Heavy Damages Awarded - The trial of the case of the children of Luther M. HAUER against the Baltimore and Ohio Railroad Company for $30,000 damages for the killing of their father, by alleged culpable negligence, at Weverton, on the 4th of June 1880, was commenced in the circuit Court of this county, sitting in special session, on Tuesday last, and concluded on Friday morning by the rendition of a verdict of $15,000 for the plantiffs. Hauer was about 49 years of age, and the son of Rev. D. J. HAUER, of Hanover, PA. At the time of his death, which resulted from being struck by a freight train, while crossing the track to board a passenger train, he was connected as salesman with a house in Baltimore. In rendering their verdict, the jury in compliance with an Act of the General Assembly made the follwiing distribution of their award to the several children: - To the eldest daugher, aged 25 years at the time of the unfortunate occurrence, $600 - to Henrietta, aged 23 years, $600 - to Charlotte, aged 20 years, $1,200 - to Mana, aged 18 years, $1,800 - to Benjamin, aged 14 years, $1,800 - to Daniel, aged 9 years, $3,000 - to Anne, aged 7 years, $3,000 Counsel in the case were Capt. James McSHERRY and Col. H. Kyd DOUGLAS for plantiffs and Hon. A. K. SYESTER and Charles W. ROSS for the defendants. A motion was made for a new trial. The jury deliberated in their room from 4 o'clock on Thursday afternoon until 9 o'clock Friday morning, and it was currently reported that the delay was caused by those who favored a much larger sum. DEATHS AND FUNERALS Mr. Mark Alexander Herbert. The body of Mr. Mark Alexander Herbert, who died of paralysis of the kidneys on his way to Gibraltar about two weeks ago, arrived in New York this morning and will reach Baltimore this afternoon. Mr. Herbert sailed from New York for Naples on December 2 on the North German Lloyd steamship Ems. He was taken ill at Naples and the United States Consul there recommended his immediate return, sending his own son to accompany him. Mr. Herbert died, as stated, before reaching Gibraltar. He was the son of the Gen. James R. Herbert, and was born in this city in 1873, where he was educated. He was connected for a long period with the Baltimore and New York Transportation Company. During the war with Spain Mr. Herbert went to Tampa with the Fifth Regiment, serving as adjutant of Major Rawlings' battalion. He was a member of the Bachelor and Junior Cotillion Clubs. Surviving him are five sisters-Mrs. W. Kennedy Boone, Mrs. Courtland Hawkins Smith, Miss Mary C. Herbert, Miss Elizabeth Alexander Herbert and Miss Camilla H. Herbert. Mr. Anthony Dailey. The funeral of Mr. Anthony Dailey, who died Monday night at his home, 1121 West Baltimore street, took place yesterday at St. Peter's Catholic Church, Poppleton and Hollins streets. The pastor, the Rev. Wm. A. Reardon, celebrated a high mass of requiem. Father Reardon made a few remarks eulogizing Mr. Dailey for his sterling qualities of mind and heart. The interment took place in Bonhie Brae Cemetery. A number of vocal selections were rendered during the services at the church. A delegation was present from the Border State Savings Bank, of which Mr. Dailey was a director. He was also one of the oldest members of the church in years of attendance. Mrs. Emily C. Wynn. Mrs. Emily C. Wynn died yesterday at her home, 1429 West Fayette street, aged 66 years. She was a daughter of the late James Gould and a granddaughter of the late Alexander Gould, Sr. Mrs. Wynn is survived by a husband, Mr. Joseph R. Wynn, eight children and nine grandchildren. Mr. James Lloyd Chamberlain. Mr. James Lloyd Chamberlain died yesterday at his residence, 1126 Forrest place, aged 70 years. Interment will take place in Cecil county. JOHNSON and others The object of this bill is to procure a decree for the sale of a certain house and lot, situate in Graceham, in said County, and a quantity of personal property, which belonged to Isaac R. HARRY, at the time of his death, specified in his testament and last will, and for other purposes. The bill states that on the 14th day of March 1835, Isaac R. HARRY, late of said County, in his life time, in due form of law, made his testament and last will, etc. That he devised and bequeathed to his wife, Ann Margaret HARRY, during her natural life, a house and lot in Graceham, in said County, and a large and valuable personal property, specified in said will; and that after the death of the said Ann Margaret HARRY, the widow, said real and personal property was directed to be sold by the Executor, in said will named: that the said testator appointed P.R. HARRY, his Executor, who accepted the trust. The bill further charges that the said Ann Margaret HARRY, the widow, died about one year since, and that P. R. HARRY, the said Executor, died a few weeks after the said Ann Margaret HARRY, who died without having executed the trust reposed to him by said will, by selling the said house and lot and the personal property aforesaid, and that it is necessary that a trustee should be appointed by a Court of Equity to make said sales. The bill further charges that the testator directed that the proceeds of sale of said property, shall be divided as follows, viz: One half to P. R. HARRY, the son of testator, and the other half to Charles MAICKE and Sabina MAICKE or to the survivor of them; and that Charles MAICKE resides out of this State, in parts unknown. The bill states that P. R. HARRY in due form of law made his testament and last will, and afterwards died withouth having revoked the same; that George H. JOHNSON was appointed Executor by said will, who accepted the trust reposed in him by said will; and that the said P. R. HARRY