    3. TIP #453 - THE MIGRANT PATTERNS Where did most of the original Kentucky settlers come from? White settlers began moving into what is now Kentucky in the 1770's while we were still a part of the state of Virginia. This was a result of Virginia issuing land warrants to the veterans of the French-Indian War and later the Revolutionary War. Settlers entered the state over the Wilderness Road and traveling down the Ohio River. The population was approximately a half a million by 1820 and then dropped below the national average as many of the Kentucky residents moved on to other states. It wasn't until the 1850 census that the government started keeping data on where our citizens had been born. By 1860 Virginia still ranked as the state of greatest movement into Kentucky, followed by Tennessee, Ohio, North Carolina and Pennsylvania. By the 1870 census, the greatest influx of new citizens came from Tennessee. One hundred years later, Ohio. If Kentuckians were leaving this state, where did they go? In 1850 they went primarily to Missouri and Texas. This pattern continued until about 1910 when the paths shifted to the northern states of Ohio, Illinois, Indiana and Michigan. Most of these shifts were because by the availability of good land, following by economic factors. What about the foreign immigrants? Kentucky ranks low in this regard. In 1850 there were 31,400 immigrants in Kentucky or 4%. This rose to 6.4% in 1869 with it peaking to 63,4000 immigrants in 1870. From that time, the immigrants decreased with 34,562 in 1980. French Settlements came about due to France's claim to the Ohio Valley on the supposed discovery of the valley by Rene-Robert Cavelier de La Salle in 1669 where he claimed in 1682 the entire Mississippi River watershed. However, the French didn't try to settle the area because the Iroquois Indians claimed it and the French claimed that the Kentucky furs were inferior to those farther north. But, by 1749 they became alarmed by growing raids beyond the Alleghenies by English traders, Gov. Gen Roland-Michel Barrin de al Gallissoniere sent 213 regulars, Canadians and Indians from Quebec to counter English claims to the Ohio and to protect the Mississippi corridor. This 4-month operation saw them crossing to the Allegheny; passing down to the Ohio to the Great Miami. But this didn't make much of an impact on the English and the Indians, for Indian irregulars destroyed the English-Indian trading center on the Upper Miami in 1752 and a chain of forts were establish by 1754 from Presq'Isle to the forks of the Ohio. The forts survived until British Gen. John Forbes sent an expedition and the Pennsylvanian Indians deserted and the French were forced to abandon, surrendering in 1763 to the English. The Americans owed a debt of gratitude to the French for their assistance during the Revolutionary War and many place names in Kentucky are in gratitude to their assistance - Versailles, Bourbon, Paris, Fayette, La Grange and Louisville.(Leslie Tihany, "French Legends Die Hard in Kentucky, FCHQ 55, April 1981.) German settlements were among the earliest in Kentucky. Isaac Hite was Isaac Hayd; he surveyed in Kentucky in 1773 and returned with James Harrod, founding Harrodsburg in 1774. Daniel Boone's companion (one of many) was German Michael Stoner (Holsteiner), a Pennsylvanian Dutchman. Matthia Harmon (Hermann) was one of the search party looking for Jenny Wiley in 1798. The famous Kentucky Rifle and the conestoga wagon were two of the contributions of the Germans. By 1790 only 14% of Kentucky's population was of German roots. Jefferson County was an area of a great number of German immigrants. Two Germans, along with others, laid out Lexington in 1781. The majority of German settlement was along the Ohio River. German editors such as Karl Heinzen became newspaper editors. By 1850 there arose an anti-German reaction, primarily by the Roman Catholic. In 1855, in Louisville, attempts were made by the Know-Nothing party to keep the Germans from being able to vote; this erupted into riots which killed many. During the Civil War, many Germans were recruited into the Army and contributed greatly to the battles of Mill Springs and Munfordville. Many Germans and German-speaking immigrants from Austria and Switzerland settled in the cities. Smaller numbers preferred the country areas. One Henrich Lembke, on orders in 1885 from the state, reported that he had found 13 colonies in Kentucky from Lyon County to Laurel County, with the heaviest settlement in Louisville, Covington and Newport. The anti-German settlement calmed down, William Gobel, son of German immigrants was elected Governor. Covington, Kentucky, the largest city in northern Kentucky, can trace many of its founders to the Irish and German. Louisville and Jefferson County is made up many immigrants from Scot-Irish, English and German descent, also many of Dutch descent. The first weekly edition of "Kentucky Irish American" newspaper was published in 1898 by William M. Higgins, of Louisville for its Irish descendants. Over the years, Kentucky has become, as all states have, a melting pot of citizens from all over the world. This has been just a birds-eye-view of the earlier times when Kentucky's frontiers were opened and