    1. Re: [MATTINGLY] Will of Thomas Warren
    2. ********************* I think that the obvious answer here is that Thomas Mattingly was not married to anyone before he was married to Ruth Cole. The only reason why we thought that he had a wife before Ruth is that HEM reported that he was married to Elizabeth Warren. And since he was married to Ruth Cole by 1717 then he assumed that Elizabeth had died. If you eliminate Elizabeth as a possiblity then that leaves only Ruth as his wife (first and only possibly). In 1715-1717 Thomas would have been 25-27 y.o. which was not an uncommon age for a man to marry in the early 1700's. This does bring up an interesting question which is: if Ruth Cole was born c. 1699 then she more than likely would not have been married before she was 16 y.o. in 1715. This means that Thomas' children (Leonard, Edward, etc..) could not have been born before 1715. ********************** In view of the info sent by Paul it seems we indeed have a problem of Elizabeth Warren being the daughter of the Thomas Warren mentioned in this will and married to Thomas Mattingly, III. Thomas Warren died in 1744 but the wife of Thomas Mattingly, III died about 1715 (based on what I've seen reported). This Elizabeth Warren "Hyatt" is obviously still alive in 1744. I have to join Paul in asking, Where can we go from here? ************* >Houston, I think that we have a problem. > >A few weeks back I asked if anyone had a copy of the will of Thomas Warren >(d. 1744). 3. This particular Charles has posed a problem for me for several years. The only Charles I find married to a Louisa is Charles Walter Mattingly, born about 1843 and a son of Ignatius Arnold/Arnold J., etc. The Charles she's looking for should have been about 15 in 1850 but he seems to not appear anywhere or else I simply can't find him (my Ohio census for 1850 is sorely lacking). 1. [MATTINGLY] Will of Thomas Warren
    2. Houston, I think that we have a problem. A few weeks back I asked if anyone had a copy of the will of Thomas Warren (d. 1744). Several people sent transcriptions of the will and oddly each was slightly different and no seemed to have actually seen the original document. So, I had it pulled from the Hall of Records. HEM gives the reference as SMC, MD, Wills, L. 24, f. 164 (3-13-1744/5; 6-4-1745) The will is interesting in that although Edward and Leonard Mattingly are witnesses to the will, they are not named as grandsons of Thomas Warren. Also, although he names his daughter, Elizabeth, he names her as "Elizabeth Hyatt, deceased". Here is the will as I have transcribed it: In the Name of God Amen, I, Thomas Warren, of St. Marys County being sick of body but of perfect mind and memory doe make and ordain this to be my last will and testament revoking and making void all other wills either verbell or in writing before by me made. First and principally I give my soul to Almighty God and my body to the Earth. - 2dly I give and bequeath to my daughter Mary Ketting one heifer provided her husband delivers my young horse to George Warren.- 3dly I give and bequeath to my daugther Susanna Strong one mare which she has now in possession.- 4thly I give to my daughter Monica Hill one shilling sterling in full satisfaction of her part of my whole estate.- 5thly I give to the heir of my daughter Elizabeth Hyatt deceased one shilling sterling in full satisfaction of his or her part of my whole estate.- 6thly I give and bequeath to my son George Warren all the remainder of my estate both reall and personall. And for the exectuion of this my will and testament I do appoint my said son George Warren executor as witness my hand and seal this 18th day of March 1744/45 his Thomas + Warren mark Signed Sealed and D. in presence of us - Thos. Spalding Jun'r Leonard Mattingly On the back of the aforegoing will was thus written viz: Edward Mattingly St. Marys County June the 4th 1745 - Then Thomas Spalding, Jun, Leonard Mattingly and Edward Mattingly the subscribing witnesses to the foregoing will being duly and solomenly swore on the Holy Evangel of Almighty God depose and say that they saw the Testator Thomas Warren sign the foregoing will and heard him publish and declare the same to be his last will and testament that at the time of his so doing he was to the best of their apprehension of sound and disposing mind and memory and that they subscribed their respective names as witnessess to the said will in the presence of the said Testator and at this request - Sworn to before me. Thos. 3. I'm glad that Mary brought up the issue of John Baptist Mattingly and the Virginia Mattingly's because it is possible that J. B. is listed incorrectly. I certainly am not prepared to debate that idea and continue to carry him as married to Dykeander and as a son of John B. and ELizabeth Venable because I've seen nothing that would convince me otherwise. However, sometime ago I ran across the following from a fellow researcher: "Will Book C, page 24, Fairfax County, Virginia - James Mattingly was witness to will of James Robertson, Sr." "James Mattingly, bc 1760, entered Rev. War service in 1780 from Alexandria, DC (now Va), served in the 3rd Va. Regt., pensioned in 1818 in DC. 1820 residence Fairfax, Va., age 60 and wife 58. In 1841, he lived in DC where he moved to be near children who lived in Georgetown. Had a younger brother, Thomas who lived in DC (who was a Justice of the Peace in 1848)." "...further states that he was in the Battle of Guilford Courthouse and some skirmishes near Richmond and below Petersburgh; that he belonged to Virginia Line and date of his original declaration was June 16, 1815, and the number of his certificate was 5206. He names his wife, Elizabeth, 58/9, bc 1761; two daughters: Nancy c34 bc 1786; Massie 18; bc1802; and one son: Lewis 28, bc 1792." >From what I've seen, John Mattingly (married Dykeander) had a younger brother named James, born about 1760. Could this be the same James? I don't have an answer but that's the way I currently carry him.

I have heard that he names a nephew, Thomas, in his will but its not in the will that HEM published. Does anyone have the fully transcribed will? 2. I have an unidentified Mattingly I would appreciate help with. I am descended from John Townley Mattingly, John Mattingly, Richard Mattingly, Edward Stephen Mattingly, Vessie Mattingly (my grandmother). While in Greenwood County Kansas doing gen. research I came across a death record for a Richard Leroy Mattingly who died June 11, 1916 from Tubercular Meningitis at the age of 1 year and 23 days. What I surprise, all of the Mattinglys in Greenwood County were related to my grandmother and I had never heard of him. My grandmother would have been almost 7 years old at the time of his death. She didn't know anything about him. I just received a copy of the death cert. from Topeka (I requested the birth cert. as well, but it didn't come). They show him as follows: Richard Leroy Mattingly, born May 18, 1915, born in Kinsley, Kansas, the son of Ward Mattingly, born in Bloomington, Indiana and Daisy Campbell, born in Cherryvale, Kansas. Would appreciate any help! The body was removed to Edwards, Kansas. Kinsley is in Edwards County and is located between Wichita and Doge City Kansas over 200 east of Eureka, Greenwood County, Kansas. Thanks, Rhonda Hansch [email protected]

    1. [MATTINGLY] Clement of Thomas III
    2. Does anyone have any evidence that Clement, son of Thomas III, was married to Mary Spalding? I have seen reference to this marriage but I can't seem to find a source. This Clement died in 1780 but does not name a wife (presumed dead by 1780). He does list several children. HEM spectulated that there may have been 2 Clement Mattinglys during this time period, one in SMC and the other in Ann Arundel County. The one that was in AAC was definitely married to Ann Burton Coyle from at least 1728 (Clement and Ann are executors to Elizabeth Coyle, Ann's mother) until 1774 (Clement and Ann Burton are listed as sponsors for the baptism of a slave). Can anyone help? Paul Mattingly Atlanta, GA
