    1. [KYWAYNE] Slaves filing lawsuit
    2. Laura L. Gibson
    3. Thanks everyone for your prompt replys in my query about slaves filing lawsuits. The one referred to as the Sidney Suit was the one I was hpoing to find some information on. I am planning to attend a Gibson reunion in Knox County, Ky this summer and then to Frankford for additional research. I am looking for information about William Terrell Mays and Nancy Gibson. I hope this lawsuit will shed some light on Nancy Gibson. Luv, Laura

    1. Re: [KYWAYNE] [CUMBERLAND-RIVER] slaves filing lawsuit
    2. In answer to whether a slave filed a lawsuit in a particular jurisdiction, one first must know WHERE and WHEN the alleged lawsuit took place. The key to finding out about this lawsuit is the Jurisdiction--that is, what county or State. Probably the fastest way to find out is to start one's research with the Family History Library Catalog on _www.familysearch.org_ (http://www.familysearch.org) Do a PLACE search. If you do not know the exact place, let's hope you at least have the State where the action took place. When you get the place, then look for the topic *Court records*. Each jurisdiction had its own system of courts. In some places, particularly Kentucky, the county court records are kept in Court Order Books. In Virginia, I believe they are called Order Books. But the action may have taken place at a higher court than a county court. Searching court records is going to be difficult, unless one is fortunate enough to have found that some dedicated genealogist-author has abstracted the court records. But there are also Courts of 'Appeal, etc. If the questioner is near an LDS Family History Center, I strongly suggest he/she obtain from that center a Research Outline for that particular State. There probably will be an explanation of what courts existed for that State. A reference book such as the several editions of The Source [perhaps a copy is at the Reference Desk of your public library--ask the reference librarian] may explain the various courts. For example, after the county courts will be District courts and so on--up the line. (One has to learn about the system in the courts at the time of the lawsuit.) If the questioner has greater details, a reference librarian at a Law Library [nearly every county has one such library] may be able to give some guidance. I wish the questioner some luck!!! Genealogy requires us to know a lot of details 1) Who 2) When and 3) Where and if possible 4) How and 5) Why??? We all have to learn to be detectives. The internet is NOT going to answer all the questions genealogists have!!! E.W,Wallace **************Biggest Grammy Award surprises of all time on AOL Music. 3. Laura: Find a law library with the title, Decennial Digest, and start with the vols from 1820 and work forward. Most appealed cases will be listed. Look under Kentucky by the name of the owner or "Estate of" or slaves or emancipation. They may be suing for their freedom if emancipated in a will and the provision was not carried out, or they may be suing as not Africans. My friend's family had to sue in Maryland and North Carolina for their freedom as they were East Indians from Mozambique who kept being held as slaves. Each time they sued they won their freedom. This can be traced for 100 years in the court records. Regards, Steven C. Perkins On Jan 25, 2008 4:58 PM, Laura L. 3. Laura, It might be, particularly since several counties were involved, that the lawsuit is filed in Frankfort. You would actually have to go to Frankfort to search the archives there, as I don't believe any of that is available on the internet. I'm going to have to make a trip there sometime myself to look for a criminal case that was tried in Madison Co. I was told those papers are filed in Frankfort. 2. Laura L. Gibson
    3. I have learned of a lawsuit that involved a family married into my ancestry line. This lawsuit was filed by a slave or several slaves against the estate of their "owner". All information I have concerning this has NO CITATIONS whatsoever. This apparently occured sometime between 1825 and the ending of the Civil War. I understand that the lawsuit lasted sixteen years. How would a "person of color" go about filing a lawsuit against their owner? Why would this be tried in several counties? Where do I start looking for this lawsuit?

    1. [KYWAYNE] be sure to change subject line when appropriate
    2. Marilyn Gregory-Fisher
    3. Please folks, be sure to change the "subject line" if appropriate when sending messages to the KYWAYNE or any other mailing list. Example: If you want to send a message with info on the 'Jones family', but you reply keeping the subject line 'Books for sale'.....people interested in your 'Jones family' might delete your message without reading it because they think it's about the 'books for sale'. Changing the subject line is easy and it only takes a moment. Thank you all for your understanding....and there is no need to reply to this email. 2. All, ??? This is my periodic fishing expedition for Wyatt Heniger. (Name spelling varies across census's and tombstone). I am looking for info on Wyatt (Wyott) born ca. 1862 Russell/ Adair/ or Wayne County... at least somewhere in KY Margaret Jane (?) born ca. 1849 Russell/Adair/ Wayne Co's allegedly married ca. 1879 (county unknown) I have been unable to locate a marriage record for them at the RC Courthouse. They appear on the 1900, 1910, and 1930 census's in Russell County. There is a daughter Ella, listed as living with them (Russell Co) in 1930 she is listed as Ella Popplewell age 28 with her son Larkin Popplewell. They are buried in the Concord/Flannagan cemetery. This is not meant as critism by any means, but why is a pass word necessary? It would seem to me that the more people who view a site, the more successful it would be, so why restrict it to those who know a password? Again, no critism intended, I'm just curious. ----- Original Message ----- From: "Susan Sinclair" <susanjsinclair@gmail.com> To: <kywayne@rootsweb.com> Sent: Thursday, December 27, 2007 8:23 PM Subject: Re: [KYWAYNE] Wayne County site password > Marilyn- > > Can I get in on this, too? > > Thanks, > Susan Christensen (Adkins, Cooper) > > > > On Dec 14, 2007 2:20 PM, Linda Clark <lindab1@highland.net > wrote: > >> Marilyn could you send me a password for the site also. >> >> >> "There are at least 2 Wayne Co MyFamily sites.
