    2. Morning All, After your visit to Jessamine County last year, the Withers Public Library ask me if we were going to do it again, and if so, how could they help. I ask that they buy book for research. I picked out some that I taught would be of interest to you. I was in the Withers Library yesterday, and guess what? They bought the full set of Fayette Co., Records, 5 Volumes. As you may know, Jessamine County was separated from Fayette County in 1798. We have about 25 years of history in this county that we have no records. You may call this set of books "The missing link." I look around the library and seem they had purchased some other book on Jessamine County. I had not seen these before. I feel that this was a very kind thing for them to do. The Withers Library has a Web-Site. http://www.withers.org Would you please take a moment and drop these folks a line and thank them. After all, this was done for you. Everything set to go on this end for the Jessamine Co., Heritage Fest in May. P.S. Don't forget to sign up for the boat ride.     3. Dear Clyde, I'd certainly be interested in the photos. I heard about this house and the grounds years ago from a gentleman who had lived there at one time and maintained the graves. The Naves were Swiss, coming through Germany to America. The name was originally Naf (with an umlaut over the a) in Switzerland, then Naef in Germany and many of that family are known as Neff here in the states. Some also spelled it Knave (particularly in Ohio). Thanks so much for finding it, and sharing all your research in Jessamine County with us. As I may have told you, we have been going around taking pictures of old houses and site of Jessamine County. I came across something the other day, I felt may be of interest to you. I was driving out of Nicholasville the other day, and spotted this large brick house setting some distance of the road. I had pass it several time, and taught about stopping and taking pictures. But never did. I decide this was the day and turned into the drive way. A very nice lady owned the place and invited us in. After a bit we walked out into the yard. The are several log buildings about the house. One pricklier log building caught my eye. I had never seen anything like it. The lady said it had been use as a slave quarters. Martha Patsy Webster was b. abt 1800 in Ky and d. 1875 in Mo. John Pemberton was the son of Stephen Pemberton b. abt 1761 in Va d. 1849 in Mo. He married a Sarah Rutherford in 1794 in Lincoln Co. Ky. Sarah Rutherford was b. abt 1767 in Lincoln, Co. Ky and died 1842 in Mo. I am wanting to know if John Pemberton and Martha Patsy Webster had any children between the time they married and 1825. The first child I have for this couple was a daughter born abt. 1826 in Ky. I am also attempting to tie in a possible son, Stephen Pemberton b. abt 1823 in Ky, and any other siblings before 1825. He married a Sarilda/Sarah Crow, born abt 1826 in Jessamine County. George McCune's brother, Joseph, married Sarilda's sister, Martha Jane Crow, also born in Kentucky, possibly Jessamine County. George and Joseph also may have had brother John/James McCune and a sister, Mary A. McCune, all born in Kentucky. This family moved to Howard Co. Missouri between abt 1848 and abt 1850.     2. Morning all, I was in the Jessamine County Courthouse yesterday, taking pictures for a presentation I am put together to show you in the up coming Jessamine County Heritage Fest. I happened to think of some old book I that had seen many years ago, up in the attic of the Courthouse. The last time I had seen them they were just scattered on the floor in the attic. The birds and the bats had them in pretty bad shape. I found my young friend Bobby, who takes care of the Courthouse and ask him if he would take me up in the attic. He said he would be happy too. We wound around the steep stair case that leads up into the bell tower. That old stair case seemed to be a lot steeped, and a lot more steps than I remembered some 25 or 30 years earlier. I couldn't tell witch squeaked the most, me or the old stair. When we got to the top of the stairs, I was delighted. Those old books that I had worried about all these years were stacked neatly in a little room, someone had build. I spoke with Eva McDaniel, our County Clerk yesterday. You didn't get to meet her last time, she was out of town. But, she will surely be there this time. Every time I go into the County Clerk's office, the folks there ask me when you are coming back. You made quite a impression. The old Estate Settlements have been moved, and you will have lots of room to work this time. I need you help. Our next April meeting of the Jessamine County Historical Society will be our last before you get here. This will be the last opportunely that we have to have everyone together. We would like to have some idea on how many people to plan for. They have already told me, I will be made to eat all the food that is left over. That's just their way of keeping me on my toes. So please, try to let Shelia know before April 26, that you are coming. This is not a cut off date. Their will be on cut off this year. We just need to know about how much food to order. The ladies want to bake some more of those cakes you like so well. We are counting on some of you to help with the planning and work. On Monday morning, May 21, at 8:00 o'clock, we would like to get together with a some of you to make a few final plans. We feel that this will make the Jessamine County Heritage Fest a greater success. Don't forget to sign up for the boat trip. This boat trip, on the Kentucky River will be sponsored by the Jessamine Co., Kentucky River Task Force and the City of Wilmore. Don't miss it. Don't forget to bring you cameras.     