Thereon, Judge Massey's books are automatically copyrighted as soon as he published them, whether or not he sent them to the copyright office and paid the fee for copyright. I feel sure he knew that. He could, of course, allow free use if he so chose, but I have no idea (without a lot of legal research) if that still holds true now that he's dead and the copyright would have passed to his children.