with this, the cultures of many nations can be seen flourishing together. English, French, German, Dutch, Irish ... all blend in with those from the other countries to make Kentucky an area flowing with cultural diversity. (c) Copyright 14 Aug 2003, Sandra K. Gorin. There are thousands anymore it seems, thankfully! This will sound like an infomercial I know! My favorite website is ancestry.com. As you know, to gain access to all the files, there is a fee involved, some is free. I have found over the past couple of years that it is well worth the cost. I started out with a basic subscription, then added the U S Census Images and Indexes. Ancestry is constantly adding to this site and I have found a lot of illusive family members with this addition. Then I added the newspaper collection and that has paid for itself! More and more newspaper images are going on line weekly, and they recently added just where I needed help - Illinois. I have spent almost 3 weeks part time reading the papers and found over 1,500 references in the old papers that I had never seen and likely would never see. There is an advanced reader that allows you to go right to the spot where the name is shown, pan the page, print the whole page or just the article I need. It has been wonderful. To investigate for yourself, just go to acestry.com. Be advised that not all states' newspapers have been added yet and there still are very few KY papers on line. Another site I use rather frequently Family Search Internet Genealogy Service at: http://www.familysearch.org/ . This is the Mormon Church site It is a free site and easy to navigate. My third site is Gendex WWW Genealogical Index at: http://www.gendex.com/gendex/. This is a site maintained by Gene Stark, very easy to navigate and with a lot of family tree data.     3. Just a quick note before a little tip today. Once in awhile, one of the subscribers to the list sends in a query. This is a "closed" list meaning that it is not set up for queries. So, your posts to this list will not be seen by anyone. And now to a short look at Populists, Gold Bugs and Silver Democrats. The Honorable Mitchell Nance of Glasgow, KY, Judge of the Circuit Court, recently spoke to our historical society on a subject of which I was unfamiliar. I have since been trying to find more information on the subject as I found it extremely interesting. He spoke of the Gold Democrats, the Silver Democrats, and the election of 1896. As Judge Nance explained, the United States and Kentucky included was going through a transition between a strictly agriculture based economy and the new industrial growth in America. THE POPULIST PARTY was also known as the People's Party and was founded in Cincinnati, OH in 1891. Its platform was taken largely from what was known as the Farmer's Alliance. Candidates ran on all ballots from the Populist Party between 1891 and 1896 and it's main platforms included backing of direct election of the U S Senators, governmental regulation of railroads, free coinage of silver at a ratio of 16 to one with gold, free and unlimited coinage of silver, lower interest rates, labor reforms, and a graduated income tax. It originally was organized to help farmers in the south and west who were "particularly stressed in the 1890s by high interest rates on loans, severe drought in the Midwest, a high rate of foreclosure of farm mortgages, and unfair railroad shipping rates for their products. (http://www.learner.org/biographyofamerica/prog17/feature/essay.html) Here in Kentucky, many supporters blamed their hardships on a conspiracy of bankers and railroad millionaires from the east. The Farmers' Alliance had at first supported these independent candidates in 1890, S. Brewer Erwin, former president ran on the slate for state office later about 20 candidates ran. Only a few were elected, and they were failing in the governor's race. One of the strongholds of the Populists was in the dark-tobacco belt of western Kentucky. One candidate of the Populists was well-known Democrat William Jennings Bryan who was responsible for writing a majority of the platform. He was the orator at the convention where he gave what was known as the "Cross of Gold Speech." Populists tried to rally support from the Republican party but this didn't work and eventually the party faded away, holding on until about 1912. (See Bland, Gaye Keller, "Populism Kentucky 1887-1896", University of Kentucky, 1979. GOLD BUGS or the GOLD DEMOCRATS split with their own party over the silver issue in 1896. They supported the gold standard as the basis of our monetary system. They also called themselves the "New Democratic Party", held their own conventions and made their own nominations. Their candidate was John M Palmer, in 1896, who was a 79 year old Kentuckian. They criticized Bryan and most of the regular Democrats saying that the Populists "advocate a reckless attempt to increase the price of silver by legislation to the debasement of our monetary standard, and threaten unlimited issues of paper money by Government." (See URL above) SILVER DEMOCRATS was a term coming into usage due to the passing of the Sherman Silver Purchase Act during the administration of Grover Cleveland. It is shown below: Sherman Silver Purchase