Dear Listers: Now, I don't want to scare any one, as likely many will escape any consequences from this worm, but you need to be sure you are doing your part to keep your machine clean. We must all be diligent in this effort. If we all keep up we will do really well keeping an infection free environment. Yesterday I received tons of oddball messages. They are coming from everywhere. Most from people I have *never* heard of. I have anti-viral protection running at all times. I update daily. I run spot scans with an alternate anti-viral system. I keep my computer virus free. I was checking my computer and parts there of no less than once an hour yesterday! I have removed all my messages from my in box to alternate folders. I also manually scanned for virus components for the newest baddie on the block.... When visiting http://www.grisoft.com/ and scrolling down to News, Virus Alerts and Press Releases, a click on more information will give the following details: I-Worm/Bugbear (alias I-Worm/Keywo) After its launching, this worm copies itself into System folder using the same filename as in the e-mail. Then it distributes itself onto different e-mail addresses that are stored in Adress book of the infected computer. Also, it tries to find a computer where whole disk full access sharing is allowed, and copies itself into Startup folder, which enables its launching. . . . and goes on with further description and removal instructions. http://www.mcaffee.com posts the following on their site: W32/[email protected] Help Center W32/[email protected] is rated as MEDIUM RISK FOR HOME AND CORPORATE USERS. This mass-mailing worm attempts to send itself to email addresses found on an infected system. . . There is more to be read about this worm and what it may do. Don't panic, read what you can do to disable it, should you feel you have be subjected to it. Make SURE that your anti-viral program is installed, up-to-date, and ACTIVATED. And... with this particular one, I would go and read the manual removal instructions to be on the safe side. The AVG site www.grisoft.com has a removal tool specific to this worm. You may want to visit their site and read more. IF you don't have anti-virus software, or have not renewed yours in a long time, you can scan your computer drives while online for free at http://www.antivirus.com AVG is also a very good resident anti-virus program. Grisoft also offers a free downloadable version. You can pay and get technical support too, if you want, but I have had good results with the free version, as have had others who recommended it to me. If you are an Internet Explorer/MS Outlook user, visit http://www.microsoft.com and download the latest versions or patches. Lastly, this is NOT intended to start a thread on the list about viruses, wierd mail, etc. Do not send replies to the list re this message, please. Check your "help" dictionary in your email client for how to turn off the HTML encoding. I prefer all messages to come to me in plain text and that is how I compose them. They are eagerly seeking oral histories and genealogies of various multi-ethnic peoples, especially Portuguese and especially of the California areas, and do include other ethnic groups. If interested, contact the Bancroft Library. They are especially interested in oral histories recorded or transcribed, including print on demand published genealogy books, tapes, oral histories written down or recorded, etc. I went to the Portuguese genealogy society (as I have four different ethnic groups in my background) and found so much research in genealogy locally here with participation by the UC Berkeley using PhD thesis on genealogy research, for example, how the dairy industry was run by the Portuguese of N. Calif before 1930, and similar thesis for other ethnic groups. So, if you're forming a genealogy group in N. Calif or DNA, they also work with Bio Technology and DNA studies. Contact Ms. Higbee who works both with biotech and genealogy at the Bancroft Library. She's working with collecting oral histories at UC Berkeley. This is one more connection to get volunteer speakers, for example to come to N. CA genealogy clubs to talk about oral histories, genealogy, and DNA. Annee

Dear Listmembers: For years now I have received, either in the US Mail at my place of employment, or now via email, clandestine solicitations to help some "poor victim" of African Government abuse by giving them my bank account information so they can park their millions in my account. Yah, right! The intent is to get you to give them your information so they can drain YOUR account. One of my fellow listmembers from another list contacted me a while back to see if I knew where this scam should be reported. Since that time we have exchanged copies of the messages we have received. Some are pretty funny. I have been solicited as a Church -- which y'all know I am not! The letters are addressed "Dear Sir " or "My Lordship" -- which y'all know I am not! The English is attrocious. The stories don't hold together. But unfortunately some folk are taken in by it. This week I have gotten an especially large quantity of these letters one after another. So, this morning I thought I would search the net a bit to see what was out there about them. One of the best sites I found is very current [9/16/02]and the guy who received their solicitation is corresponding with them and posting the resulting email to the Internet. It has been quite amusing to read the interchange. It also lets you be aware of what the next step is when some unsuspecting soul actually replies to the mail! Existing law requires the Director