butt Executors of this, my last will and testament, hereby revoking all former will and testaments hereby revoking all former will or wills, that this alone shall stand good. In testament whereof I have set my hand and seal this 9th day of February 1840. D. 1840 the forgoing writing purporting to be the last will and testament of Jeremiah Butt, deceased was produced to me for probate whereupon Joseph Carman (the balance of this paragraph is missing). State of Missouri County of Clark The State of Missouri to all persons to whom these presents shall come, greetings - Know ye, that I, Willis Curd, Clerk of the County Court within and for the County aforesaid in vacation of said Court and by authority vested in me by law do hereby appoint Joseph Carman Administrator DeVoir Non of the Estate of Jeremiah Butt, deceased with a copy of the will annexed. Therefore the said Joseph Carman as such Administrator DeVoir Non is authorized to collect and secure all and singular the goods and chattels, rights and credits, which were of the said Jeremiah Butt, deceased, at the time of his death in whosoever hand or possession the same may be found and to perform and fulfill all such duties as may be adjoined upon him by said Will so far as these shall be property and the law change him and in general to do and perform all other acts which now are, or hereafter may be required of him by law.
