Marriage Book B, pp. 191-193 MCCLURE - CLARK This Anty Nuptial contract made and entered into this 28th day of April 1858 between William McClure of Boone County, State of Missouri of one part and Eliza Clarke of Mason County, State of Kentucky of the other part witnesseth that whereas a marriage is contemplated between the partie above named, they jointly and severally agree before the consumation of the marriage that the following arrangements and agreement shall bind them, their heirs, executors, administrators and assigns forever, viz: the said William McClure releases and forever quits claim all rights, titles, or interest that he might or could have in or to the present estate and property of the said Eliza Clarke real, personal or mixed and agrees that the same is and shall be during her life and through all time to come free and clear from all claim or claims, by, through or under him, his heirs & forever hereby setting the same apart as the sole and seperate property and estate of the said Eliza Clarke and in! order to efficiency in carrying out the objects and intentions of the parties hereunto the said William McClure and Eliza Clarke do hereby nominate and approve Abner Hord of Mason County, State of Kentucky, agent and trustee to manage and control the seperate estate of the said Eliza Clarke in the county of Mason and elsewhere and all the property of the said Eliza Clark is hereby vested in the said trustee for the use and benefit of the said Eliza Clark and he shall have full power in the premised to control the same for the purposes aforesaid, and it is distinctly understood that any money or property delivered to handed over to the said Eliza Clarke at her request and receipted forever shall be a clear release and discharge to the said trustee for the amount that delivered or paid over. And the said Eliza Clarke for herself, her heirs and assigns hereby release all claims that she might or could have upon the estate of the said William McClure in consequence of the ma! rriage aforesaid and the same is to pass immediately to the heirs &c o f the said William McClure without any claim by thought or under the said Eliza Clarke her heirs &c forever, as though no marriage had been consumated. In witness whereof the said parties have set their hands the date herein first mentioned. William McClure Eliza Clarke Thomas Forman Jno. B. Herndon State of Kentucky Mason County I, Robert A. Cochran clerk of the County Court aforesaid do hereby certify that the foregoing Ante Nuptial contract between William McClure and Eliza Clarke was on 21st day of May 1858, produced to me and proved to be the act and deed of the said William McClure and Eliza Clarke by the oath of John B. Herndon and on this day the same way again produced to me and proved to be the act and deed of the said William McClure and Eliza Clarke by the oath of Thomas Forman (both subscribing witnesses) and lodged for records: Whereupon the same hath been duly admitted to record in my office. Given under my hand this 9th day of August, 1859. Robt. A Cochran, Clerk State of Kentucky Mason County I, Robert A. Cochran Clerk of the County Court of the County aforesaid, do certify that the foregoing is a true and complete copy of what is purported to be as the same remains on record in our office. And I further certify that the same is in accordance with the law of Kentucky. In testimony whereof I have hereunto set my hand and affixed the seal of said court.
