    3. Tammy, Jacquie, Bruce, et.al. - I have just received a response from the NAS about the court documents for Duncan McLearter (aka McCarter) & the costs. I'm pretty sure this is not my Duncan M'Carter from Whittingehame. Here is what they said: "Although I have not been able to conduct an in-depth search of the Precognition for the information you have asked for, I have had a cursory glance through some of the papers, but have been unable to find any reference to McLearter having a wife or children. It appears that Duncan McLearter was born in Glasgow and during his time as a seaman sustained a fairly serious injury: so much so, that in his declaration it is stated that he spent quite some time in the Infirmary. Although the exact nature of his injury is not noted, he seemingly had weak eyes and could not stand heavy work. It was after this that McLearter left Glasgow for Ayr where he worked as a labourer." I also received from a correspondent in Australia, the following: ".... there was a McCarter, Duncan alias McArthur who arrived on the Albion in 1827 to Port Jackson (Sydney). He died at Liverpool (NSW) hospital on 28 December 1838. Age given on arrival was 50 and age noted on death was 62. He was given a Life sentence for robbing a trunk. The Indent for the Albion states that he was a Protestant and married. It also states "wife only" which suggests that perhaps he had no children. He gave his native place as Glasgow and his occupation was Farmers Labourer." This would be the Accused Duncan McCarter, alias McArthur, travelling hawker, Address: Ayrshire and John Wright, travelling hawker, Address: Ayrshire, 1820. I think because of the Ayrshire address that this is not my Duncan M'Carter, either. Had my Duncan been alive and traveling in 1820, the 1818 Kirk Session records of Whittingehame would not have called his wife, the widow M'Carter. Again, thank you for your time and interest. I would not have thought to check the convict lists without you.
