WHEREAS by Indenture dated the ninth ----'---'-------------- day, of August 1921 and registered in the Registry Office for the Registry Division of Wentworth on the eleventh day of August -----------.---- 19 21 as No. 227542., Mary Bounsall, of the said City of Hamilton, Widow, did grant and mortgage· ALL AND SINGULAR th at certain parcel or tract of land and premises situate, lying and being in. The City of Hamilton in the county of Wentworth and being composed of part of Lot Number One Hundred and Forty on the east side of Catherine Street (formaly called Robert Street) adjoining the property formaly belonging to Myles O'Reilly Esquire in the survey of that part of the said City of Hamilton made for the late George Hamilton, Esquire which said parcel of land may be more particularly described as follows, that is to say:- COMMENCING at a point on the East side of Catherine Street at the southwest angle of said lot number One hundred and Forty! thence north along Catherine Street twenty-eight feet to a point; thence Easterly parallel to the southern boundary of said Lot Number One Hundred and Forty, eighty five feet to a stake planted; thence southerly parallel to Catherine Street, twenty eight feet to the southerly boundary of said Lot One Hundred and Forty; thence Weste! rly along said Southern boundary of said Lot Eighty-five to the place of beginning on Catherine Street. UNTO the said Annie Agnes Love, her -*----..---.----..~--. heirs and assigns for securing the payment of the sum of Two Thousand Dollars------,,,,,,, and interest at the times and in the manner therein set forth AND WHEREAS the time for payment of the said principal moneys has elapsed and the sum of Two Thousand ------Dollars remains unpaid AND WHEREAS the said party hereto of the Second Part has applied for an extension of time for payment of said sum upon the terms and conditions hereinafter set forth, and the said party hereto of the First Part has agreed thereto. NOW THIS INDENTURE WITNESSETH that in consideration of the premises and of the sum of one dollar to her paid by the said party of the Second Part She the said party of the First Part do the subject to terms hereinafter set forth, GRANT AND EXTEND to the Said Party of the Second Part time for payment of the said principal money so that the same shall become due and payable as follows: On the day of August 1932. the said part of the Second Part in the meantime and until payment of the principal money paying interest on the unpaid principal half-yearly on the ninth days of February and August, in each year at six and one half percent. per annum, as well as before maturity. The first such half yearly payments of interest to be made on the 9th day of February, 1930 : Agreement Extending Mortgage--p. 3. THE SAID party of the Second Part doth hereby covenant with the said party of the First Part to pay said principal money and interest at the rate and in manner hereinbefore mentioned, and to well and truly keep, observe, perform and fulfill all the covenants, provisions and agreements in said mortgage contained, and to keep the said principal money until the expiration of the said extended term. AND it is expressly declared and agreed that if at any time during the said term the said party of the Second Part shall make default in payment of the interest secured by the said Mortgage, or any part thereof, or in the performance of any of the covenants contained in the said mortgage, the extension hereby given shall, if the said party of the First Part so elect, become void, and the said principal money and every part thereof shall become due and payable, and the said party of the First Part shall be at liberty to take any proceedings She may see fit for the purpose of enforcing payment of the said principal and interest, or of the interest only, and performance of the said covenants in like manner as if these presents had not been executed. IT IS HEREBY AGREED AND DECLARED that nothing herein contained shall in any way affect or prejudice the rights of the said Party of the First Part as against the said Party of the Second Part, her heirs, executors, administrators and assigns, or as against any party to the said mortgage or as against any surety or other person whomsoever for the said mortgage debt or any part thereof or as against any collateral which the said Party of the First Part may now or hereafter hold against the said mortgage debt or any part thereof. AND it is further agreed and declared that these presents shall extend to, be binding upon, and ensure to the benefit of the heirs, executors, administrators, successors and assigns of each of the parties hereto respectively.
