He married Margery Mills, a Quakeress, and resided near the village of Yocumtown. Mills Hays was their third child, and was born in 1786. On August 13, 1817, he was appointed one of the three justice of the peace for the third district, composed of Newberry and Fairview Townships under the constitution of 1790, and served in that capacity continuously until the fall of 1839. Under the amendments to the constitution in 1851, he was elected associate judge of York County, serving one full term of five years.
