Partition - when direction for sale of premises proper although, there are contingent interests. Although there are contingent interests in real estate devised by will dependent upon whether children entitled to share may come into being, an order of sale in an action for partition is proper, when all the persons who have a present interest in the subject-matter of the sale are before the court, including the executor of the will who will receive the portions of such afterborn children in trust to be disposed of under the terms of the will. Appeal by the defendant, Edgar V. Lawrence, individually and as sole heir at law of Samuel R. Lawrence, deceased, from an interlocutory judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 18th day of April, 1905, upon the report of a referee, directing a partition and sale of certain real property. Charles L. Hoffman, for the appellant. De Lagnel Berier, for the respondent. W. H. Van Steenbergh, guardian ad litem of the infant defendant Katherine R. Neumann. Per Curiam : The judgment appealed from must be affirmed. It properly directs a sale of the property affected. It is perfectly obvious, under the proofs presented, that an actual partition could not be made so as to do justice to all of the parties interested. Under the judgment appealed from the plaintiff is entitled to an undivided one-fourth interest; the appellant, individually and as sole heir at law of Samuel R. Lawrence (who has died since the appeal was taken), is entitled to an undivided one-half interest; and the remaining one-fourth interest is held by Gaines Lawson, as executor and trustee under the last will and testament of Laura Lawson, deceased, in trust to pay the income therefrom, one-half to the defendant Katherine L. Neumann during her life and the other half to Lawrence M. Lawson during his life. The defendants Katherine L. Neumann, Lawrence M. Lawson and the infant defendant Katherine L. Neumann have an interest, either vested or contingent, in this remainder, but i! t is immaterial whether or not such interest be correctly stated in the judgment, inasmuch as none of them have appealed therefrom and this part of the judgment in no way affects or concerns the plaintiff. It is sufficient to say that a purchaser upon the sale will obtain good title inasmuch as there are now before the court all of the parties who at the present time have any interest in the subject-matter of the sale. (Code Civ. Proc. §§ 1557, 1577.) The "fact that there may hereafter be unborn children who might have an interest in the one-fourth interest or some part thereof now held by Gaines Lawson, as executor and trustee, conld not affect the title because "the person(s) first entitled to which or other virtual representative(s) whereof" are parties to the action. (Code Civ. Proc. § 1557, subd. 3.) The only appellant is Edgar Y. Lawrence The plaintiff, after deducting the costs and expenses of the sale, will be entitled to one-fourth of the proceeds, the appellant to one-half, and the defendant Gaines Lawson, as executor and trustee under the last will and testament of Laura Lawson, to the remaining one-fourth, the same to be held by him in trust and to be disposed of in accordance with the terms of such will. The judgment appealed from, therefore, should be affirmed, with costs to the respondent. Present - O'brien, P. J., Ingraham, Mclaughlin, Laughlin and Houghton, JJ. Judgment affirmed, with costs. All I know is that Gaines never talked about his family. Also when he applied for a passport and went on a trip to England he did not give the names of his parents. The connection to Burrell is that she was living next door to him in 1840 and was named Lawson. That does indicate that she was related in some way but it doesn't mean that she was a daughter. Instead, I have been working on the idea that she was closely related to John Lawson who was likely a son of Burrell. John Lawson bought land from James Willis in 1824 and that property was next to Burrell Lawson. John Lawson and a number of other Hawkins County Lawsons, including Clement, Washington, and Lacey Lawson, were found in Henry County, IN in 1830 and disappeared. John Lawson sold that land to Larkin Willis just before he moved to Henry County. It is possible that Piney was a Willis, step-Willis or close in-law of James Willis, or even the daughter or wife of John Lawson. I suspect that both Burrell and Piney were living with John Lawson in 1830 Henry County, IN. In the late 1850s, James Willis secured a prosecution bond for Piney Lawson in a lawsuit against someone for trespass. As far as I can tell, that is the only documented interaction between Piney Lawson and James Willis. Horace's father was Samuel Adam's Lawrence. My family has his portrait and his wife's Laura, dau. of Michael Kelley of Charleston, S. C. I haven't found out where the Milton comes from. I just started doing the tree this month. A distant relative has access to the diaries of Julia Lawrence, Horace's sister. They are a day