    1. [MAXWELL-L] Re: MAXWELL-D Digest V02 #97
    2. Ann Hoskins-Brown
    3. Hi: I have a Maxwell connection that I have not been able to track down and wonder if he ties into Jean's line. I didn't see tehm on your website, but it sounds as if you have some loose ends and additional info in your database. Here's what I have: Mary Jane Maxwell bn ca 1829 in TN was the second wife of James C. Hays of Robertson and Henry Counties in TN. They married in 1847. She was the daughter of a John Maxwell and Mary UNKNOWN. John is buried in the Maxwell cemetery in Henry Co TN near the Graves Co KY line only a few miles from the Hays cemetery in Cottege Grove. Also buried there are Mary Maxwell (1804-1876) and Marion Maxwell (1837 - 1861). John appears in Henry Co TN census in 1840 and 1850. 1850 lists him as a 54 yo farmer born in NC with assets of $1000. Wife Mary, age 44, also born NC. Children Marion, age 13, John age 10, Maston (written Martin) age 7, Paralee age 4 all born TN. Also listed last is Margaret Maxwell age 18 bn TN -- relationship?? (note - Mary Jane was married to James Hays by this census) 1840 lists him as age 40 to 50 with one male under 5, one female 5-10 (probably Mary Jane) and female 30 - 40 assumed to be wife Mary. His son Maxwell, M. Y. (Maston Y.) married Mary Elizabeth Stiles. He was a Pvt.; enlisted 11/2/63 in West TN; on March/April 1864 Muster Roll listed as absent without leave; on May/June 1864 Muster roll listed as transferred to Co. D, 5 TN Infantry, CSA May 1864. Originally enlisted in Co. E, 46 TN Inf., CSA. John Washington Maxwell (1846 - 1918) is buried in the Hays Cemetery in Cottage Grove TN. Any help identifying these Maxwells would be greatly appreciated. Thanks in advance -- Ann Hoskins-Brown on 7/26/02 9:40 AM, MAXWELL-D-request@rootsweb.com at MAXWELL-D-request@rootsweb.com wrote: > From: Jean Leeper <grannyroots@iowatelecom.net> > Date: Thursday, July 25, 2002 10:38 PM > To: MAXWELL-L@rootsweb.com > Subject: Re: [MAXWELL-L] Maxwell research > > Hello, I was looking at your husbands Maxwell connections and was wondering > if the Thomas Maxwell listed died at the battle of Tugs Mountain in May > 1781. I also need an obit for Mary A (Church) Maxwell. She was on the 1880 census, but 1900, Andrew has Celia as his wife. So I believe Mary died and he remarried. Thank you, Judy Peters

    3. Hello, I was looking at your husbands Maxwell connections and was wondering if the Thomas Maxwell listed died at the battle of Tugs Mountain in May 1781. His wife's name was Rebecca and they were married in 1766. I am really interested in their children's names, possibly Sidney born about 1770 and Sarah born in 1772. I am descended from Sidney and have been law;ooking for his parents. Thanks Bob I believe this fits except no Sidney and if you think so I would love to see what you have found. Thomas has been a hard line to research. My husband descends from his brother James. MAXWELL, 1C6R, F Birth Date: ca 1781 Birth Place: Propably Mont. County, VA Spouse: Newitt DREW, M Notes for Thomas MAXWELL Capt. Thomas Maxwell was no "timorous " man. He dressed often in hunting shirt, with his tomahawk and scalping knife in a belt and with his trusty mountain rifle on his shoulder, he marched to and fought at Kings Mountain. After the battle at that place, which was fought on the 7 Oct 1780 he settled on the North Fork of Holston River, near Broad Ford, in the present Smyth county. In the spring of 1781 a small band of Shawnee Indians entered Burke's Garden and Thomas Maxwell was killed near Tug River at Maxwell's Gap while trailing them. Taken from page 277 of "History of Tazewell County and Southwest, Virginia" 1748-1920 by Pendleton 1783 Survey 290 acres north Fork Clinch River on Taylors's line Montgomery B-84 is listed a Thomas Maxwell Notes for Rebecca Rebecca left a will and she mentioned Sarah "Sally" Drew, her daughter. Rebecca did not name any other children who were not her Hays children. Sarah named her first son John Cloyd. Her second was Thomas Stephenson, who became a govenor of Arkansas. She later named another son Richard Maxwell Drew. He became a judge in LA. Notes for Sarah A. (Child 1) "After Sarah married Newett Drew, John and Rebecca Hays relinquished their rights to some property in Tazewell County, VA and this is also recorded in Wilson County, TN records. This property was given to Sarah and Newitt as a gift, and it is believed it was the land that had belonged to her father. It was adjoining James Maxwell's land and Audley Maxwell signed an oath concerning it. 3. I and my husband each have a Maxwell line. (See bottom of E-mail and check register report site first) In the last couple weeks there has been a lot of activity on this list but not enough information was provided in most posts, to merit my checking my database. When I search backwards from known ancestors I do some or all of the following. First I find out everything I can of the earliest known ancestor. Talk to your oldest living relative maybe tape that conversation and have a list if questions. One of them might jog the persons mind. If known, record, date of birth and place, date of marriage and place, date of death and place and obituary if one. Also, parents names if known. (Please place this information in a posting the the list) 1. Then I do a complete census study. Filing copies of the actual because I may want to search the pages later for clues. From the census I probably will end up with the state of birth. 2. Look for a probate. There usual is a listing of heirs and where they lived at the time of the deceased death. I may be able to trace another child and find their obit/etc. and find a much need clue. 3. Land records within ca a year after the death of the deceased. It may show the transfer of land where all of the children have to give up their rights to their portion of the land. I have linked back through land records several times. 4. If you have an obit and it tells the place of birth, I then look, in that area, for any and all records for that surname seeing if there is one that has ancestor listed as a son. 5. Cemetery records and funeral home records. 6, Church records are great if you can find them. Quakers kept excellent records. My Maxwell was a Presbyterian and converted to Quaker in N C and married an Elliott. 7. Don't forget tax records as a linking tool. Your clue comes each time from a different place. I prefer to do my own searching so that means traveling to the area and then having a researcher follow up on things I missed. By now you should have a notebook of sleeved documents to refer back too. I shake my head when someone comes in our research facility and takes scratch notes and does not record the name of the document they extracted that information from and in a lot of cases, thereby, leaving out the clues. Hope some of this helps as you pursue your Maxwell line backwards. Let me know if you see a connect to our Maxwell lines. He married Bertha KELLY about 1890 and they had three children: James Albert Maxwell, b. 10 July 1893, d. 5 June 1922 Ola and Ila (twins) b. Jan. 1897 James died sometime around 1910, either in a hunting or train accident, and Bertha remarried Jesse B. Wallace and moved to Perry Co., Ms. with the twins, Ola and Ila. I've been unable to find James in earlier or later census records. In the 1900 census he was listed as "farmer" but family tradition (and some pictures) have it that he was a clerk/accountant with a railroad.