died, leaving a widow named Elizabeth HARRY, and two Children named Clara HARRY and Charles Alfred HARRY, who are infants under the age of twenty-one years, who reside in the town of Graceham, in said County. The bill states that the said Sabina MAICKE and Charles MAICKE are grand children of the testator, Isaac R. HARRY. FLEMING, esq, will sell his farm stock and household furniture. Wednesday, 19th - at 9 am at his residense, near Walkersville, Ezra E. BARRICk, esq, will sell his farm stock and utensils. Fire in Emmitsburg - On last Thursday evening, the stables of Messrs. Jacob HORNER and John ZIMMERMAN, at Emmittsburg, were entirely destroyed by fire, together with a considerable quantity of grain and hay. It is believed to be the work of an incendiary, as just previous to the conflagration, a person, not recognised, was seen to leave the premises. No insurance. We have no further particulars. Death of a Prominent Citizen - William LYNCH, esq, died at his residence, near Jefferson, in this count, on Sunday, 9th, of Dropsy, in the 70th year of his age. Mr. Lynch has represented this county in the State Legislature several times, and occupied other important local trusts. He was much esteemed and deservedly popular; and was the father of the present Prosecuting Attorney of this county, and of the Editor of the Washingtonian, published at Leesburg, Virginia. Louis Morris, a prominent contractor, and builder of Chester died at 6 o?clock last night at the Taylor Hospital as the result of complications which set in following an operation. Mr. Morris would have celebrated his fifty-ninth birthday today. The deceased, who has been a resident of Chester for the past forty years, is survived by his widow, Mrs. Georgie Hilghman Morris, three sons, Howard F. Morris, Howard I. Morris and A. Gilbert Morris and one daughter, Miss Grace A. Morris. He is also survived by three brothers and one sister. Mr. Morris during his life in Chester took a prominent part in many activities of public interest. He was a member of the last select council under the old city government. Mr. Morris was engaged in the contracting business for thirty years and during that time supervised some of the largest enterprises in the county. The Franklin school, Horace Mann school and many buildings of the Viscose Company of Marcus Hook were erected by him. Mr. Morris was active in many lodges and organizations. He held membership in the Chester Lodge, No. 236, F. and A. M.; Chester Chapter, No. 258, R. A. M.; Chester Commandery, No. 66, Knights Templar; the Philadelphia Consistory, Lu Lu Temple, A.A. O. N. M. S., and the Shrine Club of Delaware County. He was a very active member of the Chester Masonic Association and was a leader in the erection of the Masonic Temple at Ninth and Welsh streets. He was the first Grand Tall Cedar of the Penn Forest, No. 21, Tall Cedars of Lebanon, and also took a leading part in the founding of the Chester unit. He was connected with the Keystone Masonic Club, P. O. S. of A., Modern Woodmen of America and the Theodore Hyatt Council, I. O. A. The funeral will be held from his late home Saturday afternoon at 2 o?clock. The Rev. Francis M. Taitt, pastor of St. Paul?s Protestant Episcopal Church, will conduct the services. Mr. Anderson was one of the largest landowners and most successful farmers in the county. His wealth has steadily increased for the last thirty years, and at his death his estate is not far short of a hundred thousand dollars. He will be greatly missed by his neighbors, as he was kind and obliging to all, and especially to those who needed help. His bounties have been dispensed like the dews of heaven, while silently its effects have been felt, and those who shared in it, will sorrow at the death of one whom to them has been a dear friend. His demise will be severely felt by the laboring class who have depended on him for their daily bread for many years. About five years ago he connected himself with the Wicomico Presbyterian church at Rockawalking, and was a regular attendant on divine service until ill health prevented him from getting about. He leaves three sons, one daughter and several grandchildren to mourn their loss. Mr. Morris was perhaps the oldest man in Wicomico Co. He has been a member of the Presbyterian Church for about 60 years and a Ruling Elder for over thirty years. He was a large slave holder before emancipation, and his humane treatment of his servants, so firmly attached them to him, that the wife of the Rev?d Frost Pollitt, refused to leave his service when her freedom was offered her. The deceased had come to the city at that time in the schooner Cadi, belonging to his father, Mr. Isaac Anderson, for the purpose of superintending the sale of a cargo of grain and wood. The sales were effected, but no payments made, and he disappeared with scarcely a trace of his whereabouts. It was subsequently ascertained that he was in company with parties on Fell's Point, whom he left at a late hour of night. It is supposed that in the effort to make his way to his way to his vessel, which laid in the stream opposite the draw-bridge he missed his way and accidentally fell overboard at the point where his body was found. Coroner Spicer held an inquest , and a verdict was rendered of accidental drowning. A gold watch, with sundry papers, was found upon his person. The body was taken in charge, at the instance of friends, by Mr. Fry, undertaker, and prepared for sending to his late home in Wicomico county. Balto. Sun, 19th instant. The remains arrived at Salisbury last Tuesday afternoon and were immediately conveyed to the residence of Mr. Isaac Anderson, the father of the deceased, and interred in the family cemetery.
