There are two kinds of Guardianship for Minors...Guardian of the Person; and Guardian of the Estate: Sometimes they are made in the same Probate Order... The surviving Blood Parent does not need to obtain Guardianship of the person of their minor child; however; the Estate is a different matter...sometimes the deceased parent has no Estate to convey, or the property is community, or there was a Will...In these cases, Guardianship of the Estate of Minors should not be necessary... If there is a substantial Estate and one parent dies in testate (without a Will) the Probate Court may require the surviving Parent to obtain Guardianship of the Minor's Estate, and post bond, which requires that an annual accounting be made... Without this Order, Real property cannot be disposed of, or funds dispersed.