2. For those of you not familiar with the cemetery ordinance that was passed last year, here is the actual ordinance. Howard Curry Teater is actually the driving force behind getting this ordinance passed and enacted, as it has been his life's work to catalog and preserve all those old cemeteries. During our first gathering last year in Jessamine County, we all wanted to help in whatever small way we could, and supported Howard, Clyde and the others in Jessamine County, with our letters to the newspaers, elected officials, etc. After the assistance and hospitality we had all received from them, it was the least we could do and still will never thank them properly. Those of you who plan to attend this year, will be able to see first-hand, why saving these old cemeteries is so important. As Spring is rapidly approaching, I can only imagine the beauty that awaits all of us in Jessamine County in May. Hope to see you there. Shelia Below is the ordinance that was passed: JESSAMINE COUNTY CEMETERY ORDINANCE 3.9 CEMETERIES The intent of this section is to establish guidelines for developing or dividing land with cemeteries, and the general upkeep and security of inactive and private family cemeteries. Nothing in this ordinance shall exempt a property owner, developer of the Planning Commission from applicable state statutes and regulations (KRS and KAR). A parcel of land on which an inactive and private family cemetery is located may be used as allowed by the site’s zoning classification and other applicable regulations. Relocation or removal of grave sites shall be allowed only under applicable Kentucky Revised Statutes and Kentucky Administrative Regulations. 3.9.1 Preservation: Ownership of Cemetery on Tract Proposed for Development In preserving a cemetery, while at the same time developing or dividing a parcel, an applicant shall follow one (1) of the following options: a. Transfer the existing cemetery as part of a buildable lot. Ownership and maintenance of the cemetery would be left to the individual lot owner. b. Make the existing cemetery a separate lot. Ownership and maintenance of the cemetery would be assigned by written agreement with either the original owner of the cemetery, subdivision Homeowners Association, the developer of a subdivision, a local legislative unit, or an historical organization. c. In all of the above options, the developer and/or owner(s) shall comply with Section 3.9.2.(a)-(f). 3.9.2. Preservation and Maintenance These requirements shall be followed if a developer or property owner wishes to preserve an existing cemetery, while at the same time developing or dividing their property. The regulations outlined below apply only to private inactive family cemeteries and not to active cemeteries where grave sites are clearly identified by Planning Commission Staff. Any waiver of these regulations must be requested from the Board of Adjustment. If a private cemetery exists on a parcel of land and the exact location of grave sites is not able to be determined, or a cemetery is discovered during construction, a developer or property owner is advised to follow the procedures and guidelines stated in Section 3.9.3. a. Cemetery boundaries shall be established by the developer and submitted to the Architectural Review Board for approval. Request for approval should include evidence of location such as fences, walls, grave stones, natural features or recorded documents. If sufficient evidence for location of cemetery boundary does not exist then the Architectural Review Board may require developer(s) to have a professional archeologist view the site and make a determination as to the boundaries and potential number of grave sites. <BR> (1). No new structure or building addition shall be built within 30 feet of an existing private family cemetery regardless of adjoining property lines or land ownership. This 30 foot limitation is also required regardless of whether the cemetery is part of a building lot or is conveyed as a separate lot. The 30 foot limitation shall be in the form of an exclusive cemetery easement. (2). No grading, excavating, paving or land disturbance shall be allowed within thirty (30) feet of a cemetery. b. Developer shall repair or replace any existing cemetery fences or walls. Stone or masonry fences shall be replaced with the same type or suitable material. Existing cemetery fences or walls shall be repaired or replaced at time of development or prior to Final Plat or Final Development Plan approval. c. Developer shall be required to construct a new fence if one does not exist at time of establishment of cemetery boundary. Fence material shall fit with the character of the proposed development. The following materials are acceptable: Stone, Brick, Ornamental Iron, pressure treated wood (picket or plank constructed) with a quality of workmanship and material the guarantees a life expectancy of 20 years. d. At time of construction of new fence, dead or decaying trees and heavy underbrush shall be removed from the cemetery. Remaining trees shall be pruned to a height to create a clear vertical view of 8 feet. Ground cover shall also be established at this time. e. A statement by the property owner, applicant or developer shall be made on the Development Plan or Division Plat regarding cemetery ownership and maintenance. f. A Certificate of Land Use Restriction, Cemetery Easement and a Deed Restriction shall be recorded in the Jessamine County Clerk’s office acknowledging the location, size, ownership and maintenance of a cemetery. This information shall also be recorded on the Final Development Plan, and the Final Plat for a subdivision if not yet recorded. g. Public or controlled access shall be provided by the developer or owner to the existing cemetery with a minimum five foot wide recorded ingress/egress pedestrian Cemetery Access Easement accessible from a public or private street within the development. The recording of the Cemetery Access Easement shall follow the same guidelines in 3.9.2.