ALERT AND UPDATE SB1614 - AUGUST 25, 2002 The amended language of the bill presented prior to the Assembly Appropriations Hearing Thursday can be found in my August 17, 2002 Report or at the legislative web site <http://www.sen.ca.gov. In spite of the number of opposition groups attending the Hearing the bill was moved to Suspense and was voted on later in the day. Still in opposition are California State Genealogical Alliance, Genealogical & Historical Council of Sacramento Valley, Bastard Nations and allied Adoptees organizations, California Newspaper Publishers Association, Axiom and California Bankers Association, along with First Amendment Coalition, CALI and several law firms. In fact, for the most part the author has made little headway in eliminating any of the opposition. Yet, the bill moves on. The vote in Appropriations included Assemblymembers Steinberg, Corbett, Goldberg, Washington, Correa, Negrete, Alquist, Diaz, McLeod, Wiggins, Aroner, Firbaugh, Pavley, Wright, Cohn and Simitian -- ayes. Noes included Assemblymembers Bates, Ashburn, Robert Pacheco, Daucher, Maldonado, Runner, Papan and Zettel. Assemblymembers Papan and Zettel are the only Democrats who have support us. The billl still contains a money issue of county's cost. This remain in the bill in spite of the author's objections. She stated that those cost were over estimated by the Dept of Health Services. But the cost figures remain. The bill no long require a two-thirds vote thought only a simiple majority is need for it to pass. The bill moved to the Assembly Floor on Second Reading on Saturday, because the author presented more amendments in Appropriations Committee. The amendments have now been included in the bill which can be found on the Senate web site. It requires that if you own the previously sold indexes, you have six months to remove the mother's maiden name on birth index and mother's maiden name and social security number on the death index if the indexes are on the Internet or open to the public. You will not be allowed to share this information under penalty of law. Legal counsel insists that the language is unconstitutional. It would seem that we are back where we began. The bill is scheduled sometime today on the Floor for a vote on the Third Reading, then it will go back to the Senate. I am getting conflicting reports as to if it will return to the Senate Judiciary Committee or not. It should, but I was told because it is so late, it could go directly to the Floor for a vote. That could be as soon as Monday. Now, I am sure you are confessed and wondering what is going on, well, so am I. Nothing with this bill is what it should be. At this point, I think our continued efforts to stop the bill should focus on the entire Senate, rather than just approaching the Judiciary Committee. That Committee includes Assemblymembers, Escutia the Chair, Kuehl, O'Connell, Peace and Sher, Democrats who all voted yes on the bill last time they heard it. The two Republicans Haynes the Vice Chair and Ackerman were no votes last time. I will bring you the list of the entire Senate below. LET'S LET THEM HEAR FROM US!
