I had a copy of the original court proceedings pulled for the settling of the estate of John Mattingly, Sr by John, Jr and Amos Mattingly in Frederick Co, MD in 1773. Very, very unfortunately, it says just that - John Mattingly, Sr - executors John, Jr and Amos Mattingly - accounts passed. No indication of who these people were. I also had a copy of James Maginly's will and Francis Alexander's will to determine if James Maginly may have been James Mattingly as HEM had indicated in his book "Mattinglys in Early America". The will of James Maginley is clearly James Maginley. The Maginley's were Scot Presbyterians from the northern part of Frederick Co, MD and Adams Co, PA. Their lineage is clear and this is not James Mattingly as I had hoped. Additionally, he names his sons, Amos and John and 2 grandsons, each called James. If these had been Mattinglys then I suspect that he would have named a grandson John, son of John who was the executor for the John that died in 1773. The will of Francis Alexander is not very clear. He mentions moiety in the hands of James Maginly. However, there appears to be a clear correction over the "G" in Maginly that could be either a "TT", "N" or an "M". I'd give it a 50/50 chance that the scribe wrote Maginly and meant to change it to Mattinly. One transcriber of the will indicates that he thinks that the name should have been Mattingly, while another indicates that he thinks that the name should be Maginley. Unless there was a James Maginly and a James Mattingly living near Francis Alexander, then I'd bet that there was a James Maginly but no James Mattingly. So, obviously there was a John, Sr, John, Jr and Amos Mattingly in Frederick Co, MD in 1773 but I still have no idea of who these people were. Assuming that John, Jr was at least 18 in 1773, he would have been born before 1755 and John Sr, would have been born before 1735.