Act, 1890, passed by the U.S. Congress to supplant the Bland-Allison Act of 1878. It not only required the U.S. government to purchase nearly twice as much silver as before, but also added substantially to the amount of money already in circulation. The Sherman Silver Purchase Act (supported by John Sherman only as a compromise with the advocates of free silver) threatened, when put into operation, to undermine the U.S. Treasury's gold reserves. After the panic of 1893 broke, President Cleveland called a special session of Congress and secured (1893) the repeal of the act. (Free silver was the unlimited use of silver). William Jennings Bryan was an advocate of free silver. (See: http://www.infoplease.com/ce6/people/A0857392.html) Because of the conflict within the Democratic Party, the feuding between the Gold and the Silvers, the party was so split that the first Republican Governor of Kentucky was elected - William O. Bradley. He served from 1895-1899, a Garrard County native and lawyer. He was credited with suppressing the violence and feuding in Eastern Kentucky.     1. TIP #444 - A WALK IN THE WOODS - SURVEYING

    3. Before returning to losses in WW II in Kentucky, as promised, I'd like to take a look at the old surveyors. I have mentioned before that there was a tremendous amount of confusion after the end of the Revolutionary War when settlers started on their trek to Kentucky which was not even a state at the time. Surveys, land claims - all were confusing. Settlers would accidentally settle on someone else's claim, or build a cabin on land set aside for the Virginia soldiers. Property lines were poorly marked and likely, changed by an eager settler who wanted a piece of land that had already been claimed. Deeds were sometimes lost, mixed up in the recorder's office or never filed at all. The result was many bitter land squabbles, law suits and frustration. To the surveyor, Kentucky presented an awesome and fearful task I'm sure. Due to the physical layout of the land, they weren't facing thousands of acres of flatland ... Kentucky was an area of dense undergrowth, hills, creeks and Native Americans who didn't take too kindly to the white man's encroachment of their hunting grounds. Many wanna-be surveyors just couldn't understand the use of the instruments needed nor have a knowledge of plane geometry. Kentucky established in 1779-80 a land court to handle the conflicting claims and erroneous surveys, but it didn't provide any training for surveyors. Thus, the Virginia survey laws were used in Kentucky until 1794 - two years after statehood. Kentucky after 1792 was more concerned about establishing the true boundaries of the state than worrying about boundaries between settlers. I have written before in a previous tip about the problems and fights over the state boundaries. It is noted in the Kentucky Encyclopedia that "As late as 1990, boundaries were labeled "indefinite" on the topographical maps of the U.S. Geological Society." (page 862). Depending on the education of the surveyor, some surveys are beautifully done, accurate and easy to locate. Others are a nightmare. Some were so vague that for many years the land owners were not certain if they were clearing timberland on their land or their neighbors! Since many of the surveyors had to use trees marked with a slash as a property line, if he called a yellow poplar a white poplar or an oak a maple .... you can see what problem this might cause! Surveyors used as one of their instruments a "Jacob's Staff". This had been used as far back as George Washington and was the main surveying instrument. It was a one-legged staff on which was mounted an open-face brass compass. It could be tilted in order to balance the directional needle. They sighted through twin forks centered by hair-thin wires. It was light-weight, easily set up and taken down and was carried by the assistant surveyor. Distance measurements were taken in terms of "poles" A pole = sixteen and ½ feet long. Looped-wire chains were made up of sixteen inch segments; and the full chain was four poles in length. So, the surveyor had to hire chain carriers who couldn't be a 98 pound weakling! If you will use your imagination, you can easily see the problems with using these chains. (1) with the terrain in which they were working, the chain carriers couldn't just lay the chain out straight on the ground many times. They were going around trees, over brush, up and down hills. (2) the chain was dragged (snagging often I would assume!), and the wear and tear on the chain caused the "joints" or links to wear out and be inaccurate. Another dirty little secret of many of the surveyors in eastern Kentucky was their lack of even trying. Land was so cheap there that they didn't feel it was worth their time to spend much effort on surveying accurately. One surveyor, doing a conscientious job could not survey 500 acres in one day. Yet many of the surveyors did and just added the words which we've all seen so many times: "500 acres more or less". This was a legal protection for them but some surveyors really took advantage of the term! Today's surveyor is a far cry from the old timers. Modern tools, knowledge of the higher math, satellites ... although still a strenuous