The final accounting by Aletha and James was dated April 23, 1831 and referred to Benedict as deceased. Apparently it was a very popular Spalding name. I found a record online assuming the one that was married to Aletha died in Kentucky. Then again maybe it's two different Alethas. Actually when she checked she found that that particular will was that of Ann Assiter. In it Ann Assiter referenced her greandaughter Ann Payne d/o Henry Payne and Mary Assiter. Don ****************************** 10/1/2011 Additional information has recently come to light suggesting that the first wife of John Drury may possibly have been Ann Payne (daughter of Henry Payne and sister to Charles (d. 1717)). Ann received a bequest in the 1695 will of her grandmother Anne Assiter that established her existence. She then becomes the only daughter of Henry Payne not assigned a spouse. Since John Drury was living on land owned by the Payne family it seems logical that he would be married to a Payne daughter. 9/15/2012 Henry Payne and Mary Assiter did have a daughter Ann Payne who is mentioned in her grandmother’s Will. Hi Jerry, I'll try to give you my take on this situation. First of all about Rachel Payne: My notes--Rachel Payne was assumed to be the wife of John Drury s/o Robert (immigrant) due to the following (see “Beaverdam Manor” pp 96,97. Also see “Colonial Settlers St. Clement’s Bay” pp187,188): from (inv 39c:187) Will of Charles Payne 12/11/1717 lists John Drury now living on “Howard’s Mount” as next of kin. Will of Thomas Payne (1731) lists John Drury s/o John (d. 1724) as next of kin. John Drury's 2nd wife Mary Ford was established from his Admin Accts dtd 2 June 1724 where she is listed as executrix. However, Charles Payne is not known to have a sister named Rachel. There is a Rachel Payne who was a daughter of Thomas Payne and Jane Smallpiece but her family has not been proved to have a known connection to the family of Charles Payne. ********************************** Note from Linda Reno in E-mail msg: I believe that Rachel Payne, dau. of Thomas Payne and Jane Smallpiece, married Arthur Kerse based on the following administration account:Admin. accts. of Arthur Kerse (Planter), SMC, 9/11/1700; payments to Gilbert Turberville for Mr. Cheseldine and Rachel Kerse; Admr., Isaac Payne (Skinner). ******************************** Now to John Drury: I have John Drury (d. 1724) married 1st to Ann Payne d/o Henry Payne and Mary Assiter. Their daughter Ann Payne (mentioned in Mary Assiter's will in 1795) was the one I had married to Francis Hayden in 1731 . This was from two references from LDS but not further confirmed. ****************************** 10/1/2011 Additional information has recently come to light suggesting that the first wife of John Drury may possibly have been Ann Payne (daughter of Henry Payne and sister to Charles (d. Will of Ann Assiter, SMC 11/4/1693-3/20/1693-4. Note by Linda Reno a St. Mary's County genealogist and researcher concerning this will Maryland Calendar of Wills says it is Henry Assiter. I called and had the will pulled at the (St. Mary’s County) courthouse to verify the name. It is the will of Ann Assiter. I should have gone further and gotten a copy of the will. That needs to happen. If the transcriber messed up the name of the testator, other things may have also been missed, specifically the mention of Ann Paine. Carr, Lois Green, card file sc4040 - 1166 ,1695: Ann Assiter, widow of William. Inventory, personal estate. Ann willed 200 ac. to her daughter Mary and male grandchildren to split equally. To Ann Paine: 1 cow, 1 calf, at the age of 21 or marriage. *************************** Francis Hayden: The presumption can be made that Ann Drury married a Hayden because her brother John Drury married Susanna Hayden who was Francis' sister. There's no proof but it is plausible. It is evident from the admin accts of Francis Hayden that he had a wife named Elizabeth who married Sebastian Thompson. ***************************** Admin Accts. of Francis Hayden rendered 4/4/1749 lists Sebastian and Elizabeth Thompson as administrators of the estate. It is clear that Elizabeth was his widow and that she married second Sebastian Thompson. ******************************* So what we need is something definite to let us know who Ann Payne (d/o Henry Payne and Mary Assiter) really married. We don't have anything at present that I'm aware of to say who her husband was. Linda says she doesn't know of any other marriage other than that of Elizabeth, but that doesn't mean there wasn't one. Hope this helps to make my thinking clear. Thanks Jerry, That's where my reference came from also. Now for an update on her parents. Some time ago (see below) Linda checked at the St. Mary's county courthouse and discovered that a published record stated that a will was that of Henry Assiter. Actually when she checked she found that that particular will was that of Ann Assiter. In it Ann Assiter referenced her greandaughter Ann Payne d/o Henry Payne and Mary Assiter. Given the association between Charles Payne and John Drury I have assumed that John probably married Charles' sister Ann Payne shortly after 1695 when she was still listed as single in her grandmother's will. If they were married it would make sense that one of their female children would be named Ann. Hope this helps. [Will of Ann Assiter, SMC 11/4/1693-3/20/1693-4. Note by Linda Reno a St. Mary's County genealogist and researcher concerning this will - Maryland Calendar of Wills says it is Henry Assiter. To Ann Paine: 1 cow, 1 calf, at the age of 21 or marriage.] *************************** ________________________________ From: "clark8178@comcast.net" <clark8178@comcast.net> To: mdstmary@rootsweb.com Sent: Sun, February 3, 2013 11:16:27 AM Subject: Re: [MDSTMARY] Sebastian Thompson and the Drurys Don, I also had Francis Hayden married to Ann Drury, but no parents of Ann Drury. I think this probably came from one of Mary Louise Donnelly's books. Perhaps we need to check her books to see what she says and her reasoning or proof. It maybe an error several people have copied including myself. I have nothing to back it up, and I entered much of her info. from her books only to find out she had many errors. I assume it came from her book that I had that had I think it was Colonial Settlers of Beaver Dam? since I don't have that book anymore I can't remember Title, but it's the one that mentions Robert Clarke Sr. who married 1st to Sarah Combs. The first is about the wives of Francis Hayden (1709-1748). One record from the LDS International Genealogical Index and a second from LDS Family search.org lists Ann Drury (abt. 1710/13 - ?) and has her married to Francis Hayden in 1731. Then we have from research of Genealogist Theodore L. Brownyard sent to St. Mary's County Historical Society 2/10/2003 ***************************** Admin Accts. of Francis Hayden rendered 4/4/1749 lists Sebastian and Elizabeth Thompson as administrators of the estate. It is clear that Elizabeth was his widow and that she married second Sebastian Thompson. ******************************* So, did Francis Hayden marry twice or, as some have suggested, was his wife's name really Ann Elizabeth or perhaps Elizabeth Ann. If he married 2nd Elizabeth ____, were any of his children by her? Was the Sebastian Thompson who married Charity Baily and the one who was mentioned in the Admin Accts of Francis Hayden as the husband of Elizabeth Thompson the same person? Thanks again for all your excellent comments, Don Drury ------------------------------- To unsubscribe from the list, please send an email to MDSTMARY-request@rootsweb.com with the word 'unsubscribe' without the quotes in the subject and the body of the message ------------------------------- To unsubscribe from the list, please send an email to MDSTMARY-request@rootsweb.com with the word 'unsubscribe' without the quotes in the subject and the body of the message
