    1. [MIDLOTHIAN] EMERY and NETHERY FAMILIES
    2. sandra stanley
    3. Hi Everyone I am trying to trace the EMERY & NETHERY Families, who might have originally lived at either NIDDRY, or NITHSDALE, in Midlothian, prior to their migration to Co Tyrone, in NIR, which was allocated to Scots during the Ulster Plantation. Its seems that Niddry, the Wauchope Estate, is the most likely because later documents often held NIDDRY as the surname of the NETHERYS ie originally a locative byname probably of tenant farmers. The EMERY byname/surname could have been a variant of Amery, Demery, Imrey, Memry, Lemery, Ymrey, or other similar sounding names. I have no idea where the EMERY Family lived but, because of their close connection with the NETHERYS, can only presume they also lived at NIDDRY or, if not, perhaps NITHSDALE. Apparently, the EMERY and NETHERY Families were not Border Reivers but, as they settled amongst BRs at Drumquin, Longfield East, Co Tyrone, NIR, they must have had some connection with the BRs back in Scotland. They also married BRs, who included the Irvines, Johnstons, Armstrongs, Greys, Wilsons, Chitticks, Maxwells, Grahams, etc, in both NIR and again in Australia, to where hundreds of descendants of all those Families emigrated in the early 1800's. Does anyone have any idea of where my EMERYS and NETHERYS might have lived, if and why they were exiled with the BRs, or anything about them at all? SANDRA from AUSTRALIA

    2. M&M
    3. Has anyone any knowledge about finding further information regarding a man in the Prison of Edinburgh for debt. The time was July 1851 in Edinburgh. He applied for Cessio Bonorum, - to see whether his creditors would accept payment in another form. Would there be any records of this meeting with creditors, which was to be in the Sherriff-Clerks Office, County Buildings, Lawnmarket. Would there be any prison records? Any ideas on where I might look? The notice in the Gazette was signed by an S L Agent. Does any one know what that is?? Hoping someone might have some legal knowledge. Many thanks, Margaret

    1. Re: [MIDLOTHIAN] HELP NEEDED In prison for debt?
    2. Hello Margaret One of my ancestors was imprisoned for debt at the Old Tolbooth Prison in the 1770s - he was described as a "Gentleman" prisoner. I found a record of his imprisonment at - West Register House, Charlotte Square, Edinburgh - telephone - 0131 535 1314. The Precognition outlined his statement, detailing how he found himself in such circumstances, it also included was a list of creditors, their business, and money owed to them. It made fascinating reading, and gave an insight into the justice system during that period. Hope this helps, Patricia.

    3. Thank you Margaret, That does help - it clarifies things nicely and explains why the name didn't fit with what I envisaged a place called "Wightman's Lands" might be. I've since come across another dwelling called Marshall's Lands, also in Edinburgh, which I suppose was the same sort of dwelling. See, there's nothing like local knowledge! Thanks again, Loretta Melbourne, Aus.

Good morning Loretta, Apologies for coming into the "conversation" late just read your query. Have just finished checking the same question for a friend whose family lived in ""Wightman's Land" in 1890's. This was my answer "WILLIAM WIGHTMAN Burgess of the City of Edinburgh. Master Wright . Wightman, or his family, owned a tenement block in DUKE STREET , Leith , in the 19th C. Was known locally as "Wightman's Land" At this stage cannot identify which No. Will be in NAS later this week and will check the Sasines for the details In earlier times "Lands" did not only refer to fields , but also to tenement blocks built with several storeys of "flats" These would usually be rented out with very often families living in only one or two rooms. The owner's name was often given to the buildings as in "Wightman's" land. Duke Street was named in 1818 after Charles , Earl of Dalkeith. the 4th Duke of Buccleuch." Trust this is of some help and interest. Regards John John D. Stevenson Edinburgh Scotland

    3. Righto, next question! Robert TAIT and Elizabeth SHIELLS's son George was born 1839 when they were living at Leith: "Births and Baptisms May 1839 Tait May 2 Robert Tait, Foreman, Wightman's Land, Duke Street, Leith, and Elizabeth Shiells his spouse, had a lawful son named George born 21st April 1839 & Baptized 5th May 1839 by the Rev James Grant of South Leith. 1st ch." Would this mean that he was a Foreman who lived where his work was at Wightman's Land, or that he was a Foreman in his work elsewhere but lived at Wightman's Land? I can't find very much about Wightman's Land - does anyone know what sort of place it was? I checked the 1841 census for the address and it seems pretty substantial. There are two or three pages of occupants, all with varying occupations. Was it a farm or something? The name seems to indicate a property of some kind, but it sounds odd to have an address in a street if it was a farm. It's hard to tell whether it was somewhere that a lot of people lived (while working elsewhere), or whether it was a place where a lot of people lived *because* they worked there. Thank you, Loretta Melbourne, Aus.