job, is a far cry from what these old-time surveyors lived through. But I wonder how many present-day surveyors would like to go back in time for a day or so and walk along side the surveying party? Picture for just a moment what it would have been like. The surveyor might have been a big man, attired more like an Indian than a white man. Long heavy britches to protect his legs against the undergrowth. Stout shoes (although some men wore Indian moccasins) to guarantee, hopefully, a steady step. A bag around his neck and shoulders containing his survey books. By his side trod the deputy or assistant surveyor. He might have been a younger man who was in training to become a surveyor himself. Eager, of quick step to keep up with the surveyor, carrying the priceless and scarce surveying tools carefully as they waded creeks, climbed knobs, thrashed through the underbrush. Axes were carried to make the slash marks in the trees or cut back brush so they could find their way. Food was a necessity as they might spend many days in the woods, or they might have relied on their hunting skills. Behind them were the chain carriers. These two men were normally neighbors or friends of the man having the survey done; they wanted to be sure the surveyor didn't stray into their land. Or, if there were no neighbors yet, men who had been hired by the surveyor to drag those painfully heavy chains. They might have plodded silently for miles, stopping only to catch their breath, check the compass or have some vittles. They heard nothing but the call of the birds, the howls of the wild animals, the gentle splashing of the creek ahead. Indians they never heard; they were the masters of silent movement. Ever alert as they walked or rested they sought a glimpse of the enemy. The gear grew heavier every step until they reached what the surveyor had been guaranteed was the beginning of the landowner's property. The settler likely met them there and showed the proof that he had been granted 400 acres of 2nd class land here. How would you have determined where to start? How much is 400 acres when you're staring across virgin timberland? Marking that first tree or piling stones up to make a marker, the men worked through the day. Trees were climbed to get a better view of what lie ahead. Mosquitoes stung. Flies darted around the sweating faces of the men. Rocks, hidden in the underbrush, tripped up the deputy surveyor causing him to sprawl across the rocky ground and blood spurted from his face. His face turned red in shame lest the surveyor felt him not adequate to the task. Indians popping out from behind a tree with tomahawks possibly drawn causing the party to retreat. Rest at night by a campfire with one eye open for danger. But the beauty of what they had seen that day could not be explained on the surveyor's page. Grasses so tall that it came up to the belly of their horses. Streams so pure that they gulped from its crystal goodness. Birds of every variety flying overhead with their encouraging song. Animals standing back from fear of the human form. Trees reaching to the heavens it seemed. They were where no man had gone before. This was, in the early days, their final frontier. TIP #443 - PRESERVING HERITAGE PHOTOS AND MEMORABILIA In May of this year, our South Central Kentucky Historical and Genealogical Society had as its guest speaker, Cheryl Denny, Scrapbook Archivalist at our local Scrapbook Village in Glasgow, KY. As most of our readers know, especially our ladies, scrapbooking has become the most popular hobby around; and can create memories for generations to come. Genealogists, whether professional or family researchers, know that one of the most important things we need to do is to preserve our cherished old photographs and clippings. Cheryl told us of several important things to remember. I would like to quote from Cheryl who provided this to me to share with all of you! "Acid and Lignin are the two worst enemies of archivalists. Acid "eats" at your photos and documents causing destruction. This can be helped by spraying articles with an archival spray. These sprays neutralize the acids in papers therefore making them last for years to come. One good spray in particular is "Archival Mist" available at most quality scrapbook stores around the country. Lignin is from the pulp of a tree and it causes the discoloration. We all have those "red", "yellow" and "green" photos from the past. This can be helped with a mist such as "Paper Bright" available along with the archival sprays. (Note: Cheryl explained that this will not remove the discoloration from photos already yellowed etc., but to prevent it on those photos that are still their normal color). When it comes to preserving and storing photos, articles, documents and such, be sure to use acid free, lignin free and buffered papers, adhesives, and any embellishments as well as pigment inks, chalks and PVC free storage. Using these quality materials will assure your precious memories, legacies and heritage items will last for many generations to come. If you find articles stuck tight in old albums, have no fear...there is a way! Using an adhesive neutralizing product such as UnDu, you are in the preserving business. A few drops on the attached