(h). 3.9.3 Cemetery Preservation, Relocation and Discovery Procedures In order to assist property owners or developers in their cemetery preservation or relocation work, the following procedures and guidelines shall be followed. These procedures or guidelines are to be followed by each property owner or developer and shall be enforced by the Architectural Review Board and the Zoning Enforcement Officer. The procedures are based upon either cemetery preservation or relocation plans. a. Preservation of Existing Cemetery: If a property owner desires to preserve an existing cemetery while developing or diving his or her own property, then the property owner shall state his or her intent to the Architectural Review Board and the Jessamine County/City of Wilmore Joint Planning Commission in writing and follow the lot and maintenance requirements as stated in these Regulations. b. Relocation of an Existing cemetery: If a property owner desires to relocate an existing cemetery with advice from the Architectural Review Board, then the property owner shall state his or her intent to the Architectural Review Board and the Planning Commission in writing and follow the requirements for relocation per Kentucky Revised Statutes and Kentucky Administrative Regulations. Copies of all required state and local applications and permits during the relocation procedure shall be submitted to the Planning Commission and Architectural Review Board. c. Discovery of an Unknown Cemetery: If a property owner or developer unintentionally discovers a cemetery during construction, which was previously unknown, all work in the immediate area shall cease immediately. The property owner or developer shall be responsible to report this disclosure to the Jessamine County/Wilmore Planning Commission and Agricultural Review Board. As a result, the following steps should be taken: (1). First, the property owner or developer has the option of stating in writing to the Planning Commission and the Architectural Review Board whether he or she will preserve the cemetery in accordance with these and state regulations or relocate the cemetery in accordance with state law. Either option will result in a submittal to the Planning Commission a revised subdivision plat, development plan and/or zoning permit to be reviewed and approved by the Planning Commission. Planning Commission staff and the Architectural Review Board shall be available to advise the property owner or developer of the benefits of cemetery preservation versus relocation. (2). Second, if a property owner or developer decides not to report the presence of a cemetery that is previously unknown and attempts to conceal any evidence that a cemetery ever existed and discovery of this fact is presented to the Planning Commission or Fiscal Court, then the Planning Commission shall notify the property owner or developer in writing to stop construction work in the area surrounding the cemetery. At the next regularly scheduled Planning Commission Meeting, the property owner or developer must be present to discuss the matter and offer a solution. This solution shall include the following: a. The boundaries of the cemetery shall be identified by a professional (Kentucky Registered) archaeologist at the expense of the owner or developer; b. The cemetery fence (if it exists) shall be repaired, replaced or reconditioned at the owner or developer’s expense. The cemetery’s condition shall be returned to its natural state and maintained per Section 3.9.2 and ownership shall be established per Section 3.9.1.; c. Inspection of the cemetery preservation work shall be done periodically by the Planning Commission Enforcement Officer to insure that the work is completed in a reasonable amount of time. 3.9.4. Subdivision Regulations for the Jessamine County/City of Wilmore a. Articles III and IV of the Subdivision Regulations for Jessamine County/City of Wilmore shall be amended to reference this section of the Jessamine County Zoning Regulations.

    2. Morning All, I just had a little something I wish to share with you. If you recall last year, Jessamine County Fiscal Court passed a Cemetery Ordinance. We explained at the time that Jessamine County was the first county in Central Kentucky to make such a move. Shortly after the Ordinance was past the Jessamine Co., Historical Society sent out letters to our neighboring counties. In the letter we sent a copy of the Ordinance, an a appeal for their help. Last evening Mark Boone, with TV channel #27 news called to inform me that Madison County, is looking into passing a similar Ordinance. Mark ran a story about it last night on the 6:00 o'clock news. He gave Jessamine County full create for getting to ball rolling. You folks played a big part in the passing of these Ordinances, and I want to thank you from the bottom of my heart. This years