There is a record in Johnston Co., NC exhibiting that THOMAS LEE, 19 Apr. 1771, signed his name as "Lt." under Col. Needham Bryan in the Johnston Co. Militia. THOMAS LEE appeared as "Capt." at a Court Martial held in Smithfield, 15 Aug. 1777. "A general Return of Officers and Men belonging to the Regiment of Militia in Johnston county commanded by Col. John Smith at a General Muster at Smithfield on the 14th May 1770 showing that CAPT. THOMAS LEE's company contained 64 men." This indisputably proves that "a" Capt. Thomas Lee was in Johnston Co. in the 1770's, which was prior to the advent of "a" Thomas Lee in Green Co., NC [later, Hawkins Co., TN]. Several land records in Johnston Co., NC also reference CAPT. THOMAS LEE: 21 Oct. 1782: Grant #573 to THOMAS LEE, 100 a. head of Watry Branch & White Oak. Warrant entered June 1779, surveyed for CAPT. THOMAS LEE. Chain bearers: William Lee, James Lee. (G-Ral 46, 153, File 2049 & Johnston Co. Deeds M-1, 364) 16 Mar. 1795: Thomas Lee, by his att'y., SHADRACK INGRAM, sold this to Samuel Avera, L25. Wit: James Lee, Thomas Ingram (Johnston Co. Deeds W-1, 70) NOTE KWG: THE NAME SHADRACK INGRAM HAD APPEARED IN THE WILL OF JOHN LEE, ESQ. OF JOHNSTON CO., NC, NAMED AS HIS GRANDSON AND WILLED 200 A ADJ. RICHARD INGRAM'S LINE AND JOHN LEE'S LINE, ALSO 300 A. ON WHITE OAK SWAMP AND A NEGRO CALLED JUDAH. THE NAME SHADRACK INGRAM HAD ALSO APPEARED IN A LETTER WRITTEN BY THOMAS LEE (AFTER LEAVING JOHNSTON CO.), REQUESTING THAT SHADRACK INGRAM COLLECT DEBTS OWED TO HIM & SEE THAT THEY WERE DELIVRED BY A SURE HAND (Aug. 19, 1797). IN THAT LETTER, THOMAS LEE ASKED TO BE REMEMBERED, "MY LOVE TO SISTER MARY BALINGR AND ALL INQUIRING FRIENDS..." MARY BALINGER WAS NAMED DAUGHTER IN THE WILL OF JOHN LEE, ESQ. IN JOHNSTON CO., NC. Still in Johnston Co., NC records: 21 Oct. 1782: Grant #976 to THOMAS LEE, 100 a. both sides WHITE OAK SWAMP - - own corner - - SHADRACK INGRAMS' LINE - - Lemuel Lee's line. Chain bearers: William Lee, James Lee (G-Ral file 2273 & Johnston Co. Deeds M-1, 453) 16 Nov. 1792: Thomas Lee "in Johnston Co." sold this to SHADRACK INGRAM "of the co.", L10, a grant to CAPT. THOMAS LEE. Wit: John Bryan, Nathan Allen (Johnston Co. Deeds S-1, 334) 15 Feb. 1784: THOMAS LEE of Green Co., NC, gave Power of Attorney to William Ingram and SHADRACK INGRAM of Johnston Co. Wit: Samuel Smith, Josiah Barns (Johnston Co. Deeds Trs-2, 319 & P-1, 202) THOMAS LEE, est. b. c1735, died 2 July 1816 Hawkins Co., TN (Noncupative Will in Hawkins Co., TN Bk. 1, p. 311 Hawkins Co., TN). The last wife of THOMAS LEE was Mary, widow of John Rains, and Mary was given the administration of the estate of John Rains, Feb. 1772 in Johnston Co., NC. (Court Records). Securities for her bond were Richard Ingram and Henry Rains. The will of MARY LEE, WIDOW OF THOMAS LEE, HAWKINS CO., TN written 29 Aug. 1818. Extrs: William Lee, Edward Lee. Wit: Jones Griffin, James Lee, David B. Cummings. To daus. Winifred Bailey, Zilpha Bailey, Mary Griffin - - her clothing. Remainder of estate to be sold and divided among all her heirs. In a suit filed in Chancery Court, Hawkins Co., Tenn., 23 May 1823, the nine heirs of Mary Lee were named: Henry Rains and the last eight children of Thomas Lee (i.e, those children by Mary) NEEDHAM, JOHN, WINIFRED, ZILPHA, WILLIAM, EDWARD, JAMES AND MARY. NOTES: WINIFRED (LEE) BAILEY b. 2 Aug. 1778, married WILLIAM BAILEY, son of Sarah and Thomas Bailey Killed in East Tenn. before 1816 After leaving Hawkilns Co., TN "Winey" Bailey was head of household on the 1820 Census of Shelby Co., AL (with son Thomas Lee Bailey &) others in house. ZILPHA (LEE) BAILEY b. ca 1780, married THOMAS BAILEY, s/o Sarah/Thomas. Zilpha b. ca 1780. Of Zilpha's thirteen named children (Letter to VA, 28 Jan. 1938 by P. H. Harris of B'ham, AL), Mary (Pollie) d. 1825 Shelby Co., AL. 1820 Cen. of Shelby Co., AL shows Thomas Bailey (head of house), (James Bailey) both over 21; 1 fem. over 21; 6 fem. under 21; 1 fem. over 21(sic) and 7 slaves. 1823, May 23, Hawkins Co., Tenn. Chancery Court: Thomas Bailey of Shelby Co., AL, husband of Zilpha (Lee), brought suit in the settlement of Mary Lee's estate. (Mary, widow of Capt. Thos. Lee).