tool and a slide under your photos will take up your photos without any damage being done to them. This product is one you will want to make sure to have on hand when removing items. As you know, our hands contain acid. You should handle items for preservation with gloves if possible. There are some wonderful items available to help if you can't use gloves. Most scrapbook stores carry a soap, wipes, or lotion to clean your hands with before handling your photos that neutralizes the acid on your hands for up to two hours. When cleaning photos, removing fingerprints and smudges, microfiber cleaning cloths are wonderful! These lint free cloths are made with special micro-soft fibers that so there is no streaking or scratching." Two things that Cheryl stressed was not using rubber cement (oh boy, we were told all these years that this was what we should use!) and that we shouldn't use ball point pens to mark on our photographs. Instead you need to use a permanent, photo-safe, acid-free, waterproof pigment pen. You can find these supplies at most art or scrapbooking stores near you and maybe some of these tips will help preserve your wonderful memories. I know it's a lot better than having them all in a shoe box as I'm afraid most of us have done for years!     1. TIP #441 - THE FINCASTLE SURVEYS

    3. As you well remember, before 1792, there was no Commonwealth of Kentucky. The lands lie in Virginia and the last county claiming our lands was Fincastle County, Virginia and Kentucky was also known as Kentucky County, Virginia. In April of 1774, a group of surveyors headed out to begin surveying the area that would many years later end up as the original three counties in Kentucky. Some of the Fincastle surveys laid outside of Kentucky, but for the major part, the men appointed were tromping through the wilderness areas seldom seen by the white man. It must have been an awesome task; even more desolate than when settlers started coming into Kentucky en masse after the Revolutionary War. Only a few brave souls had been in our land and the surveyors were met with challenges every step of the way. Surveyors included John Floyd, Hancock Taylor, James Douglas and Jesse Hite who departed from Smithfield, Virginia and began their trek by boat down the Kanawha and Ohio Rivers. At every spot along the way, they sketched out their surveys with the help of their work crew. Can you imagine the excitement, fear and wonder these men experienced? Trees so thick it blotted out the sky. Rivers and creeks so pure that one could see to the bottom? Animals of every variety and always the illusive Native American who might be around the next bend. The men reached the Falls of the Ohio on the 28th of May, a long trip already. Fatigue must have overcome them at times, but the lure of the new lands pushed them on. Twenty-eight surveys were done after their arrival at the Falls covering 40,000 acres. This would encompass the present-day city of Louisville running south to the Watterson Expressway and east to Anchorage. On June 3rd the surveyors split into two groups - one headed by Hancock Taylor. Taylor surveyed the area around Harrodsburg and then moved over to near Frankfort on the 17th. John Floyd, leader of the second party, rejoined Taylor on July 1st and they camped near present day Midway, KY. Now they split into 3 parties with James Douglas and Isaac Hite in the third group. Floyd surveyed the North Fork of Elkhorn; Taylor went along the South Fork of the Elkhorn and Douglas along Jessamine and Hickman Creeks. Sixty-two surveys were completed here for about 113,000 acres. Remember now, they didn't have the fancy tools that surveyors do today, these were men on foot carrying heavy chains, marking the lines of each survey by cutting slashes in trees to mark the boundaries or piling rocks up with a notation on it. Long, arduous work. An Indian attack on July 8th stopped any plans of the men reuniting at Harrodsburg and the men started for home by different routes. Two men were lost on the 27th when Indians attacked Taylor's group and killed he and another man. To the remaining surveyors and their crew came to rescue the noted Daniel Boone and Michael Stoner, scouts sent out by Virginia for this very purpose. Floyd and his companions came back by following an Indian trail that led up the North Fork of the Kentucky River and through the Pound Gap. Douglas' group paddled their way home in a small canoe down the Ohio and Mississippi Rivers and then catching a ride on a ship headed to Virginia. The weary men who had survived returned to Fincastle County and presented their surveys - likely water soaked, perhaps blood stained and ragged. The survey work did not stop with these four men however; surveyors continued to come into Kentucky during the years 1775 and 1776 until finally over 206,250 acres had been surveyed. These were primarily done on the old military warrants from the central part of the state. Further information can be found in an article entitled: "Fincastle Surveyors in the Bluegrass, 1774" by Neal Hammon, found in the Kentucky Historical Society Register 70, October 1972. What was involved in these Virginia surveys? Virginia had to do something - after the Revolutionary War, settlers began