Nicholas County, Kentucky Deed Book N page 147 This Deed of Conveyance made and entered into this day of June 1836 Between Harry Buckner & Betsey his wife, late Betsey Holladay, George Talbott & Nancy his wife, late Nancy Holladay, Benjamin Holladay, James Holladay, Joseph Holladay, Jesse Holladay, David Holladay, Andrew Holladay, Clarissa Holladay, and Mary Frances Holladay, children & heirs of William Holladay, deceased, By Moses Hopkins a commisioner appointed under an Interlocutary Decree of the Nicholas Circuit Court, at the last March term thereof, authorizing him to sell & convey 204 acres of land which descended to the aforesaid heirs from their said ancestor and also their interest in & to 85 acres of land which was allotted to Peggy Holladay widow of said decedent as her Dower interest in said landed estate of sd. William Holladay decd. at her death making in all about 289 acres of land which the said William died seized & possessed of in Nicholas County on the Brushy Fork, upon petition filed in the Nicholas Circuit Court for that purpose of the one part, and Thomas Holladay of the other part are of Nicholas County & State of Kentucky. Witnesseth: that whereas upon the filing of said petition as aforesaid and aproper cases(?) having been presented to the Nicholas Circuit Court under the statutes of Kentucky authorizing the sale of Infants real estate, and the court having decreed a sale of said estate, to take place at the court house door in the town of Carlisle upon a court day, to the highest bidder after the same had been duly advertised in pursuance of said Decree, upon a credit of one, two, & three years in equal instalments, requiring bond & approved security of the purchaser. The said Thomas Holladay being the highest bidder at Eighteen dollars 12 1/2 cents per acre became the purchaser on the 23rd day of May 1836, that being the day upon which said estate of land was exposed to sale. Now the said Hopkins as commissioner aforesaid and by reason of the Authority vested in him, For and in consideration of the sum of Five thousand two hundred thirty eight dollars 12 1/2 cents that being at the rate of $18, 12 1/2 cents per acre and by reason of the premises aforesaid, does by these presents sell and convey unto the said Thomas Holladay his heirs and assigns forever the aforesaid tract of land and premises, containing about 289 acres situate as aforesaid & Bounded as follows, to wit Beginning at A a white oak in Hawe's line corner to William Holladay, thence with his line South 45 W 36 poles to B a stake, thence S 19 E 40 poles to C a stake thence S 57 1/2 W 44 poles to D three Black Locusts at a spring, thence S 24 E 22 poles to E a stone corner on the Brushy fork, thence down the same S 66 W 12 poles to F a stone thence S 2 W 45 poles crossing the creek to G a Black ash on the South side of the creek then S 19 W 20 poles to A a large sugartree on the South side of the creek & above the cool spring thence S 45 E 8 1/2 poles to a stone then S 45 W 114 poles to an Elm & Sugartree Saplin, thence N 45 W to one of William Holladay's original corners Thence N 45 E with his old line to another of said Corners Thence N 45 W with another of his lines to the corner Thence N45 E with another of the said Holladays lines to the corner thence S 45 E pursuing said lines to the Corner, thence N 45 E with his said lines to N in Haw's line a Hickory, Ash, and Hackberry, thence with said line S 45 E 104 poles ot the beginning. To have and to hold the aforesaid tract of land and premises with the appurtenance unto the said Thomas Holladay his heirs and assigns, the aforesaid heirs of William Holladay decd by M. Hopkins a Commissioner appointed as aforesaid will warrant and forever defend against all persons whatsoever claiming by through or under them in as full and ample a manner as they are vested with said title. In testimony whereof the aforesaid heirs by M. Hopkins, a Commissioner appointed as aforesaid have hereunto set their hands * seals the day and date above written. Lewis H Arnold
