Stumbaugh was remanded to the custody of the marshal to await his trial for killing George Sobo on the same night and the same place, for which there is a separate indictment. Marshall and Sobo were partners and ran a store in which the killing occurred. Stumbaugh claimed self defense. Judge Clayton did not give a manslaughter instruction to the jury.