flooding into the Kentucky County area, primarily since Virginia had paid its soldiers by giving them land there. Many of the surveys were totally inaccurate and were known as "tomahawk surveys" or what Henry Clay called "fireside surveys." It caused problems for Virginia and later Kentucky for many years. The original surveyors came out of William and Mary College which the guidelines for surveying had been designed. After Kentucky statehood, Kentucky set forth its own rules and regulations for "ascertaining internal land boundaries and property recording and determining the validity of warrants and deeds." With the 2nd Kentucky Constitution, each county was to submit the names of two proper persons, who, with the consent of the Senate, one was appointed a county surveyor. If no one's name was submitted from a county, the Governor submitted a name and was approved or disproved by the Senate. It was not until January 1814 that the Kentucky General Assembly finally specifically outlined the requirements for surveyors. To be continued with more details of how the surveys were drawn. Before I start on the next list of soldiers killed, I'd like to add a couple of notes. On an old post I listed the Kentucky soldiers who died at the Andersonville Prison during the Civil War. Kathi Hodson Morse asked me add the name of HENDERSON GEARHART who was from Floyd County. Also another soldier killed during WW II from Hart Co who was not on the list: HAROLD DELTON THARPE. He was shot down in Vienna, Austria, assigned as a PFC 449 AAF Bomb Company, 717 Bom Squadron, 449 Bomb Group.     3. TIP #439: KENTUCKY'S FOUR CONSTITUTIONS Just a short tip for today about Kentucky's constitutions. We are blessed in America to have had a constitution that was so well thought out and inclusive, that we are still living under it. However, Kentucky has gone through four constitutions during its statehood in 1792. There were constitution of 1792, 1799, 1850 and 1891. The first two constitutions were fairly well based on the United States Constitution. The first one, penned in 1792, was barely more than a brief document laying out the establishment of a tripartite government; a bicameral legislature and a bill of rights for its citizens. It allowed the House of Representatives to be elected by popular election and the governor and Senate elected by a body of electors. The constitution of 1799 kept most of the 1792 constitution but added the abolition of an electoral college and allowing popular vote; created the office of Lieutenant Governor; gave more power to local governments; increased the power of different agencies that were responsible for taxation; regulated business. But, the free blacks lost the franchise they had had since 1792. The 1850 Constitution was much lengthier. The major changes included setting the judiciary to serve fixed terms; changing the General Assembly (which had greatly abused its powers). It limited the legislative sessions to sixty days unless a 2/3rds vote over-ruled this. It protected the money set aside for debt repayment (called a sinking fund), set up the publiceducation system reaffirmed slavery, and added the requirement for office holders to swear that they had not participated in a duel. The latter is still a requirement in KY!. Another major change was for judges, sheriff and the majority of local office holders to be elected for fixed terms instead of appointed. The 1891 constitution lost control over executive officials by addting two elective independent constitutional executive offices (up to 11). The General Assembly was limited to the 60-day sessions every two years. Appropriations were subject to a gubernatiorial line-item veto. Fiscal restrictions ewere placed on local governments and corporations operating in the state. For all it's good points, historian Thomas Clarke and others have noted that it has limited the ability of state and local governments to provide services.     3. It has been a long time since I showed a list of unusual occupational names. If one searches the internet or refers to various books written on the subject, one could accumulate literally thousands of job titles from the olden days - most of which could be found in Kentucky as well. Below will be the start of another list of old occupations you might see on the census and were afraid to ask what they were! ALE FOUNDER: official who tested the quality and measured the ale served in inns and taverns. ALE DRAPER: One who sold ale ALE TASTER: One who tested ale and beer for quality. Old English term. ALE TUNNER: Filled ale casks (tuns} with ale ALEWIFE: A woman who kept a tavern ALL SPICE: A grocer. AMANUENSIS: A stenographer/secretary. ANKLE BEATER: A young man who assisted in driving cattle to market. ARKWRIGHT: A craftsman who produced "arks" which were wooden chests or coffers. BACK'US BOY: kitchen servant who worked in the back of the house. BACK WASHER: cleaned the wool in the worsted manufacturing industry BADGER - licensed pauper who had to wear a badge with the letter P on it. He could only work in Approved areas.     