of Health Services, as the State Registrar of Vital Statistics, to administer the registration of births, deaths, fetal deaths, and marriages. Existing law requires the State Registrar to arrange and permanently preserve the certificates in a systematic manner and to prepare and maintain a comprehensive and continuous index of all certificates registered. Existing law, the California Public Records Act, requires state and local agencies to make records that are not otherwise exempt from disclosure available to the public upon receipt of a request that reasonably describes an identifiable record, and upon payment of fees to cover costs. This bill would require the comprehensive index described above, and comprehensive birth and death record indices prepared or maintained by local registrars and county recorders, to be kept confidential, except that these indices may be disclosed to government agencies. This bill would exempt these indices from disclosure under the California Public Records Act. This bill would prohibit a government agency from selling or releasing these indices, except as specified, and from posting these indices on the Internet. This bill would require the State Registrar to prepare and maintain separate noncomprehensive indices of all California birth and death records for public release, as well as indices for purposes of law enforcement or preventing fraud. The bill would also provide for the release of certain birth and death data files, as defined, by the State Registrar, local registrars, and county recorders in accordance with specified requirements. It would require requesters of these indices and data files to provide proof of identity, complete a form containing prescribed information, and sign the form under penalty of perjury, and would prohibit these indices and data files from being used for fraudulent purposes or from being posted on the Internet unless certain requirements are met. This bill would also make it a misdemeanor for any person to violate the above provisions and would provide that any violators may be denied further access to the indices or data files maintained by the department. By expanding the scope of the crime of perjury, creating new crimes, and by increasing the duties of local officials, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement, including the creation of a State Mandates Claims Fund to pay the costs of mandates that do not exceed $1,000,000 statewide and other procedures for claims whose statewide costs exceed $1,000,000. This bill would provide that with regard to certain mandates no reimbursement is required by this act for a specified reason. With regard to any other mandates, this bill would provide that, if the Commission on State Mandates determines that the bill contains costs so mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 102230 of the Health and Safety Code is amended to read: 102230. (a) (1) The State Registrar shall arrange and permanently preserve the certificates in a systematic manner and shall prepare and maintain comprehensive and continuous indices of all certificates registered. (2) The birth and death record indices prepared pursuant to paragraph (1) and all comprehensive birth and death record indices prepared or maintained by local registrars and county recorders shall be kept confidential and shall be exempt from disclosure under the California Public Records Act (Chapter 3.5 (commencing with Section 6250) of Division 7 of Title 1 of the Government Code). (3) Notwithstanding paragraph (2), the State Registrar, at his or her discretion, may release comprehensive birth and death record indices to any government agency. Local registrars and county recorders, when requested, shall release their comprehensive birth and death record indices to the State Registrar. A government agency that obtains indices pursuant to this paragraph may not sell or release the index or any portion of its contents to any other person except as necessary for official government business and shall not post the indices or any portion thereof on the Internet. (5) The birth and death record indices prepared pursuant to this subdivision may be released to any government agency. (6) Requesters of the birth or death record indices prepared pursuant to this subdivision shall provide proof of identity, complete a form, and sign the form under penalty of perjury. (g) Any noncomprehensive birth and death record indices created by local registrars or county recorders shall be subject to the conditions for release required by this section. (h) A person or entity that obtains a birth or death record index, or any portion thereof, from a requester who has obtained the index in accordance with paragraph (6) of subdivision (c) may not sell, assign, or otherwise transfer that index, or any portion thereof, to any third party. (i) Paragraphs (2) and (3) of subdivision (a) and subdivisions (b) to (h), inclusive, shall be implemented only to the extent that funds for these purposes are appropriated by the Legislature in the annual Budget Act or other statute. SEC. 2. Section 102231 is added to the Health and Safety Code, to read: 102231. (a) Notwithstanding any other provision of law, birth data files, birth data files for public release, death data files for public release, and death data files for purposes of law enforcement or preventing fraud prepared and maintained by the State Registrar, local registrars, and county recorders shall only be released as follows: (1) Birth data files containing personal identifiers shall be subject to the same restrictions as the confidential portion of a birth