Jessamine Heritage Fest we have a lot of news coverage, so bring a big smile with you. I wish Tina was coming this year. She would tell them a thing or two. Newslist members, For those of you who might just now be contemplating attending the Fest with us in May, I am including here a copy of the proposed agenda that I received from Clyde Bunch and a list of the available lodging in Jessamine County. The agenda is not set in stone yet, but I expect only some minor changes, if any at all. Again, you can contact me if you are interested, as we need to try to keep a fairly accurate count of how many the Historical Society needs to prepare for. I look forward to seeing old friends and making new ones this year. Shelia The following was sent to me by Clyde Bunch, President of The Jessamine County Historical Society, who is the driving force behind all this: "I am sending you a rough agenda of what we have planned. However we won't stop planning until the day you all get here. Everyone here is being so helpful. We have not had one single person turn us down for anything. This says a lot for the people of Jessamine Co.. I think I grow more proud of the people here with each passing day." Just like last year the Historical Society will be open each day you all are here, with a few exceptions. Last year we had car tours of the county. I feel it best, this time we work more with the individual. We have a lot more people lined up this time to work, so we can spend more time with the individuals needs. We will find that old farm, cemetery, old records or whatever they came here looking for. The events we have planned were done, in appreciation for all the help and support you folks have given Jessamine County. With your help, we did a lot of good things last year, beyond our wildest dreams. If we accomplish as much with the upcoming Fest, as last year, we will be more then pleased. Clyde Monday - May 21, 2001 - 9:00 AM - Blue Building at the City - County Park in Nicholasville. ( From the courthouse on Main Street (US 27), go south approx. 1 mile, passing Edgewood Dr. and Edgewood Shopping Center. The next street is LONGVIEW ST., where you will turn left and follow it all the way to the end to the City-County Park.) A. Refreshment, compliments of the county and Judge Neal Cassity B. Welcome speakers, Jessamine County, Judge Neal Cassity, and Sam Corman, Mayor of Nicholasville, and others. C. Historical Societies of Mercer, Woodford and Garrard Counties will be present. They will have tables set up. We have ask them to bring their marriage, census records, tax records and anything that may be of interest to you. They will have some of these for sale. D. Ron Bryon is coming to speak with you. He is from the Kentucky Historical Society. Ron is one of the most knowledgeable persons in the state of Kentucky, when it comes to locating records. E. The folks from Shakertown will be here. They will be in full dress, and have a table set up show you a little sample of what is just across the river. F. I asked Howard Fain to come and set up a display. Everyone seemed to enjoy Howard the last time. (For those of you new to the event and to Jessamine County, Howard Fain is a local artist who has been capturing so much of the history of Jessamine County with his work. What better treasure to take back home than one of his pieces, depicting an area that important in your own ancestors lives. Shelia) Tuesday - May 22, 2001 This morning we have turned over to Mary Kozak, County Planner. I think she is planning something at Camp Nelson. I do not have the details on this now, but will post later. Wednesday - May 23, 2001 - 9:00 AM - Jessamine County Historical Society.This is clean up day for the Cemeteries. We could meet at the Historical Society this morning at9:00 have coffee and donuts. Remember to tell everyone to come prepared. Don't forget the long sleeve shirts, gloves, high top shoes, or boots, and if you have some tools bring them along also. I have already talked to Grag Kocher with the Lexington Leader about covering this. I think I will invite Chad Truelove to come also. Thursday - May 24, 2001 9:00 AM - Jessamine County Historical Society. We have ask Pattie Friend to come speak with us this morning. She is the new planner for downtown Nicholasville. She may give the new folks a quick tour of the town. 7:00 PM - This is our regular meeting of the Jessamine County Historical Society. I have put together a presentation on early Jessamine County. I did this with you folks in mind. I think you will like it. Friday - May 25, 2001 We have turned this morning over to Nancy Stone and the Jessamine Chamber of Commerce.     2. Morning All, Several people have e-mail me asking about the Maps of Jessamine County, that Jim recency posted on the Web. Many of you ask for a Hard Copy. The copies we posted were really not that good, and I know some of you found them hard to read. So, I tell you what I am going to do. When thing slow up a bit here, I think I will go to Frankfort and make new copies from the originals. I been wanting to do this for the Historical Society for quite sometime, but just never got around to it. I will let you know when we have the Maps ready. I wlll try to have the maps ready in time for the Fest. Every thing is going well on this end. All the big planing is out of the way. Is their anything, you can think of that we have missed? I got a feeling we are going to have a great time at the May Fest. When you get old folks like George excited, you have really done something.