    3. Many thanks to everyone who replied to my message - thanks to your suggestions and hints I think I have a pretty good handle on old Robert after viewing images for his children's births and following up censuses. I reckon he was the son of George TAIT and Jane HUNTER, born 1815 in Prestonkirk, East Lothian. His brother James (born 1813) was a witness at the baptism of Robert's daughter Mary at Prestonkirk in April 1841. Robert appears to have been in gaol in Edinburgh on census night 1841 but couldn't have been in for long because he and Elizabeth had another two daughters in 1843 and 1847. The names given to their children fit perfectly with the Scottish naming pattern if George and Jane are his parents. Elizabeth is recorded as a widow in 1851 so Robert may have died between June 1847 and March 1851. I'm going to the State Library this week to check MIs for East Lothian - maybe there's a hint there. I'll also check to see whether he might have been back in the pokey in later censuses (Elizabeth may have preferred people to think she was a widow) or maybe emigrated. So thanks again, everyone - I know a lot more about Robert than I would have thought possible this time yesterday! Cheers, Loretta Melbourne, Aus.

    2. Thomas Family
    3. Hi all, I'm trying to track down a death for Elizabeth TAIT (nee SHIELLS) and would like to find practically anything about her husband Robert TAIT, who is a major mystery. Elizabeth was born in Berwickshire c 1818 but married in Leith and lived in East Lothian for a while (1841 census and three children born Prestonkirk 1841-1847) and then in Midlothian from 1851. I have a copy of the marriage entry: "Proclamations June 1838 Robert Tait, Carter residing till lately at Janefield Place Leith, parish of South Leith, and Elizabeth Shiells residing at No 14 Duke Street Leith, same parish, and daughter of Willm Shiells, Gardener, Grange Loan, were three times proclaimed in order to marriage on 3 June 1838 & no objections offered, and were married at Edinr on 8th June 1838 by the Rev Willm Peddie, Edinburgh." Trouble is, Robert does not appear in any census with Elizabeth. She had six known children, four of them with Robert Tait named as father. In 1841 Just Elizabeth and daughter Mary were at home. In 1851 she has three daughters, and still no sign of Robert. In 1861 Elizabeth was at Nether Liberton and seems to have gained a son, William, aged 5, and still no sign of Robert. In 1871 she is still at Nether Liberton and has yet another son, George. In 1881 Elizabeth was living with her daughter Marion (whose first husband John Barclay died in 1875) and her second husband James Thomson. I cannot find Elizabeth after 1881 in theUK and nor is there a death entry for her at Scotlands People. There isn't a birth entry either, nor a marriage for her parents. Her brother John died in 1872 and his death certificate names his parents as William SHIELL and Mary SHIELL, but I can find nothing about either of them on SP or the censuses or the IGI. Maybe they were non-conformists or something but that wouldn't explain why there's no death certificate for Elizabeth. And as for Robert - I don't know his age or birthplace so I have no hope of identifying him in the Statutory deaths. Robert and Elizabeth's daughters were Mary (born 1841, married William ALLAN); Jane (born 1843, married George THOMSON; Marion (born 1847, married John BARCLAY then James THOMSON). I can't find the sons George (b 1863) and William (b 1856) after the 1871 census. In fact, I think George may be the illegitimate son of Elizabeth's daughter Mary - the only possibility for George at SP was born August 1862 and Mary didn't marry William ALLEN until May 1863. A son of the same forename, age and birthplace shows up with Mary and William in 1881. Does anyone know anything about these people? Does Robert show up in a directory somewhere perhaps, or on an MI? Does anyone have them in their tree? Many thanks, Loretta Melbourne, Australia
