We actually need to locate a will of John Barton MILES to prove who his children were. I have made some changes to my data. I now have John Bartholomew "Barton" Miles as the one who married Sarah HOWARD, and Rose Ann ? I can't back up that she was Rose Ann PAYNE- if anyone has proof let me know, but not sure where I got that info. I have placed Henrietta Miles who married Charles Fowler Mattingly, and her brother Elexius Miles who married Sarah B. THOMPSON 13 Jan 1830 , Washington, Kentucky, and a John Miles with no info. Under John Barton MILES. Now as far as Barton Elexius MILES son of Henry MILES and Eleanor PIDGEON, I have removed both of his wives, I now have no known wife. I think people including myself have got the children of Barton Elexius MILES confused with the children of John Barton MILES. Now as far as Mary Ann MILES b. abt 1805. m. to Benedict Drury. I am very hesitant to place her under John Barton MILES, until we determine where and When John Barton MILES died. The reason is, Benedict DRURY moved to Union County, KY his will was transcribed by Judith BURGER. In will of Benedict DRURY he states that his Father in Law ? MILES was of Union County, KY. If John Barton MILES died in Marion County, KY that rules him out as being the father of Mary Ann MILES who married Benedict DRURY. If her marriage record indicates that her father was a John Barton MILES then apparently John Barton MILES was in Union County, KY not Marion County, KY. Will Of Benedict W. Drury Signed April 09, 1844 In the name of God Amen I Benedict W. Drury being weak in body but sound mind and of disposing memory make this my last will and testament ((Viz)) 1st It is my great wish and desire that Benedict I Spalding should become my executor. 2nd I also wish all my just debts be paid, and if my perishable property be insufficient to pay my debts, and those who I am owing should be unwilling to wait until the renting of my land should meet their demands, I then wish my executor to sell either public or privately which he may think best, my land, after paying the balance of said debts, I wish the residue of that money (for which the land may bring) to be used in the raising and education of my children so far as my executor may think necessary, it is also my wish that the Court Un Co appoint Benedict I. (J?) Spalding as Guardian for my three youngest children, and further wish the rest of my children to choose Mr. B. I. Spalding for their guardian, also I expect (as my children) to receive other property from my Father-in-law------Miles of Union County Ky, should my expectations of receiving such property be realized in land negroes money or any other property It is my wish (so far as I am Concerned) that my executor shall have full power and control over such lands negroes, money (?), and to make such a disposition of it as he may think most advantageous to my children, in all things pertaining to the management of my children or property, I leave it entirely with my executor (?), as I hope he will take charge of both. And if by any accident my executor should be rendered incapable of attending to this my last will and testament or if my executor Benedict Spalding should die then I wish and desire that Mr Spalding Son, shall be appointed in his stead And it is my wish and -----(will?) that my eldest daughter Maria shall have the (last timed?), bedstead, bed and furniture for services rendered, I wish and will that my daughter Mary Jane shall have her choice of the remaining beds, and bed stead of furniture at the appraisment price In testamony Where of I have hereunto set my hand and affixed my seal on this 9th day of April in the year of our Lord one thousand eight hundred and forty four Benedict W.