certificate and shall only be released under the terms and conditions specified in Section 102430. (2) Birth data files for public release shall not contain the mother's maiden name. (3) Death data files for public release shall not contain the mother's maiden name and social security number. (4) Death data files for purposes of law enforcement or preventing fraud shall include the mother's maiden name and social security number. Death data files prepared pursuant to this subdivision may be released to governmental agencies and to those entities described in paragraph (4) of subdivision (c) of Section 102230. (5) Death data files containing personal identifying information may be released to persons expressing a valid scientific interest, as determined by the appropriate committee constituted for the protection of human subjects that is approved by the United States Department of Health and Human Services and has a general assurance pursuant to Part 46 (commencing with Section 46.101) of Title 45 of the Code of Federal Regulations. (b) Requesters of birth and death data files pursuant to this section shall provide proof of identity, complete a form, and sign the form under penalty of perjury. The form shall include all of the following: (1) An agreement not to release the birth or death data files and not to post the files on the Internet, except as permitted by this subdivision. (2) An agreement not to provide public access to data files obtained pursuant to paragraphs (1) and (4) of subdivision (a). (3) The proposed use of the data file. (4) For data files obtained pursuant to paragraphs (1) and (4) of subdivision (a), the names of all persons within the organization, if applicable, who will have access to the data files. (5) A disclaimer that credits any analyses, interpretations, or conclusions reached regarding the birth or death data files to the author and not to the State Department of Health Services. (6) Assurance that technical descriptions of the data files are consistent with those provided by the State Department of Health Services. (7) Assurance that the requester shall not sell, assign, or otherwise transfer the data files, except as permitted by subdivision (e). (8) Assurance that the requester shall not use the data files for fraudulent purposes. (c) Mail-in requests for birth and death data files pursuant to this section shall include a notarized statement attesting to the identity of the requester. (d) Birth and death data files provided pursuant to this section shall be made available subject to cost recovery provisions of the California Public Records Act (Chapter 3.5 (commencing with Section 6250) of Division 7 of Title 1 of the Government Code). (e) (1) Birth and death data files, and any portion thereof, obtained pursuant to this section, shall not be used for fraudulent purposes and shall not be posted on the Internet. (2) Notwithstanding paragraph (1), individual information contained in death data files obtained pursuant to paragraph (4) of subdivision (a) may be posted on the Internet if all of the following requirements are met: (A) The information is posted on a Web site that is protected by a password. (B) The information is posted on a Web site that is available to subscribers only for a fee. (C) The information is not posted for public display. (D) The information is available to subscribers pursuant to a contractual agreement. (E) The information is posted for purposes of law enforcement or preventing fraud. (f) A person or entity that obtains a birth or death data file, or any portion thereof, from a requester who has obtained the data file in accordance with subdivision (b) may not sell, assign, or otherwise transfer that data file, or any portion thereof, to any third party. (g) This section shall be implemented only to the extent that funds for these purposes are appropriated by the Legislature in the annual Budget Act or other statute. SEC. 3. Section 102232 is added to the Health and Safety Code, to read: 102232. (a) (1) Any person who violates Section 102230 or 102231 may be denied further access to the indices or data files maintained by the department. (2) Any person who violates Section 102230 or 102231 is guilty of a misdemeanor and shall be punished by imprisonment in the county jail for a period not to exceed one year, or a fine of one thousand dollars ($1,000), or by both the imprisonment and fine, for each violation. (3) The penalties described in paragraphs (1) and (2) shall not be construed to limit any other remedies provided by law. (b) Notwithstanding Section 126 of the Penal Code, the crime of perjury specified in paragraph (4) of subdivision (b) of Section 102230, paragraph (6) of subdivision (c) of Section 102230, and subdivision (b) of Section 102231, shall be punishable as a misdemeanor. (c) Paragraph (1) of subdivision (a) shall be implemented only to the extent that funds for these purposes are appropriated by the Legislature in the annual Budget Act or other statute. SEC. 4. No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution for certain costs that may be incurred by a local agency or school district because in that regard this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII B of the California Constitution. However, notwithstanding Section 17610 of the Government Code, if the Commission on State Mandates determines that this act contains other costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code. If the statewide cost of the claim for reimbursement does not exceed one million dollars ($1,000,000), reimbursement shall be made from the State Mandates Claims Fund.