3. To take a week's break from the World War II casualities, I wanted to revisit the complications that arose in the early settlement of Kentucky when it came to land claims. If you become confused, you are not the only one and we can blame it on Virginia! Now Virginia was a good state; no complaint there. But when Kentucky reached statehood in 1792, the new Legislature chose to follow the same land laws as Virginia and it surely caused a lot of confusion. Four steps had to be followed to obtain land in Kentucky. (1) Obtain a warrant; (2) make an entry; (3) have the land surveyed, and (4) return the survey and the entry to the land office. Then the land office would issue a patent which was supposed to be totally binding, known as "absolute verity." However, the oft laid plans of mice and men often go astray they say, and with each of the four above steps came chaos, law suits and a lot of headaches. The state issued warrants with such abandon that if one counted up all the acreage allotted, Kentucky would be many times the size it truly is. Acreage flew from the pens of the powers that be with such speed that more acres were awarded that were ever contained within the state boundaries. Some people were allowed free warrants of course. Veterans of the Virginia and Continental Armies could apply for military warrants ranging from 100 to 5,000 acres depending on rank. Settlers who convinced immigrants to come to the "western frontier" could apply for free land by "importation rights". Settlers who came to Kentucky and erected a building or cleared off land for settlement were awarded "preemption" warrants. Poor settlers could obtain their land warrants on credit. And, finally, other settlers could purchase treasury warrants that cost 40 pounds for 100 acres. Imagine the bookkeeping - imagine the errors! Once a settler obtained a warrant, he took the warrant and filed with the county surveyor. He gave the surveyor information such as the acreage and the location. It was the latter that caused so many headaches since, again following Virginia tradition, land was marked off by nearby streams, trees, rocks, neighbors and buildings. The streams stayed pretty well where they were, but trees were cut down or died, rocks were moved when clearing the land, neighbors moved and buildings fell down! Thousands upon thousands of lawsuits were brought over boundary disputes. Original neighbors were tracked down to verify that he always knew a certain tree to be a boundary line ... it was a true nightmare. Once the surveyor had the information, he was required to go out and find the land (not an easy task!) and survey it according to the true meridian rather than the magnetic meridian. Another problem. The only surveying tools available at this time were magnetic measuring tools. So, unless the surveyor was gifted in astronomy or higher mathematics; he often got the measurements wrong. Plus, Kentucky at this time did not require much of their surveyors in the way of education (Virginia did). According to an old unknown quote found in the Kentucky Encyclopedia, "Kentucky surveyors were never correct, except by accident." The next step for the surveyor was to mark the lines "upon the ground". Can you imagine the poor surveyor with his chain carriers, neighbors and assistants, plodding through the undergrowth trying to find the land the settler had described? Fighting the elements, animals, Indians and fatigue, this was not an easy task. But, by law, he had to complete all the maps and any notes he had taken in one year or less. There were exceptions here too - if the warrant holder was an infant, a captive, a married woman or insane, the time limit was altered. If all went well, the land office would issue a patent and the survey was entered on a map. Next problem. There were no accurate maps of the area and accidentally, the land office would issue multiple patents to the same tract of land to more than one person. It was a heart-breaking time when a settler found that, after going through all the steps, being issued a patent, clearing the land, chopping down trees, building a cabin and out buildings, bringing the family there to their home in paradise to later find another family pulling in with a wagon, screaming children, chickens and cows holding a patent to the same acreage. More law suits. What could the settler do? Of course, sue the state. The State of Virginia General Assembly had created the first land court of Kentucky in 1779. Their function was to "bring about adjudication of the woefully confused situation of land claims in Virginia's Fincastle County [Kentucky]. Commissioners had been appointed including William Fleming, James Barbour, Samuel Lyne and James Steptoe. They held their first meeting at Logan's Station in October of 1779. It met until April 1780 and settled 1,328 claims for 1,354,050 acres of land. This is just a brief look at why it was so difficult to even get settled in Kentucky; there were many other difficulties of course. Some involved settlers being allowed land in restricted districts - the land set apart for the soldiers of Virginia and the Continental Army. If it was found that the land they had worked so hard on was in the military district, they were allowed to move to another area of like size that had not been claimed - a wonderful offer - but think of all the work they had done to be left behind and start all over again.