by day account of her life and mention many family members. Lawson, his brother Eugene was born in 1870. He was buried in Congressional Cemetery by 3 June 1891, I have a receipt for the transport of his body to Wash. D.C. but it does not say where it came from. I was told he had died around the age of ten. The records of the cemetery do not show a death date for him but do for his mother. I have pictures of the tombstones and have been there. My grandmother Marie Lawson was buried there. Lawrence was 17, being born in 1879, when they sailed to England. I guess the best way to determind where Eugene died would be to look at the military records of Gaines Lawson and try to decifer from there. This seems closer to Eugene's age than Lawrence's? Gaines father is generally said to be James Willis. In a letter my Mother sent to a fellow researcher in mid 1970s. She wrote: "Malvina Piney Lawson (believed to be daughter of Clement and America Lawson,) never married. She had 5 or 6 children by Dr. Willis." The problem is, my Mother's research has been lost so there is not an iota of proof for her statements. Mom also did a lot of oral interviews with "the old folks at home." David Jones contributes to this site, look for his postings. He knows more about this family than anybody I know of. Also look for postings by Sam Lawson and Doug Jenkins. So Mike is your nephew, not your brother. Has anybody seen the headstone for Eugene? It might show his death date. The information below is an excerpt of a posting in 2005 by David Jones. Gaines Lawson sold some Hawkins Co., TN, property (actually registered) on July 23, 1872, in which he identified himself as Gaines Lawson, Capt. 25th Infantry, Brevet Lt. Col, US Army. The document was signed by George S. Anderson, Col, 25th Infantry, C N Gray, Adjutant 25th Infantry, Camp Pudra Pinta, Texas. He sold (actually registered) land again on July 29, 1881 (actually sold September 1875) in which he identified his mother as Malvina Lawson and implied that his sister was Jane Shanks. Malvina Lawson was [speculated to be] the daughter or daughter in law of Burrell Lawson. Census and deed records suggest that she was really a Willis--related to James Willis, and that she might have been the wife of John Lawson, who was likely the son of Burrell Lawson. No one in the family knew who Gaines Lawson's family was. He would never talk about it. Eugene Gaines Lawson was born in 1870 in Mississippi but he was in Ft. Duncan, Maverick, Tex. according to the 1870 census and he was 4 mos. old then. I was told that he lived until he was 10. He is buried in Congressional Cemetery, where there are 4 plots that Gaines bought for the family. His wife is there. He is in Arlington Nat'l Cemetery. Gaines and Laura had three children, Eugene, Katherine, and my grandfather, Lawrence Milton Lawson. I hope this helps. I am still trying to sort out who Gaines Lawson's father was. I hope to get some pictures and documents on my family tree this summer. Right now I am on my nephew's site because I am helping him. Gaines' mother, Malvina Piney Lawson, and my 2great grandfather(Banks Lawson)were either brother and sister, or first cousins. Malvina is usually said to be the daughter of Burrell Lawson, and Clement Lawson is her alternate father. Banks Lawson is usually said to be the son of Burrell Lawson, but my Mother was certain he was the son of Clement Lawson. I am a Kay, too, but usually go by Katy. Was Eugene a full brother to Lawrence? I have a difficult time finding Eugene in any records. When did he die? I am the great grandson of Rosa Lawson, the daughter of Micajah Cager Lawson and Annie Elizabeth Saylor. My grandfather was Roy Brock (deceased), her son with Eli Brock. I am looking for a photo of Rosa. I don't know if you are aware of the story but Rosa was murdered by her 3rd husband. My grandfather was at work and his half brothers John and Richard Haywood were home when she was murdered. He also tried/threatened to kill them and they ran from the house that day. My grandfather and John spent the next 45-50 years wondering what had happened to each other before John located my grandfather in the early 80's. Considering they had been separated for so many years, it was amazing that they were reunited. My grandfather had wanted a photo of his mother and they searched together but were never able to locate one. When I told John that I was working on this family tree, he asked if I had found one or would try to find one. John is not in good health and it is my goal to exhaust my resources to find him one. If you have one, I'd appreciate assistance with getting a copy. If you know of someone that may have one, please point me in the correct direction. Thank you for ! any assistance that you can offer. They were married 2 March 1883. Letha died in 1904 and David married Mary E Moore 20 May 1907, in Lebanon, Laclede, Mo. My info says David died 28 Feb 1920 and I don't know if he and Mary were married or divorced at that time. Hope this helps .