UP-DATE ON SB1614 - AUGUST 31, 2002 Last night just before 8 p.m. SB1614 pass on the Floor of the Senate. On Wednesday it was passed on the Assembly Floor in spite of the valiant effort on the part of Assemblyman Pescetti who supported our opposition. From there it moved back to the Senate. For the next two days, we worked to force the bill back to committee. When it left the Senate the language in the bill had been striped and it stated only intent. At that time the author assured Senator Brulte that it came back it would go to the Senate committees. By now the time is running short and old promises do not mean much, at the discretion of the chair the bill went to the Floor. This time it was Senator Bowen who eloquently plead the case for the genealogist and adoptees. She related the factual information that at neither the state or federal level had any identity thefts been linked to any indexes. She slowed them down. On the first vote the author only got 17 yes votes. But in the final minutes of the session when SB1614, the only bill heard that was place on call, received four addition yes votes. So, it passed by one vote. SB247, the 'good bill' also passed on Friday. This bill will do something to curtail identity theft, while continuing to allow researchers access to the information. I will have follow-up with more details later. Right now I need some rest. I plan to that the weekend off. It will be the first one in seven weeks. I just wrote to Iris Jones for clarification regarding her last post on SB 1614 which said in part: "SB 1614 was just amended to remove the requirement put in while the bill was in appropriations that those who post previously acquired data to the internet redact the maiden name and SSN." My question was - since RW DID buy this database long ago, did the amendment mean RW *could* repost their database intact? Her answer was that it DID mean they would not be *required* to remove maiden names! Also, apparently, RW is discussing whether or not to repost the DB with or w/o maiden names! This is VERY good news meaning even if SB 1614 passes, we still *might* have access to the indices thru RW! Apparently SB1614 gets voted on tomorrow. I suggest that we, as CAGENWEB volunteers, wait to see the outcome of the vote, then write to our RW reps in support of reposting of this important-to-us database fully intact!!!!!! Jana

ALERT AND UPDATE SB1614 - AUGUST 25, 2002 The amended language of the bill presented prior to the Assembly Appropriations Hearing Thursday can be found in my August 17, 2002 Report or at the legislative web site <http://www.sen.ca.gov. In spite of the number of opposition groups attending the Hearing the bill was moved to Suspense and was voted on later in the day. Still in opposition are California State Genealogical Alliance, Genealogical & Historical Council of Sacramento Valley, Bastard Nations and allied Adoptees organizations, California Newspaper Publishers Association, Axiom and California Bankers Association, along with First Amendment Coalition, CALI and several law firms. In fact, for the most part the author has made little headway in eliminating any of the opposition. Yet, the bill moves on. The vote in Appropriations included Assemblymembers Steinberg, Corbett, Goldberg, Washington, Correa, Negrete, Alquist, Diaz, McLeod, Wiggins, Aroner, Firbaugh, Pavley, Wright, Cohn and Simitian -- ayes. Noes included Assemblymembers Bates, Ashburn, Robert Pacheco, Daucher, Maldonado, Runner, Papan and Zettel. Assemblymembers Papan and Zettel are the only Democrats who have support us. The billl still contains a money issue of county's cost. This remain in the bill in spite of the author's objections. She stated that those cost were over estimated by the Dept of Health Services. But the cost figures remain. The bill no long require a two-thirds vote thought only a simiple majority is need for it to pass. The bill moved to the Assembly Floor on Second Reading on Saturday, because the author presented more amendments in Appropriations Committee. The amendments have now been included in the bill which can be found on the Senate web site. It requires that if you own the previously sold indexes, you have six months to remove the mother's maiden name on birth index and mother's maiden name and social security number on the death index if the indexes are on the Internet or open to the public. You will not be allowed to share this information under penalty of law. Legal counsel insists that the language is unconstitutional. It would seem that we are back where we began. The bill is scheduled sometime today on the Floor for a vote on the Third Reading, then it will go back to the Senate. I am getting conflicting reports as to if it will return to the Senate Judiciary Committee or not. It should, but I was told because it is so late, it could go directly to the Floor for a vote. That could be as soon as Monday. Now, I am sure you are confessed and wondering what is going on, well, so am I. Nothing with this bill is what it should be. At this point, I think our continued efforts to stop the bill should focus on the entire Senate, rather than just approaching the Judiciary Committee. That Committee includes Assemblymembers, Escutia the Chair, Kuehl, O'Connell, Peace and Sher, Democrats who all voted yes on the bill last time they heard it. The two Republicans Haynes the Vice Chair and Ackerman were no votes last time. I will bring you the list of the entire Senate below. LET'S LET THEM HEAR FROM US!
