    3. Indenture Leo Joseph Braddock VS William & Leonard Mattingly February 21, 1865 Union County, Kentucky This Indenture made and entered into this 21st day of February 1865 by and between Leo J. Braddock of the first part and William Mattingly and Leonard Mattingly of the second part all of the County of Union and State of Kentucky. Witnesseth that for and in consideration of the sum of Three Hundred and Thirty-Five dollars in hand paid the receipt-of which is acknowledged and Fifty-six dollars and Ninety cents to be paid on the 1st day of March 1866 for which said Mattinglys have executed their promissory note bearing even date herewith and drawing interest from date. The party of the first part have bargained and sold and by these presents do bargain sell transfer and convey unto the party of the second part the following described tracts or parcels of land situate lying and being in the County of Union and State of KY on the waters of Eagle Creek in a Military survey of land known as the Mercer survey. The first part Nine acres where the coal banks and where Thos. Brinson lived. Bounded as follows. Beginning at a poplar and black gum, the black gum one of Mattingly's corners, thence S 31¼ West-54 poles with Mattingly line to a hickory and stone in said Mattingly's line thence N 75* East 73 poles to a poplar and stone in Davis' line, thence N 52 West-51 poles to the Beginning containing Nine acres. Also another piece of land purchased of said Wm. Mattingly. Bounded as follows Beginning at a poplar and black gum corner to Wm. Mattingly and the Nine acre survey, thence with the Mattingly line S 31¼ West 43 poles to a stake in said Mattingly's line. Thence North 12 poles to a large poplar thence North 14 W 5½ poles to a sweet gum on a drain thence N 14 E 10 poles to another sweet gum on the same drain. Thence N 32 East 12¼ to another sweet gum on the same drain. Thence N 42 East 10 poles to a hickory and dogwood on the same branch thence S 52 East 11 poles to the Beginning containing 2 acres and 2 roods of land. And ten acres of under ground privilege marked out above the ground, towit Beginning at a poplar and stone corner in Davis-line corner to the Nine acre survey on the South East side of said survey thence S 15 East 21¾ poles to a hickory and dogwood marked above ground thence S 75 West 73 poles to a stake thence N 15 West 21¾ poles to a hickory corner to the Nine acre tract. N 75 East 73 poles to the Beginning containing Ten acres of und! erground privilege. To have and to hold the above described tracts of land and the coal privilege in the last mentioned survey unto said Wm. & Leonard Mattingly their heirs and assigns and the said Braddock & wife agree to warrant and forever defend the title to the land above described from and against the claims of himself his heirs & from and against the claim of all persons whatever. Mattingly was this day produced to me duly stamped according to act of congress and acknowledged by said L.J. Braddock and Helen Braddock his wife to be their act and deed.
